इस प्रकरण में कुछ नई जानकारियां आई हैं. पहली तो ये कि कोर्ट की तरफ से उस आईआरएस आफिसर के बयान / कथन आदि को प्रकाशित करने पर रोक है जिन्होंने इस कथित करप्शन का खुलासा किया है. कोर्ट ने ऐसा आदेश आईआरएस अधिकारी के मानसिक रूप से गड़बड़ यानि पागल होने के अस्पताल के सर्टिफिकेट के आधार पर दिया है. दूसरी बात, नेता और चैनल पर आरोप को लेकर सीबीआई की विशेष अदालत ने वर्ष 2011 में इस आईआरएस अधिकारी पर जुर्माना लगाया था क्योंकि अदालत ने इन आरोपों को निराधार पाया और आरोपों के समर्थन में कोई दस्तावेज न होने की बात कही है. विशेष सीबीआई अदालत के फैसले के बारे में उस वक्त स्टेट्समैन में जो खबर प्रकाशित हुई थी, वह इस प्रकार है..
2G: Court dismisses plea against PC, TV channel

NEW DELHI, 5 DEC: A special CBI court on the 2G spectrum allocation scam case on Saturday dismissed the petition filed by a serving Income-Tax Commissioner seeking his examination as a prosecution witness in the case and alleging involvement of the NDTV group and the Union home minister Mr P Chidambaram, among others, in alleged money laundering of illegal bribe money of over Rs 2000 crore and abuse of power in the 2G scam.
Special CBI judge Mr OP Saini dismissed the plea of the petitioner Mr SK Srivastava, IRS, Commissioner of Income Tax, (OSD), Delhi, filed by his advocate Mr Harihar Pratap Singh. The court also imposed a fine of Rs 10,000 on the petitioner for filing a “frivolous” application. The court said the allegation levelled by the petitioner was not supported by any documentary evidence and was devoid of any merit.
In his application, Mr Srivastava had pleaded with the court to make him a prosecution witness and to proceed against NDTV, its subsidiaries, a slew of public officials and Mr Chidambaram for allegedly “plundering the public exchequer of lawful tax revenue in excess of Rs 1,200 crore and embezzling an amount of Rs 1,46,82,836/ in the garb of I-T refund by forgery and fraud” under various Sections of the Prevention of Corruption Act, the IPC and the CrPC.

We have opened and perused the report sent to us in a sealed cover by VIMHANS. As to what should be the extent of disclosure of this report, we would like to examine and learned counsel for the parties also seek some time to assist us in this matter.
We have requested the clerk who has come from VIMHANS to ensure that a senior officer familiar with the case circumstances from VIMHANS should be available in Court on the next date of hearing to assist us. At this stage, it is suffice to say that there are serious issues arising from the report of the VIMHANS which makes it necessary for us to issue interim directions forthwith, which are as under:
i) No communication addressed by the petitioner qua any issue should be given any cognizance or be taken into consideration.
ii) The petitioner should not be entrusted with any work in the Department as it may affect the public at large, an aspect we have emphasized to the learned counsel

for UOI. This would necessitate making alternative arrangements as the appellate proceedings would be required to be completed before the end of the financial year.
The report be put in a sealed cover and be kept in the custody of the concerned Deputy Registrar to be sent to the Court on the next date of hearing.

Interim orders dated 16.01.2013 shall continue to operate till the next date of hearing.
