With reference to the said Article on the website \u201cbhadas4Media.com\u201d, under instructions from and on behalf of my client, IBN18 Broadcast Limited, the owners of the Hindi News Channel IBN7,I am serving you with this notice.<\/p>\n
1. You the abovementioned addressee no. 1 who are the registered owner of the Website have written and got published on the Website , the said Article on 03 May, 2010.<\/p>\n
2. At the outset I state that the contents of the said Article so published on the Website are absolutely false, incorrect, motivated and entirely defamatory. You have made false, wrong, concocted and motivated statements in the name of Prabhat Shunglu, by spreading rumour in the garb of disassociation of Prabhat Shunglu with my client. You may kindly note that Prabhat Shunglu is still very much associated with my client in the capacity of Editor Special Assignments. Further, in respect of other persons, you have failed to even follow the basic tenets of journalism. You have made these statements without verifying the veracity and correctness of the same from my client. Your statements are highly presumptuous, irresponsible and baseless and such statements made before the public have harmed the image, reputation and good -will of my client.<\/p>\n
3. It is pertinent to state even at the cost of repetition that you did not even bother and have failed to follow the very basic principle of journalism, which requires that the version\/reaction of all the parties related to news \/ matter must be obtained before publishing, and you also failed to verify and ascertain the true and correct factual position from my client before proceeding to publish the false, scurrilous, malicious and defamatory said Article.<\/p>\n
4. This notice is more specifically addressed to the addressee No. 1, since you are the publisher of the said Article on your Website, where not only the said Article has appeared in a prominent manner and continues to exist, the same was thrown open to the public for posting their comments on the said false news and the derogatory and defamatory comments received thereon from the subscribers were also posted on the Website, which signifies your concurrence to the same and therefore you are liable for all such comments as well.<\/p>\n
5. It was the duty of all you addressees to verify the contents of the said Article prior to publishing the same on the Website. By way of publication of the said Article on the Website you have caused irreparable loss and damage to the reputation and goodwill of my client which is spearheaded by eminent journalists of\u00a0 national repute in the filed of television journalism and belonging to one of the biggest media conglomerate in the country. You the addressees have failed to take proper care and exercise reasonable precaution and due diligence contrary to the accepted norms of journalism by publishing the said Article which is highly defamatory, concocted and contains false allegations against my client. It is your duty to act in a\u00a0 responsible manner by verifying the facts of the Article and not readily publish and print anything which comes your way.<\/p>\n
6. You the addressees have willfully and deliberately made statements which are baseless and without any substance with the intention to hurt and tarnish the image, reputation and goodwill of my client. All the addresses jointly and severally have made and published the defamatory Article\u00a0 in such a prominent manner with the intention to harm and with the knowledge and reason to know that such imputations will harm the reputation of my client.<\/p>\n
7. In view of the aforesaid facts and circumstances, all the addressees jointly and severally are inter alia<\/p>\n
(i) Guilty of defamation and are liable under Section 500, 501 and 502 of the Indian Penal Code, 1860;<\/p>\n
(ii) Including the Network Service Provider, Essar Domains are guilty of mis-utilising the internet network and may be liable for violation of the provisions of the Information Technology Act, 2000;<\/p>\n
