\tThe release of Dr. Khalil Chishty. <\/p>\n
\tI am making this appeal to you in the name of humanity for release of Dr. Khalil Chishty, who is at present in the Ajmer Central Jail, so that he can go back to his home and family in Karachi, Pakistan.<\/p>\n
\tDr. Chishty was an eminent Professor of Virology in Karachi University, and holds a PhD from Edinburgh University. He is presently about 80 years of age and has several ailments. He is a heart patient, and has a fractured hip, and is unable to walk.<\/p>\n
\tHe had come to India in 1992 to meet his ailing mother in Ajmer. It appears that some quarrel took place at that time between Dr. Chishty’ family and their collaterals and as a result one person was killed. Several persons were implicated in the FIR, including Dr. Chishty. Dr. Chishty was granted bail but on the condition that he should not leave Ajmer and report to a police station every fortnight, which condition he complied with.<\/p>\n
\tThe criminal case went on for 19 years, and ultimately the judgment of the Ajmer District Court was delivered in January 2011 awarding life sentence to the accused including Dr. Chishty.<\/p>\n
\tDr. Chishty filed an appeal in the Rajasthan High Court, which was heard finally in July 2011 and judgment reserved, but as yet the judgment has not been delivered. The prayer for suspension of his sentence was rejected.

\tI had made an appeal to the Prime Minister Shri Manmohan Singh in the month of April 2011 requesting him to grant a pardon under Article 72 of the Constitution to Dr. Chishty. The Prime Minister referred the matter to the Home Minister Mr. P. Chidambaram. I wrote to Mr. Chidambaram, but to no avail. I then wrote to the Rajasthan Governor, Shri Shivraj Patil but he did not even show the courtesy of replying to my letter, although at that time I was a sitting judge of the Supreme Court of India.<\/p>\n
\tIn this connection I may mention that I had made an appeal to the Pakistan Government to release one Shri Gopal Das who had been in a Pakistan prison for a long period. The Pakistan Government honoured my appeal and released Gopal Das who returned to India. I am sad that while the Pakistan Government honoured my appeal, the Indian Government has not done so.<\/p>\n
\tIn these circumstances I make an appeal directly to you as my appeal to the aforementioned three authorities have been to no avail. I may mention that according to the decision of the Supreme Court in Nanavati’s case, AIR 1961 S.C, 112 a pardon can be granted even if a case is pending.<\/p>\n
\tDr. Khalil Chishty is an old man of about 80 years and does not have very long to live. It would be a disgrace for our country if he dies in jail. On the other hand, the prestige of our country will go up if he is released forthwith.<\/p>\n
\tI therefore fervently appeal to you in the name of humanity to intervene in the matter and immediately get Dr. Chishty released. Please treat this as most urgent.<\/p>\n
