इलाहाबाद हाई कोर्ट की लखनऊ बेंच द्वारा सहारा क्रेडिट कोआपरेटिव सोसायटी लिमिटेड के स्तर पर, कथित रूप से की जा रही अनियमितताओं के सम्बन्ध में, आईपीएस अधिकारी अमिताभ ठाकुर तथा सामाजिक कार्यकर्ता डॉ नूतन ठाकुर द्वारा दायर पीआईएल की सुनवाई उस सम्बन्ध में दायर पुनरीक्षा याचिका के साथ की जाएगी।
याचिका के अनुसार सहारा क्रेडिट का पंजीयन बहु-राज्य सहकारी सोसायटी अधिनियम 2002 के अंतर्गत समान उद्देश्य वाले व्यक्तियों द्वारा अपने संसाधनों का सामूहिक हितों की सिद्धि हेतु उपयोग करने को किया गया। पर इसके विपरीत सहारा क्रेडिट द्वारा सहारा ई शाइन, सहारा ए सेलेक्ट, सहारा माइनर, सहारा एम बेनिफिट तथा सहारा यू गोल्डन जैसे स्कीम के माध्यम से सहारा इंडिया के कार्यकर्ताओं के जरिये पूँजी निवेश कराया जा सारा है, जो क़ानून से बचने का एक तरीका है और इससे निवेशकों के हितों को वास्तविक खतरा है।
अतः याचीगण ने इसकी जांच करा कर पूँजी निवेश के सम्बन्ध में देश में प्रचलित समस्त कानूनों का पूर्ण अनुपालन कराने की प्रार्थना की थी।
पूर्व में यह याचिका याचीगण द्वारा सम्बंधित बेंच के सामने बहस नहीं करने की बात कहे जाने पर ख़ारिज कर दी गयी थी पर आज याचीगण द्वारा इस सम्बन्ध में निशर्त माफ़ी मांगे जाने और कोर्ट के सामने पूरी बहस करने की बात कहे जाने पर जस्टिस इम्तियाज़ मुर्तजा और जस्टिस डीके उपाध्याय की बेंच ने इस पीआईएल को पुनरीक्षा याचिका के सामने सुनने का आदेश कर दिया।

Heard Sri Amitabh Thakur, petitioner no.1 and Dr. Nutan Thakur, petitioner no.2 in person. After hearing the arguments at some length, when the Court required the petitioner no.1 to answer certain queries on the issue as to how does he substantiate his submission that the schemes quoted in annexure no.1 to the writ petition are being run by respondent no.6, Sri Amitabh Thakur submitted that the perspective of the Court, vis-a-vis annexure no.1 and the schemes quoted therein, are different than his perspective.
On the aforesaid submission made, the Court specifically told Sri. Amitabh Thakur, petitioner no.1 that he is arguing the matter before a Court of law and that the Court is not supposed to enter into or entertain any kind of debate and further that when a person approaches the Court he has to substantiate his assertions and arguments. At this observation of the Court, Sri. Amitabh Thakur appeared dissatisfied and stated that he did not want to argue this matter any further.
Thereafter, when the Court required the petitioner no.2 to answer the queries, she also submitted that once the petitioner no.1 does not intend to argue the case before the Court, she also does not intend to do so.
In these circumstances, the Court is left with no option but to dismiss the petition.
Thus, the writ petition is hereby dismissed.
After passing the order, Sri. Amitabh Thakur, petitioner no.1 further submitted that what he intended to convey to the Court was that he did not want to argue the matter before this particular Bench.
We may, at this juncture, only state that Benches in the High Court exercise their jurisdiction as per roster assigned by Hon'ble the Chief Justice. The instant petition has been filed in the shape of Public Interest Litigation. As per roster determined by the Hon'ble Chief Justice, this Bench has been assigned the said jurisdiction. Further, no person who is a party to a proceeding before this Court can be permitted to argue cases before a Bench of his choice.
Accordingly, the aforesaid submission made by Sri. Amitabh Thakur, petitioner no.1 is hereby rejected. Order Date :- 10.3.2014/Shahnaz.
