The filing of Special Leave Petition in the Supreme Court by the UP government against Allahabad High Court order seeking response on CBI enquiry inYadav Singh scam in 4 days has been heavily criticized by social activist Dr Nutan Thakur who had earlier filed a similar PIL in the Lucknow bench.\u00a0\u00a0 In a letter to the Chief Minister Akhilesh Yadav she has asked what was the hurry and need for the State government to move Supreme Court instead of responding to the queries raised by the High Court. She said the State litigation policy specifically mentions that appeals in Supreme Court shall be made in extraordinary cases and when there was enough opportunity to respond before High Court, moving to Supreme Court in such serious corruption case and spending huge money on costly lawyers like Salman Khurshid was complete waste of public exchequer. Saying that this act of moving Supreme Court for a known corrupt person has sent wrong messages all across, Dr Thakur has asked for enquiry and fixing of responsibility for filing this petition.<\/p>\n

There are serious allegation in the writ petition with regard to the involvement of sons of very prominent leader of the ruling party and his other relatives. Recovery of Rs. 10 crore was made from the boxes placed under the seat of a White Audi Car A 6 registered in the name of Mr. Namrata Manocha, who is stated to be one of the directors in Mcconn Infra Private Limited Construction Company along with Mr. Yadav Singh, who at the relevant time was posted as Chief Engineer Yamuna Express Way, Chief Engineer, Noida as well as Chief Engineer Greater Nodia. It has been stated that Yadav Singh had got 35 fake companies registered at Kolkata. It has also been stated that one of the companies involving Yadav Singh, namely, N.M. Buildwell Pvt.Ltd. has son of a prominent leader of a political party who is also a member of parliament as a Director \/partners . It has been stated that Yadav Singh is only a regulator of Funds generated through illegal and corrupt practices by political leader of various parties.
Petitioner has informed that till date even an F.I.R has not been registered in respect of recovery of Rs. 10 crore from the Audi Car for reasons best known to the State.
We need not go to the details of the allegations made at this stage but we do find, that a prima facie case is made out for a response from the State Government.The State Government must disclose as to why First Information Report has not been registered till date in respect of the recovery of Rs. 10 crore. The State must also respond to the allegations made in the writ petition including the plea that an enquiry be got done qua the offences as alleged by an independent agency not within the control of the State Government, namely, C.B.I. in the facts of the case.
Response must be filed by Friday i.e. on 19.6.2015. Shri Kailash Prakash Pathak, learned counsel for the respondents no. 3 and 8 may also file response by Friday.

Shri Ravindra Kumar, learned counsel accepts notice on behalf of Noida Development Authority, Respondent No.4 herein. The contention of the learned senior counsel for the State of U.P. is that the State Government has already appointed a retired Judge of the Allahabad High Court to inquire into the matter and the report is yet to be submitted. It has also been stated that a Public Interest Litigation has already been filed before the\u00a0 Lucknow Bench of the Allahabad High Court bearing No.12396 (MB)(PIL) of 2014, which is still pending. The High Court was not at all justified in entertaining the Writ Petition and asking the State to file reply within four days. In view of the above, until further orders, we deem it fit and appropriate to stay further proceeding in Writ Petition No.35009 of 2015 titled “Jitendra Kumar Goel vs.State of U.P. and Ors.”.<\/p>\n

The filing of Special Leave Petition in the Supreme Court by the UP government against Allahabad High Court order seeking response on CBI enquiry inYadav Singh scam in 4 days has been heavily criticized by social activist Dr Nutan Thakur who had earlier filed a similar PIL in the Lucknow bench.\u00a0\u00a0 In a letter to the Chief Minister Akhilesh Yadav she has asked what was the hurry and need for the State government to move Supreme Court instead of responding to the queries raised by the High Court. She said the State litigation policy specifically mentions that appeals in Supreme Court shall be made in extraordinary cases and when there was enough opportunity to respond before High Court, moving to Supreme Court in such serious corruption case and spending huge money on costly lawyers like Salman Khurshid was complete waste of public exchequer.
