: निमेष आयोग का हश्र श्रीकृष्ण आयोग जैसा नहीं होने देगा रिहाई मंच : लखनऊ। समाजवादी पार्टी के कुछ सांसदों द्वारा राज्यसभा में आतंकवाद के नाम पर बेगुनाहों की गिरफ्तारियों पर सवाल उठाने को रिहाई मंच ने मुसलमानों को बेवकूफ बनाने का शिगूफा करार दिया है। अलीगढ़ में रिहाई मंच की बैठक के बाद जारी बयान में मंच के अध्यक्ष एडवोकेट मो शुऐब और इंडियन नेशनल लीग के राष्ट्रीय अध्यक्ष मो सुलेमान ने कहा कि एक तरफ तो उत्तर प्रदेश की सपा सरकार बेगुनाहों को छोड़ने के अपने चुनावी वादे से मुकर गयी है वहीं संसद में इस सवाल को उठाकर मुसलमानों को गुमराह करने की कोशिश कर रही है।
उन्होंने एक प्रतिनिधिमंडल में शामिल रामगोपाल यादव द्वारा प्रधानमंत्री से यह कहने पर कि उनकी सरकार तो बेगुनाहों को छोड़ना चाहती है लेकिन हाईकोर्ट के स्टे के कारण ऐसा नहीं कर पा रही है, को झूठ और बेबुनियाद करार देते हुए कहा कि कोर्ट ने ऐसा कोई स्टे आर्डर नहीं दिया है। रिहाई मंच के नेताओं ने कहा कि मुलायम सिंह के भाई और मंत्री शिवपाल यादव कहते हैं कि किसी भी आरोपी को नहीं छोड़ा जाएगा वहीं दिल्ली में उनके भाई रामगोपाल कभी प्रधानमंत्री से मिलकर तो कभी राज्यसभा में आतंकवाद के नाम पर बंद मुसलमानों का सवाल उठाने का नाटक करते हैं। जिससे जाहिर होता है कि या तो सपा में इस मसले पर एकराय नहीं है या फिर मुलायम सिंह का कुनबा
इस मसले पर मुसलमानों को गुमराह कर रहा है। उन्होंने कहा कि ऐसे में यह जरूरी हो जाता है कि मुलायम सिंह इस पर अपनी पार्टी की स्थिति स्पष्ट करें क्योंकि मुसलमानों ने सपा को बेगुनाहों को छोड़ने के वादे पर ही वोट दिया था। नेताओं ने सपा सरकार पर आतंकवाद के नाम पर बंद बेगुनाहों के सवाल पर धोखा देने का आरोप लगाते हुये कहा कि सरकार के पास कचहरी विस्फोटों के आरोप में पकड़े गये तारिक और खालिद की गिरफ्तारी के सवाल पर गठित आरडी निमेष जांच आयोग की रिपोर्ट 31 अगस्त से ही है। लेकिन उसे जारी करने के बजाये लखनऊ जेल में बंद निर्दोषों का लगातार उत्पीड़न जारी है।
इसका प्रमाण तारिक कासमी का जेल से भेजा गया वह पत्र है जिसमें उन्होंने उत्पीड़न की दास्तां बयान करते हुये बताया है कि छोटे से कमरे में बंद नौजवानों को जेलर शराब के नशे में साम्प्रदायिक गालियां देते हैं, जिसके चलते इन युवकों में आत्महत्या की प्रवृत्ति भी आ रही है। उन्होंने कहा कि यह पत्र सभी अखबारों में छपा और मानवाधिकार संगठनों ने साम्प्रदायिक जेलर को हटाने की मांग भी की व विधान सभा के सामने धरना भी दिया। लेकिन सपा सरकार ने इस मांग को नहीं माना जिससे उनका उत्पीड़न आज भी जारी है। मुआवजे के नाम पर मुसलमानों से सहानुभूति बटोरने की कोशिश करती सपा बताए कि उसने दसियों साल बाद बेगुनाह रिहा हुए कानपुर के वासिफ हैदर, मुमताज, हाजी अतीक अहमद, सफात रसूल, गुलाम जिलानी खान, जुबैर अहमद व तीन साल बाद बेगुनाह रिहा हुए सीतापुर के सैयद मुबारक समेत दर्जनों युवकों के मुआवजे और पुर्नवास के लिए अब तक क्या किया।
मोहम्मद शुऐब और मोहम्मद सुलेमान ने कहा कि रिहाई मंच आर डी निमेष जांच आयोग का हश्र मुम्बई दंगों पर गठित श्री कृष्ण आयोग की रिपोर्ट जैसी नहीं होने देगा जिसके तथ्यों को तो सभी जानते हैं जो अखबारों में भी खूब छपा लेकिन सरकारी तौर पर कभी जारी नहीं हुआ। उन्होंने कहा कि आतंकवाद के नाम पर मुस्लिम समाज के हो रहे उत्पीड़न का पर्दाफाश करती निमेष आयोग की
रपोर्ट पर मुसलमान 2014 में सपा को जवाब देगा। इस अभियान के तहत रिहाई मंच 12 दिसम्बर को आजमगढ़ में जहां से तारिक कासमी को और 16 दिसम्बर को मड़ियाहूं जौनपुर में जहां से खालिद को उठाया गया था और 22 दिसम्बर को बाराबंकी में जहां से एसटीएफ ने इन बेगुनाहों को पकड़ने का झूठा दावा किया था, में विरोध प्रर्दशन करेगा।
रिहाई मंच के प्रवक्ताओं शाहनवाज आलम और राजीव यादव ने बताया कि जिस इलाहाबाद हाई कोर्ट की टिप्पड़ी के नाम पर समाचार माध्यमों द्वारा आरोपियों को छोड़कर पद्म भूषण देने की बेबुनियाद बातें प्रसारित की गईं उसके खिलाफ इलाहाबाद हाई कोर्ट के वरिष्ठ अधिवक्ता फरमान नकवी ने प्रेस काउंसिल के अध्यक्ष मारकंडे काटजू को पत्र लिखकर शिकायत की है क्यों कि पद्म भूषण की कोई बात कोर्ट के रिकार्ड में नहीं है।

In a latest case PIL (Criminal) No. 16559/2012 (Naitya Nand Chaubey and another vs State of UP and others) which was filed in Allahabad High Court against the so called “would be” decision of UP govt. relating to withdrawal of cases against some youths ( dated 3.09.2012). The High court only asked State to file its reply vide its order dated 29.11-2012, but our enthusiastic media adorning “prejudiced Frames” had gone beyond unimaginable heights by putting their own prejudiced thoughts in the mouth of Judges and quoted them as,”Meanwhile, the Allahabad High Court on Thursday had lashed out at the state government for its initiative to withdraw terror charges against those accused of the 2006 Varanasi serial blasts. A bench of Justice RK Agarwal and Justice RSR Maurya wondered if the government’s move will end up encouraging terror activities. “Who will decide if a person is a terrorist or not? Since the cases in question are pending before the court, it should be left for the courts to decide.” The court also observed, “Today the government wants to withdraw cases against terror accused. Tomorrow they will be decorated with Padma Bhushan.” The judges made these observations while hearing a PIL by social activists Nityanand Chaubey and Rakesh Nayayik of Varanasi
questioning the government’s move to withdraw the cases. The petitioners’ counsel informed the court that the state government had already issued orders dated October 31, 2012 seeking the comments of the prosecution on withdrawing of cases against Waliullah and Shameem, arrested in connection with the March 7, 2006 serial blasts in Varanasi, despite the fact that they had confessed their involvement. Waliullah’s interrogation had also led to recovery of items used in the terror attack. Although no such orders are part of record of these proceedings in High Court. Neither in the order dated 20.11.2012 nor order dated 22.11.2012 nor on 29th November any such reference is made. Sri Shashi Shankar Tripathi had been quoted in media that on 29th November Hon’ble Shiva Kirti Singh,Acting Chief Justice that “the action amounts to waging war against country”.The counsel appearing in this case Sri Shashi Shankar Tripath had also sent an sms of the same nature attributing such order by Honorable Shiva Kirti Singh, Acting Chief Justice on my friend’s mobile no. 9793512969 today in after noon.
Sir, my concern is that these people in the media are going beyond their limits of freedom and are apparently being used by unscrupulous persons to fulfill their own political and prejudiced agendas by using these types of innocuous and normal court orders, which cannot be allowed to be done. The Courts cannot be left as a pawn in their hands and this type of Media persons who place fictitious things in news mold in the name of court orders cannot be allowed to roam free. They are liable to be handled with iron hands.
