Builder, Politician and Police harressment and torture

Respected Sir, I Rajkumar Bansal  want to invite your kind attention on my problem i am facing in virar -thane district area. I had issued notice to builder for some of his illegal acts like selling away car parking,not giving account audits, after that builder start harressing to me and my family and sending local gundaas and using political pressure on me and from last one and half year they are harressing me,giving various type of dhamki jaan se maarne ki and police is not taking any action even not filling  F.I.R or any N.C.. and under R.T.I. I asked police regarding my matter they replied inquiry is going, in 9 months no action . If possible sir print my story how if anyone raise his voice against illegal activities of builder ,how influencial people tortured and harressed them with involving those people who purchased illegal parking. and society chairman and secretary also not taking any action against builder.

Sub:  Harassment and Torturing from Builder Side Directly and indirectly.   (Please lodge F.I.R as the facts of the case indicate against Builder and others involved.)

Respected Police Officer,

With this letter I request you to register my complaint either in the form of FIR or NC ,my incident suggests having regard to laws of the land. I have Purchased Flat No. 104, B-Wing in Poonam Annex Building known as Poonam Nagar Complex at village Bolinj, Taluka-Vasai, Virar, District Thane-401303 from M/S Poonam Skyline Constructions having Office in 12, Poonam Plaza, Trupati Nagar, Virar (West)- 401303, as agreement dated 10th June 2009. We have many times orally and in writing given letter on 16/11/2010 & second letter on 01/01/2011 to builder on many points issues, which is not as per Approved Cidco Plan/ Building Plan and MAHARASTRA OWNERSHIP FLAT ACT.

Builder had made one sided agreement and flat sold to us on built up and super built up area where rule is passed to sold flat only on Carpet Area basis and many amenities is not provided By Builder, written maximum point in our above dated (mentioned) letter. Irregularities committed by builder on construction, illegal construction and sold common space of society; even builder charged us super built up 860 sq. ft.and actual carpet is not more than 570-580 sq.ft.There is huge difference of area.

Now our society is formed and I am also secretary of society and in society also decision is taken in special general meeting held on 27th/02/2011 that serve notice to builder if not listen take legal action against Builder on many points. Imp. Matter is Builder Sold /Allotted Parking to 14 Flat Owner Illegally, they blocked the same using Name Plate and Key Chain for that disputes arise among member and due to that unnecessary fighting between members and not giving Audit Accounts of Maintenance and many issues letter sent to Builder from society side also.(Supreme Court order builder have no right to sale parking space).

Instead of listening our problem builder showing his Muscle Power and Financial Strength on me and sending gundaas like Jayesh Bhai,Pappu Bhai, ke  dwara and telling maa behan ki ghandi ghandi gali or haath pair thodne ,jamine mae gaade denhe,abhi chode raha hu dobara gher bhi nahi pohchega, ulti sidhi damki de raha hai kah raha hai kya tu manik bhai ko paresan ker raha hai,blue print kya puch rha hai,kya hisaab mangta hai jyada deemag rakhne ka nahi maderchod teri gaand mae dum hai to ja manik bhai (Builder) ke khilaf jaker dikha,teri aukat mae ruh ,ye virar hai,virar ka kanun alag hai..for that Police Complained Is Recorded On Date 02/04/2011 and one Mr. kiran Thakkur from Ekvira construction is calling me on 08/06/2011 at 6.30 p.m. from mobile no. 9321898746 Jayesh Bhai told me come to kiran thakkur office now some urgent work is their  ,interfering in our issue and giving various type of Damki Like

Hamare Paas Bahoot Raste Hai Tunmko Fasane Ke Liye, Ladies Matter Mae Fasa Denge, Abhi Sangle Policewale Mere Paas Betha Tha Usko Bolker Fasa Denge ,Accident Kara Denge,Mae Virar Estate Agent Association Ka President Hu Tumhe Estate Agency Business Karne Nahi Dunga,(Mae Rajkumar Bansal  Virar Mae Estate Agency Ka Kaam Karta Hu) ,and Telling Me Leave Virar Or Leave The Issue With Builder, tu manik bhai se kya sawaal karta hai,yeh hamara area hai,yha rahne ka to hamari sunne ka , Mr Sawant And Mrs Sawant jo ki Society Mae Member hai Or Unki Wife Builder Ke Office Mae Kaam Ker Rahi Thi ,Builder Dwara Vo Bhi Hame Paresan Ker Rahe Hai, Or kiran thakkur dwara milker paresan ker rahe hai, Jin 14 Logo Ne Parking Illegally Kharidi Hai,Usme Se 4-5 Family Mr.Vakharia, Mr Namade, Mr.Gadgil (Unessecerily Involved Ladies In Society Matter) Kisi Na Kisi Bhane Ladai Karte Hai Paresan Karte Hai..Or Kiran Thakkur Mujhe secretary post Risine Karne Ke Lie Pressure Ker Raha Hai or Mr.Sawant,Mr.Vakharia,Mr.Namade,Mr. Gadgil ko Secretary Chairman banne do bol raha hai yeh sub hamare log hai..Problem solve na ker “builder ko na bolker mujhe damki de rahe hai.”

For that information given to police but till no action is taken by police instead handling issues Mr. Sangle from Aghashi Police Station telling me Chapter Case  Bna  Dunga, virar mae police complained kiya to sabse phale information kiran thakkur,pappu bhai ke paas mr. sangle dete hae. Mae janna chattha hu police station kha khola gaya hai Kiran Thakkur Ke Office Mai ya Agashi Mae.

Kya Ab Police Department Mae Aam Admi Ki Koi Sunwai Nahi Hogi.  But one partner of M/S Poonam Skyline Constructions Mr. Manik Bhai told to me (R.K.Bansal )  that “Sham Daam Dund” Formula we are using, and now showing strengths and using Big Political Names like Mr. Raju Patil Mahapoor And Mr. Hitendra Thakkur  (Lokneta Bhujan vikas Aghadi) and through invitation card,showing his political contact and telling me tum biwi bachhewala hai,hum pyar se tumhe samja rahe hai hamare saath sawaal jabaab mat karo.hamne kuch naya nahi kiya sub builder esa karte hai,kanun manta kuan hai hamare paas 50 lakh kharcha karne ki takat hai tumhare paas kya hai.or ab Mr. Suresh Mehta,Kalpesh Mehta Or Mr. Manek Bhai mere business ko indirectly hurt ker rahe hai ,or mujhe Mentally Financial tarike se paresan karne ki kosis ker rahe hai.

OR Ab Building Ke 4-5 Family Jin Logo Ne Illegal Parking Purchase Ki Hai Mujhe Builder Ke Sath Milker Paresan Ker Rahe Hai Parking NO. 8 B-603  Sunil Vakharia & Whole Family. Three Times Fight With Me Complained Given To Police Station On  07/01/2011 Parking NO. 12 B-303 Nilkankh Namade & family Complained on 04/06/2011. With Mr. Sawant And her Wife Creating Every Day Problem And Fight Unnesseraly with me, telling why you raise question of parking,don,t raise issue or leave post of secretary .

I request you to please informed your department to take proper legal action and lodged F.I.R and to start criminal proceeding against these people to maintain peace and also avoid  any danger in future  on me and my family and all these are responsible for same if any incident happened.

Dear Sir,

There are many points pending for clearification from your side, referring the same we had already given you letter requesting for clarifying the points, buy your behavior of not listening to our point and not taking any letter in writing personally and after Registered A.D. Till date we have not received any feedback or action plan from your side, we again request you to furnish the details early so that a good relation of customer and builder can maintain or don’t force us to Take any legal action against you.

I have Purchased Flat (Jointly) No. 104, B-Wing in Poonam Annex Building (Land Bearing S.No.355. H.No.8 to 23) known as Poonam Nagar Complex at village Bolinj, Taluka-Vasai, District Thane-401303 from you, as agreement dated 10th June 2009.

Why is carpet area in sale agreement not mentioned? The rule states that builders should sell flats only on the basis of carpet area section 3 (2) of Maharashtra ownership flats (regulation of the promotion of construction, sale, management and transfer) Act, 1963, sale of apartment will be the basis of carpet area only.

You have sold flats to us on super built up area 860sq.ft.  and your actual carpet area is not more than 570 sq.ft. If we add super built up 30% then it approx. come to 180 sq.ft. That is approx.750-760 sq.ft. And there is huge difference of area in our flat. What are the reason and other facility provided by you, for charging us so high on super built up area? According To that how much Sq. ft. should be our common area and according to your approvals/sanctioned plan. Please clarify the same.

Require Layout Plan of Poonam Nagar and Poonam Annex Building Blue Print, As per Your OC (occupancy certificate) you have changed/amended your plans 4 times, but when we ask you have given us blue print plan of 28/04/2006. We now require the latest one that is 02/06/2009 mentioned in your OC.

Why are only 17 parking areas allotted to 16 flats only (flat no Details written in each parking) and it is locked using chain, when we have 77 flats and 24 shops in our building? We would like to know how much parking space should be provided in our building Poonam Annex as per DC rules for Residential and with Shop line Building. As per your CIDCO OC there is 24 Shops but we have seen Shutter of 26 Shops, we smell there is Gross Violation of Rules.(NOT AS PER PLAN)

Is there adequate water supply connection for 77 flats and in many shops also water connection? How many municipal water connections are granted for Poonam annex and give us details of underground and over head tank capacity granted and actually provided by you. And Overhead Tank Iron Lids Size Is Less Than the Open Window of Tank Due To That Rain Water and dust enter directly in tank and can create health problem. You have to provide us garden with children play area before possession But in end of December 2010 you had done this. In between Poonam annex and Poonam Atum building is the open garden area reserved for any other purpose (you have shown us in your sale broachers it is a fountain but there is no fountain till date). And we also want to know when our society is different then why one open garden is given to both buildings.

Why has the builder not given receipt of Rs 55000 which was taken in cash as society charges and not given bifurcation of the same amount (consumer protection act, 1986.)

As per agreement you were to provide us with generator back up. But you have given us only inverter battery backup and that is also very less up to  20-25 KVA, which is not suitable for long term performance, when will you provide us with generator back up.

You had charged us maintenance of Rs.1.50 per sq. Feet on super built up area. For e.g.; 860sq .ft. for 18 months. That is Rs-23220 .We now request you to clarify for charging so much amount and give us detailed accounts.

After paying so much maintenance, in one year no pest control and fogging was done in the rainy season. Due to that malaria and chicken guinea spread and people are facing health problems; we have the right to be clean and healthy environment.(UNDER CONSUMER PROTECTION ACT) In many areas the drainage system is open and there is no proper attachment of pipes and it should be underground.

According to CIDCO OC you have to provide us SOLID WASTE in 2 compartment of 0.67CUM and 1.33 CUM. Capacity for every 50 Tene – ments for Non-Bio Degradable & Bio Gradable Waste. We have 77 Flats and 24 Shops according to OC, have you provided for Poonam annex building and where is the location?

Please present to us the mosquito proof treatment certificate obtained from the concerned municipal council for Poonam annex mentioned in OC. After demanding minutes of the CGM Meeting held in 05/12/2010 in that I objected for parking area and other pending issues, but till date you had not given copy of the same.

Note: please note down violation of MOFA (the Maharashtra ownership flats (regulation and permotion of construction, sale, management and transfer) Act 1963 is Criminal in nature and is Offence under various section of INDIAN PANEL CODE and also in THE CONSUMER PROTECTION ACT, 1986, against Deficiencies in services, unfair trade practices unscrupulous exploitation of consumers.

If I do not receive satisfactory reply within 15 days,then we will go forward to take legal action.

CLARIFY URGENT ISSUE OF PARKING

Parking- Regarding parking you have given allotment letter and put chains and flat no. flat in stilt parking area of society on what basis and ground and according to below listed flat owners that they purchased the same from you in cash amount. But in allotment letter no proper word purchase or sale mention.

As per our knowledge and superEM court order builder don’t have right to sale parking space and many members using the parking space even they don’t have vehicle, they illegal put the lock with keychain remove it immediately or solve this parking issue

it’s a property of society, these people unathourisedly making right (kabja) on property of society and it’s a matter of nuisance & fighting among members every day.
