\tKOCHI : Media has the right to report proceedings in open courts, the Kerala high court said on Monday. A committee consisting of all the judges of the high court had earlier decided that reporting of open court proceedings need not be allowed.<\/p>\n
\tThe clarification by a division bench comprising of Justice K T Sankaran and Justice M L Joseph Francis was along with ending proceedings related to contempt of court action against Times of India for a report based on open court proceedings. On Monday, Justice Sankaran said media can report proceedings in open court and there is no ban on it.<\/p>\n
\tWhile media is free to report arguments presented by counsels of both sides, caution should be exercised while reporting the comments of judges. If a comment by a judge during hearing gets reported by media and the final judgement happens to be opposite to the comment, it would give the impression that the judges came to be influenced, the court said.<\/p>\n
\tFurther, justice Sankaran said the comment or question posed to the counsels appearing for the parties are intended to know the arguments of the counsel fully and is not an opinion of the court. The opinion of the court will only be stated in the judgement in the case, the bench that is presently hearing the appeals of the accused in Suryanelli sex case of 1996 said.
