किसान और मज़दूर विरोधी भू-अधिग्रहण अध्यादेश के विरोध में आंदोलन, ट्रेड यूनियन और राजनीतिक दल एकजुट

दिनांक 23-24 जनवरी 2015 को केंद्र सरकार द्वारा वर्ष 2014 के आखरी हफ्ते में लाये गए भूमि अधिग्रहण अध्यादेश के विरोध में जनान्दोलनों के राष्ट्रीय समन्वय (NAPM), अखिल भारतीय वन-जन श्रमजीवी यूनियन (AIUFWP), जनसंघर्ष समन्वय समिति, छत्तीसगढ़ बचाओ आन्दोलन, इंसाफ, दिल्ली समर्थक समूह एवं अन्य संगठनों ने मिलकर दिल्ली के दीन दयाल मार्ग स्थित नेहरु युवा केंद्र में दो दिवसीय राष्ट्रीय अधिवेशन का आयोजन किया. सभा में उत्तर प्रदेश, उत्तराखंड, बिहार, झारखण्ड, राजस्थान, महाराष्ट्र, मध्य प्रदेश, छत्तीसगढ़, पश्चिम बंगाल, हिमाचल प्रदेश, हरियाणा के किसान और मज़दूर संगठनों के प्रतिनिधि शामिल हुए.  इस अधिवेशन के पहले दिन केंद्र सरकार द्वारा लाये गए अध्यादेशों पर विस्तारित चर्चा हुई और भू-अधिग्रहण अध्यादेश के विरोध में देश व्यापी प्रतिवाद खड़ा करने की योजना बनायी गयी, जबकि दूसरे दिन जन सभा आयोजित की गयी जिसमे विभिन्न राजनितिक दलों के नेताओं ने भू-अधिग्रहण के सम्बन्ध में अपने विचार रखे.

अधिवेशन ने इस बात को रेखांकित किया कि लाया गया भू-अधिग्रहण अध्यादेश देश  की संसदीय जनतांत्रिक प्रणाली पर किया गया आघात है क्योंकि ये अध्यादेश संसद में बिना चर्चा कराये दोनों सदनों (राज्य सभा व लोकसभा) के सत्रावकाश के दौरान चोर दरवाजे से उस समय लाये गए हैं जब अगले दो महीने में ही संसद के सत्र चलेंगें. ये अध्यादेश भारतीय संविधान के अनुच्छेद 123 की घोर अवमानना का निर्लज प्रदर्शन हैं जो कहता है कि इस प्रकार के अध्यादेश केवल विशेष परिस्थितियों या आपातकालीन स्थितियों में लाये जा सकते हैं.

भारतीय संविधान के अनु 39 B में प्राकृतिक संपदाओं पर देश के नागरिकों के अधिकार को परिभाषित किया गया है. लेकिन नया भू-अधिग्रहण अध्यादेश भारतीय संविधान के विरोध में खड़ा होते हुए प्राकृतिक संसाधनों को कंपनियों के हवाले कर देने के और अग्रसर है. इसलिए अध्यादेश जन विरोधी होने के साथ-साथ संविधान की मूल भावना के विरुद्ध है. 

सरकार ने इन अध्यादेशों के जरिये एक ही झटके में जल, जंगल, जमीन ओर खनिज पर लोगों को प्राप्त हुए सिमित अधिकार को ख़तम करते हुए कंपनियों के लिए भूमि अधिग्रहण के रास्ते को बहुत ही आसान बना दिया है. किसानों और मज़दूरों के लिए ज़मीन का मामला उनके अस्तित्व से जुड़ा होता होता है, इसलिए उन्होंने भारत की सडकों पर अपने अस्तित्व और रोजी रोटी की खातिर बरतानिया हुकूमत द्वारा बनाये गये सन् 1894 के भू-अधिग्रहण कानून को बदले जाने के लिए खून बहाया, और आदिवासियों तथा किसानों के ढेरो आंदोलनों और कुर्बानियों के बाद पिछली सरकार “भूमि अर्जन, पुनर्वासन और पुनव्यर्वस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार कानून, 2013 ” नाम से औपनोवेशिक भूमि अधिग्रहण कानून में बदलाव लाने के लिए बाध्य हुई थी.

हालाँकि संशोधित कानून भी जमीनों को अधिग्रहित करने का ही कानून था जमीनों को बचाने का नही, फिर भी वह कानून भूमि अधिग्रहण की प्रक्रिया में संविधान के तहत स्थापित स्थानीय स्वशासी संस्थाओं और ग्रामसभाओं से परामर्श लेने तथा 70% किसानों के सहमती के प्रावधानों को रखता था. उस कानून में भूमि अधिग्रहण से पहले विकास परियोजनाओं के सामाजिक प्रभाव के अध्ययन का उल्लेख था और कहा गया था कि भूमि अधिग्रहण का कुलपरिणाम ऐसा होना चाहिए कि वह प्रभावित लोगों के लिए गरिमामय जीवन का रास्ता तैयार कर सके, और इस मकसद से भू-अधिग्रहण से पहले परियोजनाओं के सामाजिक प्रभाव के आकलन का स्पष्ट प्रावधान था. परन्तु मोदी सरकार द्वारा लाये गए नए भू-अधिग्रहण अध्यादेश में कॉर्पोरेट के निहित स्वार्थ में इन सारे प्रावधानों को तिलांजलि दे दी गयी है और इसके साथ ही साथ वनाधिकार कानून 2006, वन संरक्षण कानून आदि जैसे 13 अन्य कानूनों को भी अध्यादेश के अन्तर्गत लाया गया है, जिसके वजह से लोगों के अधिकारों को निहित करने वाले जनपक्षीय कानून निष्प्रभावी हो जायेंगें, और सरकार तथा कंपनियों द्वारा व्यक्तिगत और सार्वजनिक ज़मीनों के अधिग्रहण/अतिक्रमण की प्रत्येक कार्यवाही कानूनी प्रक्रिया के दायरे से मुक्त हो जायेगी. 

अधिवेशन ने फौरी तौर पर अध्यादेश के विरोध में निम्न कार्यक्रम तय किये –

1.  26 जनवरी को पूरे देश भर में ग्रामसभाओं द्वारा भू-अधिग्रहण अध्यादेश के विरोध में अध्यादेश पारित किये जायेंगें.

2. 30 जनवरी 2015 को गाँधी जी के शहादत दिवस पर पूरे देश में अध्यादेश की प्रतियां जलाई जायेंगीं.

3.   देश भर में जिला मुख्यालयों, भाजपा के कार्यालयों के समक्ष अध्यादेश के विरोध में धरना दिया जाएगा.

4.   गैर भाजपा शासित राज्यों की विधान सभाएं इस अध्यादेश के खिलाफ प्रस्ताव पारित करें, इसके लिए राज्यों के सत्ताधारी पार्टियों के नेताओं से संवाद कायम किया जाएगा.

5.   संसद के बजट सत्र के शुरुआत में एक दिन (Feb 22/23) देश के सभी जिलों में प्रतिवाद कार्यक्रम आयोजित किया जाएगा, और जंतर मंतर पर भी एक विशाल धरना आयोजित किया जाएगा.

6.   20मार्च 2015 से 8 अप्रैल 2015 के बीच राष्ट्र व्यापी यात्रा आयोजित की जायेगी.

7.   जन आंदोलनों की सामूहिक पहल के तौर पर जमीनों के अधिग्रहण, उपयोग, आवंटन और प्रस्तावित अधिग्रहण के ऊपर एक श्वेत पत्र ज़ाहिर किया जायेगा

A two-day national convention was organised on 23rd – 24th January at Nehru Yuva Kendra in New Delhi against the Land Acquisition Ordinance passed by the central government in the last week of 2014. The convention was organised by National Alliance of Peoples Movements (NAPM), All India Union of Forest Working People (AIUFWP), Chhattisgarh Bachao Andolan, Jan Sangharsh Samanvay Samiti, INSAF, Delhi Solidarity Group, Right to City Campaign and other groups. The first day saw discussions on different aspects of the ordinance and its implications followed by building of strategies for nation-wide protests to be organised against the land acquisition ordinance. Representatives of farmers and workers organisations from uttar pradesh, Madhya Pradesh, Bihar, uttarakhand, Rajashtan, Himahcal Pradesh, haryana, Chattisgarh, WestBengal and other states joined the convention. There was widespread participation from members of various political parties and trade unions who came together to express solidarity and support in the public meeting on the second day.

The bypass of parliamentary procedures by virtue of passing the ordinance through the back door was highlighted in the convention; which avoided any debate or discussion in both houses of the Parliament, even when the parliament sessions are scheduled in a month’s time. It is an onslaught and attack on the democratic parliamentary procedures, since the 2013 Act was passed after arriving consensus of all stakeholders over a period of nearly seven years. It is a shameless attempt by the government with gross violation of Article 123 of the constitution, which allows for ordinances to be passed for only ‘urgent’ and ‘extraordinary’ situations.

Article 39(b) of the Indian Constitution defines the rights of citizens over natural resources which have been blatantly violated by following an ordinance route, aiming to hurriedly pass natural resources in the hands of huge corporations; hence against the basic principles of the Indian Constitution in addition to it being extremely anti-people.

The government has dismantled the already limited rights of citizens recognised over natural resources including land, water, forests and minerals to ease the way for the process of land acquisition, even when government land banks have lakhs of hectares of unused acquired land in every state, to acquire more of productive agricultural land, putting food sovereignty and the lives of the majority of its population at risk.

The question of land is detrimental to the identity and existence of farmers and workers, for which they have lost many lives on the streets in many farmers and adivasi andolans against the colonial and draconian land acquisition act of 1894, which had compelled the previous government to pass the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013.

Although the amended act of 2013 was also the law for acquisition, and not for its fair use, redistribution or much needed land reform, it still, however, recognised the constitutional consultative and self-determining role of local self-governing institutions in the process of land acquisition, with the consent of 70 – 80 percent of the farmers. The 2013 Act envisioned a life of dignity for people being affected by land acquisition for development projects, with provisions for the social impact assessment, recognising the requirement of assessing the impact on the society prior to the sanction of land for projects.

However, the ordinance passed by the Modi government has generously exchanged these provisions in favour of the vested corporate interests and has brought the progressive legislations such as the Forest Rights Act, 2006 and Forest Conservation Act in its ambit, diluting other provisions which have recognised the natural and constitutionally guaranteed rights of the people to life with dignity – an inviolable part of Fundamental Rights. It would also free every processes of acquisition and encroachment of land by corporations and government of legal intervention.

The convention chalked out the following programmes for the protests against the ordinance –

    Resolutions would be passed in Gram Sabhas across the country against the land acquisition ordinance on 26th January.

    Copies of the land ordinance would be burnt across the country on the death anniversary of Mahatma Gandhi, January 30.

    Dharnas in protest of the ordinance would be organised at district HQs, State Capital, and BJP offices across the country.

    Dialogues would be established with leaders of ruling parties in non-BJP ruled states to pass resolutions against the ordinance in their respective state assemblies.

    Coordinated programmes to be organised for a day (Feb 22 or 23) at all district headquarters in protest during the budget session of the Parliament, along with a huge dharna at Jantar Mantar in Delhi.

    Nation-wide yatras to be organised from 20th March to 8th April 2015 to create wider participation and support from people across the country.

    People’s Movements to release a white paper on land acquired, used, land bank, proposed acquisitions etc. as has been demanded by the movements over a period of time.

The public meeting on 24th January was addressed by Medha Patkar (Narmada Bachao Andolan – NAPM), Com Kavita Krishnan (CPI [ML]), Com Hanan Maula (CPIM), Captain Ajay Rao (Congress), Aam Aadmi Party leader Yogendra Yadav, Sh Pandey (Bhartiya Mazdoor Sangh), Dr. Prem Singh (Socialist Party of India), Roma (AIUFWP), Vijay Panda (Adivasi Mukti Sangathan – CSD)  among other leaders from political parties, trade unions and representatives of peoples movements.
