A Public Interest Litigation has been filed in Lucknow bench of Allahabad High Court today as regards the Rs. 104 crores cash money deposited\u00a0 in old currency by Bahujan Samaj Party between 02 December 20 to 09 December 2016 in the Party\u2019s Union Bank of India bank account in Karol Bagh branch, New Delhi after the demonetization order. Petitioner Pratap Chandra\u2019s counsel Dr Nutan Thakur said that the Election Commission had issued Guidelines for financial transparency on 29 August 2014 which had been further clarified through its order dated 19 November 2014.<\/p>\n
These Guidelines say that any political party must deposit its cash collections in its bank account within 10 working days of the fund collection. These directions say that if any political party violates these Guidelines, action including cancelling the recognition of the political party can be taken under the provisions of Para 16A of the Election Symbols (reservation and Allotment) Orders 1968.<\/p>\n
Dr Thakur said that since the demonetization order came on 08 November 2016, hence as per these directions, the cash deposit in old currencies should necessarily have been undertaken by 20 November but BSP deposited Rs. 104 crores between 02 December to 20 December, which is a clear violation of these Guidelines. Hence the petition prays for directing the Election Commission to take cognizance of these facts and issue notice to BSP and take appropriate action under Para 16A of the Election Symbol Order.<\/p>\n
