Need for FIR against Syed Ali Shah Geelani, Arundhati Roy and SAR Geelani<\/h2>\n

A matter of great seriousness has recently come up where Syed Ali Shah Geelani, Arundhati Roy and SAR Geelani have supposedly openly made seditious speeches at a meeting named Kashmir event “AZADI-The Only Way” was organized in LTG Auditorium, Copernicus Marg, Mandi House, New Delhi on\u00a0 21st October 2010.<\/p>\n

As per the newspaper and media reports, many speakers including Syed Ali Shah Geelani, Arundhati Roy and SAR Geelani had openly used seditious language and had conducted themselves in a manner that would easily amount to conspiracy to commit offences punishable by section 121 which is about waging, or attempting to wage war, or abetting waging of war, against the Government of India. Syed Geelani is reported to have spoken of “Kashmir’s complete independence from India” while Arundhati reportedly said that Kashmir should get Azadi from bhookhe-nange Hindustan\u2026India needs Azadi from Kashmir and Kashmir from India. S A R Gilani said-\u201cThe demand of Kashmir Azadi not only meant the Kashmir Valley but the entire Jammu and Kashmir and Ladakh. \u201d<\/p>\n

Section 124A of the IPC says Sedition is the crime where anyone \u201cby words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government established by law in India\u201d and section 121A talks of \u201cWhoever within or without India conspires to commit any of the offences punishable by Section 121\u201d. Thus, this seems to be prima-facie a crime under sections 121A and 124A of the Indian Penal Code.<\/p>\n

While Article 19 gives all citizens the right to freedom of speech and expression; Article 19(2) makes it very specific that \u201cNothing in sub clause (a) of clause ( 1 ) shall affect the operation of any existing law, or prevent the State from making any law, in so far as such law imposes reasonable restrictions on the exercise of the right conferred by the said sub clause in the interests of the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency or morality or in relation to contempt of court, defamation or incitement to an offence\u201d. Thus whoever, Syed Ali Shah Geelani, Arundhati Roy or SAR Geelani or anyone else, might have all the rights as a human being to have certain opinions and views and also to firmly believe in them but when it comes to expressing the views in public domain, each one of us have to adhere to the law of the land. There exists the paramountcy of law, as long as it exists in a given format and no one, including these three people can be considered to be above law. And when the matter is related with the basic integrity and unity of the Nation, the seriousness of the matter increases manifold. This is important because any laxity or relaxation on this account would always act as a motivating factor and precedence to others to take law in their own hands , to the extent of playing with the Nation\u2019s very basic foundations. The situation becomes all the more serious when the persons committing the crime are considered among the respected members of the society and claim to be intellectuals and thinkers in their own way. The crime being committed has been done in the most deliberate and intentional manner, very well knowing what exactly they were doing. Possibly they had a feeling and a thought that their crime would be overlooked and they could play with the law of the land in the way they want it to be. This, in fact, is the most dangerous part of the entire episode.<\/p>\n

In the light of the above deliberations and the above-mentioned legal provisions I have sent a letter to the Police Commissioner, Delhi Police stating the facts and my point of view upon it, urging him to get an FIR registered in this case against Syed Ali Shah Geelani, Arundhati Roy and SAR Geelani as per the provisions of law.<\/p>\n

There I have also put the point that since the program was very much an announced one (as can be seen from many Internet sites including http:\/\/www.kashmirglobal.com ) where the topic itself would have been sufficient to demand alacrity and preemptive action\u00a0 hence there is also a need to\u00a0 take suitable administrative actions, if any laxity and dereliction of duty is found on the part of any concerned authorities.<\/p>\n
