लखनऊ : खनन मंत्री गायत्री प्रसाद प्रजापति के खिलाफ दायर परिवाद में सामाजिक कार्यकर्ता डॉ नूतन ठाकुर ने लोकायुक्त जस्टिस एन के मल्होत्रा को शासन के सीधे हस्तक्षेप से अवैध खनन पट्टा दिए जाने के सम्बन्ध में एक और हलफनामा प्रस्तुत कर दिया है.
हलफनामे में कहा गया कि 31 मई 2012 के शासनादेश द्वारा कहा गया था कि प्रदेश में बालू, मौरंग, बजरी और बोल्डर के रिक्त क्षेत्रों का पट्टा उ०प्र० उपखनिज (परिहार) नियमावली 1963 के अध्याय 4 के अंतर्गत ई-टेंडरिंग प्रणाली के माध्यम से ही होगा.
इस शासनादेश को नरनारायण मिश्रा मामले में इलाहाबाद हाई कोर्ट में चुनौती दी गयी जहां इसे सही बताते हुए कहा गया कि 31 मई 2012 से पूर्व सभी विचाराधीन नए खनन पट्टे व नवीनीकरण के खनन पट्टे निरस्त किये जायें. कोर्ट ने यह बात पुनः सुखन सिंह तथा मो० अकील केस में भी कही.
डॉ ठाकुर के अनुसार इसके बाद भी इन आदेशों के उल्लंघन ने श्री प्रजापति के कार्यकाल में हमीरपुर में 48 और जालौन में 20 खनन पट्टे यद्यपि डीएम द्वारा दिए गए पर इनकी अंतिम स्वीकृति शासन द्वारा ली गयी जो श्री प्रजापति की संलिप्तता की ओर इशारा करता है.
उन्होंने इसके अलावा धर्मेन्द्र कुमार द्वारा उनके खिलाफ लोकायुक्त कार्यालय के सामने मारपीट कर शर्ट फाड़ने और घडी तोड़ने के झूठे मुकदमे की भी सूचना देते हुए बताया कि उस समय वे स्वयं लोकायुक्त के सामने मौजूद थीं.

In the complaint presented against mining Minister Gayatri Prajapati, social activist Dr Nutan Thakur today presented another affidavit before Lokayukta Justice N K Malhotra as regards grant of illegal mining lease on direct intervention of State government.
The affidavit says that the Government Order dated 31 May 2012 says that lease of sand, Mauran, bajari, boulder etc on free areas shall be through e-tendering as given in chapter IV of UP minor minerals (concession) rules 1968.
This GO was challenged in Allahabad High Court in Narnarain Mishra case where it upheld the GO saying that all applications pending on 31 May 2012 for fresh and renewal of lease shall be cancelled. The Court stated this again in Sukhan Singh and Md Aqil case.
As per Dr Thakur, despite these orders, 48 such lease grants have been given in Hamirpur and 20 in Jalaun during Sri Prajapati’s tenure. Though these grants have been given by DM but they have been formally approved by the State government before issuing the lease grant, which points towards direct complicity of Sri Prajapati.
She has also said before the Lokayukta that one Dharmendra Kumar has given false complaint against her of breaking his watch and tearing his shirt in front of Lokayukta office at the time when she was sitting before the Lokayukta himself.
