Heard learned counsel for the petitioners, learned Standing Counsel who has put in appearance on behalf of Respondents No. 1 to 3 and perused the material on record. Learned counsel for the petitioners has contended that the respondent no. 2 passed an order dated 18.12.2009 directing the employers to deposit the amount due within 15 days from the date of order failing which the recovery proceedings would be initiated. It is contended that the said order has become final and it has not been challenged by the employers or any other authority.<\/p>\n

It is further argued on behalf of the petitioners that the impugned order, which has been passed, amounts to review of the earlier order dated 18.12.2009 without there being any basis for the same and the respondent no. 2 does not have any power to review his earlier order. Therefore the order impugned cannot sustained in the eye of law. Issue notice to the respondents no. 4 to 8 returnable within four weeks. Steps be taken within a week. Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, be filed within two weeks thereafter. List thereafter for orders.
