एके गांगुली के खिलाफ तेजपाल की तरह स्वतः एफआईआर दर्ज करने की मांग

मैंने बीते 26 नबम्बर को उच्चतम न्यायालय के मुख्य न्यायाधीश से आग्रह किया था कि वे इंटर्न के यौन उत्पीड़न मामले में आरोपी का नाम सार्वजनिक कर प्रकरण को जांच एजेंसी को सौंप दें. आरोपी का नाम सार्वजनिक हो चुका है अतः मैंने आज पुनः अनुस्मारक भेजकर उच्चतम न्यायालय के मुख्य न्यायाधीश से आग्रह किया है कि वे अब तो इंटर्न के यौन उत्पीड़न मामले में प्रकरण को जांच एजेंसी को सौंप दें.
 
बीते 26 नबम्बर को ही मैंने राष्ट्रीय महिला आयोग की अध्यक्षा से भी आग्रह किया था कि वे कद्दावर लोगों के मामले में आयोग की मात्र शो पीस बने रहने की अवधारणा को तोड़कर मामले की स्वतः जांच आरम्भ कर दिल्ली पुलिस से मामले की प्रथम सूचना रिपोर्ट दर्ज कराने की कार्यवाही करें. कोई कार्यवाही न होने पर आज उनको भी अनुस्मारक भेजा है.
 
इसी प्रकार मैंने बीते 26 नबम्बर को  ही दिल्ली के पुलिस कमिश्नर से भी आग्रह किया था कि वे तरुण तेजपाल प्रकरण में गोआ पुलिस द्वारा दर्ज की गयी FIR की तर्ज पर आरोपी पूर्व जज के खिलाफ FIR दर्ज करें पर अभी तक ऐसा नहीं हुआ है और आज मैंने उनको भी अनुस्मारक भेजा है. सुप्रीम कोर्ट, महिला आयोग और दिल्ली पुलिस को भेजे ज्ञापनों की प्रतियां निम्नानुसार हैं.

Though the name of the accused has been put before the world but probe has not been handed over to investigating and intelligence authorities.

Sir,
It refers to media-reports that intern having levelled serious charges of molestation by a Supreme Court judge (now retired) expressing dissatisfaction and humiliation with the three-judge Supreme Court panel looking at the complainant with suspicion. In such circumstances, for a proper and unbiased probe the matter needs to be  handed over to investigating and intelligence agencies also to save honour of judges firstly because the complainant has expressed dissatisfaction on Supreme Court probe. Secondly and more importantly, immediate disclosure of name of the concerned Supreme Court judge (now retired) will prevent other retired judges from being unnecessarily defamed because several names are going in whispers and speculations amongst journalists and in corridors of Supreme Court. Early disclosure of name of concerned judge in a time-bound period of say three days will also tend to prevent any future such incident.
 
Since Supreme Court appointing probe-panel with which victim-intern is totally dissatisfied, is purely an administrative step and not at all the judicial which may stop other concerned agencies to probe in the serious matter. So we are approaching you thru this mail  with demand to immediately hand over the probe to investigating and intelligence authorities for a proper and unbiased probe.

If Goa police can sue-motto file FIR against Tehelka editor Tarun Tejpal, Delhi Police should also take similar step by sue-motto taking cognizance of news-reports. Supreme Court appointing probe-panel with which victim-intern is totally dissatisfied, is purely an administrative step and not at all the judicial which may stop other concerned agencies to probe in the serious matter.
 
As yet , Delhi Police has not taken any such action , so We are requesting  National Commission for Women  through you,  to come out of its  ‘Showpiece’ image,  prove its  worth by taking courage to take all necessary steps to get the FIR filed by Delhi Police on basis of news-reports.

We also want this to bring to your kind notice that Supreme Court appointing probe-panel with which victim-intern is totally dissatisfied, is purely an administrative step and not at all the judicial which may stop Delhi Police to register FIR and  probe in the serious matter.
 
As yet , Delhi Police has not taken any such action , so We are requesting  you to come out of your  ‘a Bare Spectator’ image,  prove Delhi Police’s  worth by taking courage to take all necessary steps to get the FIR filed by Delhi Police on basis of news-reports and also ensure further investigation as per law of the land.
