Connaught Place Vendors’ petition dismissed in Delhi High Court

New Delhi :  A petition was filed by 160 street vendors vending near Palika Bazar gate No.1 to 4 in Connaught Place against NDMC in Delhi High Court alleging that they were being forcefully removed and shifted to a small area. The matter came up before the Hon’ble High Court Delhi wherein Mr.Anil Grover and Harsha Pichara appeared on behalf of NDMC and mentioned that they are unauthorized squatters/street vendors who are blocking the entire path near Palika Bazar area causing disturbance and safety hazard to the general public who are visiting that area.

The court agreed with the contentions of NDMC and noted that the protection given to street vendors under Section-3(3) of the Street Vendors Act-2014 is not absolute and in subject to protection of the entrust of general public visiting that area. The court noted that this court has already dismissed similar petition in several cases and in any case since the Delhi Government had already notified the Street Vending Rules-2016 and the Street Vendors Scheme on 7th January, 2016 and the Town Vending Committee is in the process of being constituted, this court cannot grant the relief prayed for in the present petition. Accordingly, the court dismissed the petitions.
