‘उपेंद्र राय और सुबोध जैन ने सुब्रत राय को बचाने के लिए राजेश्वर सिंह को एप्रोच किया था’

इनफोर्समेंट डायरेक्टोरेट (ईडी) के अधिकारी राजेश्वर सिंह की तरफ से वरिष्ठ वकील केके वेणुगोपाल ने सुप्रीम कोर्ट को बताया कि टूजी स्कैम प्रकरण में एस-टेल कंपनी की भी जांच हो रही जिसने पांच सर्किल में लाइसेंस हासिल किए और इस एस-टेल कंपनी में सहारा ने भारी भरकम निवेश किया है. इस तरह ईडी की जांच में सहारा द्वारा लगाया गया पैसा भी शामिल है और इस जांच में सुब्रत राय समेत सहारा के कई बड़े अधिकारियों पर आंच आ रही.

इस कारण सहारा की तरफ से उपेंद्र राय और सुबोध जैन ने जांच को प्रभावित करने के लिए ईडी अधिकारी राजेश्वर सिंह को एप्रोच किया था. उपेंद्र राय और सुबोध जैन की ब्लैकमेलिंग व धमकियों से आजिज आकर राजेश्वर सिंह ने सुप्रीम कोर्ट की शरण ली और टूजी जांच प्रभावित करने का आरोप सहारा समूह के मीडिया हाउस के वरिष्ठों उपेंद्र राय व सुबोध जैन पर लगाया. तबसे सुप्रीम कोर्ट में यह मामला चल रहा है.

पिछले दिनों इस प्रकरण को लेकर सुप्रीम कोर्ट में सुनवाई हुई तो सहारा की तरफ से मानहानि नोटिस पर ही सवाल खड़ा कर दिया गया. सुप्रीम कोर्ट ने ईडी अधिकारी राजेश्वर सिंह से संबंधित कोई खबर सहारा मीडिया के माध्यमों पर दिखाने छापने पर पूरी तरह रोक लगा दी है. पूरी रिपोर्ट इस प्रकार है…

Sahara group chairman Subrata Roy questions contempt notice

NEW DELHI : Sahara group chairman Subrata Roy questioned before the Supreme Court maintainability of the contempt notice issued against him and two others for allegedly threatening an Enforcement Directorate (ED) official investigating into the 2G scam. Senior advocate Ram Jethmalani, appearing for Roy, raised objection over the proceedings. He said it was neither in conformity with the Supreme Court rules nor mandatorily vetted by the attorney general.

In his submission before a bench of justices G S Singhvi and K S Radhakrishnan, the counsel said he would like to cross-examine complainant Rajeshwar Singh for filing a “wishy-washy” affidavit in the apex court. The apex court on May 6, 2011, issued contempt notices to Roy and two journalists, Upendra Rai, editor and news director, Sahara India Media and Subodh Jain, erstwhile reporter with Sahara Samay.

It was alleged that Upendra Rai and Subodh Jain had approached Singh with a set of questions, claiming that he had got certain details relating to corruption against the ED official, to scuttle investigations into the 2G case. During the hearing, senior advocate Rajeev Dhawan, appearing for Rai, submitted that the status of the ED in the case was no higher than a litigant. The court could not exercise its suo motu power in this manner and it was impermissible as a matter of due process, he contended.

Representing the ED official, senior advocate K K Venugopal submitted that since Sahara had invested in M/s S-Tel Ltd, which got licences in five circles, Singh, who was investigating the FEMA case, was approached by Upendra Rai and Subodh Jain at the instance of top executives. Meanwhile, the apex court trashed an application filed by a private TV channel seeking a probe into contents of a CD.

The bench had taken serious note of the fact that after summons were issued to the CMD of Sahara group under the Prevention of Money Laundering Act, "crude methods" were adopted to terrorise, intimidate and blackmail Enforcement Directorate's Assistant Director Rajeshwar Singh, who is the investigating officer in the 2G spectrum case.

The bench had also banned Sahara India News Network and its sister concerns from publishing and broadcasting any story or programme relating to Singh. The probe against Roy was launched by ED in connection with the investment made by the Sahara in the Chennai-based telecom company S-Tel which had come under the scanner of CBI on the issue of national security. Singh had filed the petition in his personal capacity.
