खबरों से खफा उपेंद्र राय ने अमर उजाला को भिजवाया लीगल नोटिस

ये वो उपेंद्र राय नहीं है, जो सहारा मीडिया के हेड हैं. ये उपेंद्र राय बिजनेसमैन हैं. इन उपेंद्र राय की तरफ से वकील विजय प्रताप सिंह ने अमर उजाला के संपादक, प्रकाशक और मालिक को लीगल नोटिस भेजा है. नोटिस अमर उजाला में छपी कुछ खबरों से खफा होकर भेजा गया है. नोटिस में कहा गया है कि झूठी खबरों को छापकर उपेंद्र राय की सामाजिक और व्यावसायिक प्रतिष्ठा को धूमिल किया गया है. नोटिस की एक प्रति प्रेस काउंसिल आफ इंडिया को भी भेजा है. नोटिस इस प्रकार है….

As per instructions of my client Sri Upendra Rai son of Sri Pradeep Kumar Rai, Partner, Goldrush Logistics Office, 75 Tej Kumar Plaza, IInd Floor, Hazratganj, Lucknow, who is running transport business since last several years, I am giving this legal notice on behalf of my client for publishing the news item in Hindi daily news paper Amar Ujala, Lucknow Region dated 01.10.2012.

My client is a reputed businessman having its establishment for running the bus under U.P.S.R.T.C. in all over Uttar Pradesh. The news item “Parivahan Nigam me 50 Mercedes Benz Bus Kharid Samiti ka Karnama” “Doosrey ki balancesheet per de diya 40 Crore ka theka” which was published in Amar Ujala Hindi dainik newspaper, Lucknow in its edition of 01.10.2012. The aforesaid news is intending to defame the social as well as business and corporate integrity of my client  and to denigrate its status  and position, aforesaid news item published in daily newspaper in caption “Parivahan Nigam me 50 Mercedes Benz Bus Kharid Samiti ka Karnama” “Doosrey ki balancesheet per de diya 40 Crore ka theka” is libelous publication has adversely affected and caused damage to the reputation of my client and it was so published without verifying the truth or otherwise thereof and this being an offense of 'Defamation'.

The aforesaid news item was published on the information given by one Sri Pradeep Agarwal son of late A.P. Agarwal, resident of A-16 Nirala Nagar, Police Station Hasanganj, District Lucknow who is an accused of Case Crime No. 126/2012 under Section  406, 420, 504, 506 I.P.C., Police Station Vibhuti Khand, Gomti Nagar, Lucknow. The aforesaid case was registered on 28.6.2012 and in this very case my client is complainant.

It is also being brought to your notice that the defamatory publication in your daily newspaper Amar Ujala, Lucknow, Lucknow dated 01.10.2012  falls within the ambit of defamation as defined in Section 499 I.P.C. The news item published in Amar Ujala daily news paper, Lucknow Region, Lucknow in its edition dated 01.10. 2012 was published only with the connivance of Mr. Pradeep Agarwal against whom my client has registered a F.I.R. and investigation of the said case is going on.

So, you above named are required to publish the apology and corrigendum regarding the news item published on 01.10.2012 within a week and take necessary action, otherwise my client reserves every right to file a complaint case against all the responsible persons and the newspaper as well.

In the follow-up edition, a News item in Hindi daily news paper 'Amar Ujala' Lucknow region, dated 2.10.2012 was again published in caption “M.D. Ne Khangali Theke Ki File” without verifying the true facts. The aforesaid news is also intending to defame the social as well as business and corporate integrity of my client and to denigrate its status and position.

It is also being brought to your notice that the defamatory publication in your daily newspaper Amar Ujala, Lucknow, Lucknow dated 02.10.2012 also  falls within the ambit of defamation as defined in Section 499 I.P.C.

So, you above named are required to publish the apology and corrigendum regarding the news item published on 02.10.2012 within a week and take necessary action, otherwise my client reserves every right to file a complaint case against all the responsible persons and the newspaper as well.
