Dainik Jagran is guilty of the contempt of the Apex Court

The Supreme Court of India has taken cognizance of the contempt petition filed by the Indian Federation of Working Journalists (IFWJ) on behalf of the employees against Shri Sanjay Gupta, the CEO of Jagran Prakashan Limited. The bench of Justices Ranjan Gogoi and Rohinton Fali Nariman directed the Management of Jagran Prakashan Limited on 13th October to comply with the order of the court for the implementations of the Majithia Wage Boards recommendations within two month, if the same has already not been done. 

The Supreme Court of India has taken cognizance of the contempt petition filed by the Indian Federation of Working Journalists (IFWJ) on behalf of the employees against Shri Sanjay Gupta, the CEO of Jagran Prakashan Limited. The bench of Justices Ranjan Gogoi and Rohinton Fali Nariman directed the Management of Jagran Prakashan Limited on 13th October to comply with the order of the court for the implementations of the Majithia Wage Boards recommendations within two month, if the same has already not been done. 

Three employees of the Dainik Jagran, Avishek Raja, Ashok Kumar Rana and Sandeep Kumar Rai have said in their contempt petition that the Jagran management is guilty of willful and deliberate disobedience of the verdict of the Hon’ble Supreme Court.  The judgment of the Hon’ble Court was pronounced on 07th of February 2014 by the three-judge bench headed by the then Chief Justice P. Sathashivam consisting of Justice Ranjan Gogoi and Justice Shivakirti Singh.

It may be recalled that by dismissing all writ petitions of the top newspaper barons of the country, the Supreme Court had directed for the implementation of all recommendations without any change, with effect from 11.11.2011. Only some have implemented Wage Boards recommendations, many newspapers have not properly complied with. The biggest felony has, however, been committed by the Jagran Prakashan Limited, which claims to be highest read newspaper not only of India but also of the whole world in any language. This newspaper was also one of the petitioners, which impugned the Wage Boards recommendations before the Supreme Court.

Dainik Jagran has deep and pervasive readership in Uttar Pradesh, Uttarakhand, Himachal Pradesh, Punjab, Jammu & Kashmir, Haryana, Madhya Pradesh, Rajasthan, Bihar and Jharkhand. Jagran Prakashan Limited is the worst violators of labour laws and this time again; it has shown the temerity and the audacity by not even responding to the requests of employees to implement Majithia recommendations. What is even more shocking is that the management has taken the despicable recourse to harassing, victimizing and intimidating the employees.

After the pronouncement of the landmark judgment of the Hon’ble Apex Court, the management has brazenly removed dozens of employees, journalists and non-journalists included, and vindictively transferred many of them to insignificant places. The employees of Dainik Jargarna are living in the atmosphere of perpetual fear and terror. The counsel for the employees Parmanand Pandey, who is also the Secretary General of the ‘Indian Federation of Working Journalists’ (IFWJ) has stated with documentary evidence that the Dainik Jagran management is not paying even the fragment of salary and allowances to its employees, which has been recommended by the Wage Board.

According to latest balance sheet submitted by the newspaper to the Company Law Board (CLB) the annual turnover of the company is more than Rs. 1700/- crore and thus the Dainik Jagran newspaper falls in the category of the class I newspapers but the employees are deprived of even the minimum basic facilities and wages. The management of Dainik Jagran is known across the India for its notoriety, mischief and bloodsucking exploitative methodology against employees. This newspaper prominently claims on its masthead to be published from 35 centres from all over India but the number of regular employees does not go beyond four digits altogether. Most of the employees are appointed on the contract basis and they are paid abysmally low wages. Journalists are compelled to work much beyond the working hours than the prescribed under the Working Journalists Act, 1955.

The Apex Court will certainly take serious view of its contempt if Dainik Jagran management again fails to abide by the law of the land.

    Dainik Jagaran ke Malik Gupta ko ab Jail Jana hi chahiye.. Workers ke Khoon Choosney waley iss Kayar Malik aur uskey Tuchchey Managers ko Jail ki Hawa ab khila hi do Parmanand ji… Bahut Sataa liya inn “Namuraadon ney”… Supreme Court ki Jai…

    jagran hi kyo, aur bhi khurapati hai, sabhi akhbar maliko ka yahi kam hai , Workers ke Khoon Choosna , sab ko jail me dalo tabhi sudhrenge ye, abhi bhi koi tikdam karne ki soch rahe honge sale….

    please stand with fact and the fact is, the matter is su judice. Even the hon’ble supreme court passed a four lines order to three newspapaer management and owners , it did not issue so cause notice for contempt. Moreover IFWJ is also party in one of these case so the functionary of IFWJ should restrain to conclude anything which is not what hon’ble supreme is saying . yes, prima facie hon’ble supreme accepted the pleas of petitioners that management is not complying with its 7 feb 2014 direction and judgement .
    One thing more we wish to add that your news item describes Mr. Ashok Kumar Rana and Mr. Sandeep Kumar Rai employees of Dainik Jagran(JPL) , acctually both are ex employees of JPL.

    Truly barring the big newspapers at National level and State level small papers under no circumstances can implement the Majthia Wage Board. If scrutiny the papers it will be seen it is only the big papers who corners 90 per cent of the advertisements whether it is government or corporates.Rest 10 percent is distributed among the medium and small newspapers in the country.We have to be pragmatic in our approach while clamouring for implementation of the wage board recommendations whether these small papers will survive for a month. If these medium and small papers die then thousands of workers will be on the road and their families shall be ruined . Then who shall come to their rescue? At least now they get some salary which meets their daily expenses. If completely the sources are cut off then will the court, the lawyer Gonsalves and the so called leaders will pay from their income for their survival.The leaders are basking by hoodwinking these poor employees. When an owner will not be in a position to meet his own expenses wherefrom he shall make payments to the workers ? Do the leaders ever thought of it. Mere giving slogans and utopian speeches and press releases has no meaning. Several union leaders have no following nor members but claim thousands of members in their website to fool the government one is IJU of Sures Akhouri. They enjoy all government freebies at the cost poor taxpayers and fool their own fraternity. Similarly a.leader of a leading news agency has made crores by fooling his workers and through advertisements by publishing souvenirs which does not see the light and just mailed to advertisers to collect payment. Such are the characters of these leaders who are completely defunct of all morals and ethics.But poor workers have no choice, These leaders on one hand showed moon to the gullible workers and acted brokers of the management. These true colours of such leaders should be exposed .
    The managements on the other hand should earn the goodwill of their workers instead of being adamant but hike the salaries of their staff by negotiating with them and showing their correct financial positions.The workers will definitely understand their problems and support them instead of allowing them to depend on those leaders who are cheating them and putting the owners into bad light in public.
