It is respectfully stated that we, the undersigned, are working in Dainik Bhaskar at Jalandhar office in the state of Punjab.<\/p>\n

That the management here at Jalandhar has refused to release our salary for the month of December, 2008 on 7th instant.<\/p>\n

That the management is also not allowing us to mark attendance despite our presence for the last more than 2 weeks. \u00a0We have already informed your goodself regarding the situation vide our separate letters and telegrams too.<\/p>\n

That when we demanded our salary on 7th and 8th \u00a0of January were asked to leave the service by tendering our resignations and by making full and final settlement also which we resisted as we are not inclined to leave the present service.<\/p>\n

That refusal of payment of due wages is an offense under the Payment of Wages Act, 1936 and is civil and criminal offence also besides non-payment of legal dues entails penalty at the tune of 10 times as well as a penalty \u00a0of Rs. 750\/- per day till the payment of the dues.<\/p>\n

It is, therefore, requested that the management at Jalandhar office may kindly be directed to release our wages above said immediately failing which we shall, having no other alternative, be constrained to initiate legal proceedings as per law in the matter.<\/p>\n

It is further requested that the management may also be directed to allow us to mark our attendance since the respective dates we have not been allowed the same and for which we have informed your goodself already.<\/p>\n

We venture to bring to your kind notice that\u00a0 after gazette notification of 30% Interim Relief to newspaper employees, instead of complying with the notification by making payment of the interim relief, the newspaper employers have started termination of the services of their employees. The Dainik Bhaskar is the first to commit the unfair labour practice and have terminated the services of about 200 employees from its units in the country.<\/strong><\/p>\n

That while terminating the services of the employees, even mandatory provisions of laws have not been complied with & no termination order has been given to any of the employees. Instead of giving termination letters, the employees were pressurized to tender resignation even and from some of the workmen resignations have been obtained forcibly. \u00a0The workers who have refused to tender their resignations, have been refused duty and they are being pressurized in one way or the other for their resignations. These workers are also being threatened of their transfer to far off places.<\/strong><\/p>\n

That the Dainik Bhaskar Group have terminated the services of at least 36 workers from Jalandhar, Kapurthala and Amritsar.\u00a0 These workers are neither being assigned their duty nor they are being served any written notice. \u00a0The services of Sarvshri. Shiv Kumar, Sub-Editor, Ranjit Singh, Vijay Singh and Dinesh Kumar, all Pagemakers have been terminated at Amritsar office by forcibly obtaining resignations from them. Many more are in the process of termination.<\/strong><\/p>\n

That this group of paper is not making payment to their employees as per the recommendations of the Wage Boards and no labour law is being complied with by the management \u00a0of this newspaper group. That this group did not allow its employees to avail any kind of leaves, may these be casual, sick, earned or national & festival holidays. \u00a0No overtime work payments are being made and no other benefits as per the Working Journalists & Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 are given to the employees.<\/strong><\/p>\n

That on the other hand, this group avails each & every facility, given by the Government and its management gets davp as well as advp advertisements despite it does not comply with any of the Labour Laws. It is, therefore, requested to intervene in the matter immediately so that the payment of notified interim relief be made to the employees, enforce the recommendations of the Wage Board as well as provisions of the Working Journalists & Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 be complied with ensuring that the benefits under Law be given to the employees.<\/strong><\/p>\n
