मुंगेर (बिहार) के वरिष्ठ और जुझारू पत्रकार श्रीकृष्ण प्रसाद एक बड़ी लड़ाई लड़ रहे हैं. उन्होंने हिंदुस्तान अखबार द्वारा बिहार में किए गए दो सौ करोड़ रुपये के विज्ञापन घोटाले का न सिर्फ भंडाफोड़ किया बल्कि इसे कानूनी और न्यायिक लड़ाई के जरिए एक मुकाम तक लेकर आए हैं. इस मामले में हिंदुस्तान प्रबंधन ने पटना हाईकोर्ट में एक याचिका डालकर विज्ञापन घोटाले की जांच को बंद करने का अनुरोध किया लेकिन कोर्ट ने इस मामले में हस्तक्षेप करने से इनकार कर दिया.

The Patna High Court order relating to the 200 crore Dainik Hindustan Advertisement scandal in Bihar

Munger (Bihar, India) . The Honourable Justice of the Patna High Court, Justice Anjana Prakash,in her historical judgement on Dec. 17,has asked the Munger Investigating Police Officer to expedite the police investigation and complete the same within a period of three months from the date of the receipt of this order in connection with the Munger Kotwali P.S.Case No.445 /2011.

The Honourable Court has also refused to interfere in this case at this stage on the plea that the Munger D.M's report shows that the police investigaton is in full progress.

The Honourable Justice has further said in her order in the para no.12,''Having heard the cousel for the parties, it appears that contentious matters have been raised as to whether the accused persons had complied with the Provisions of Sectons 5(2 C),(3) and 19 C of the Press & Registration of Books Act,1867.This becomes even more relevant in view of the letter of the District Magistrate, Munger,Mr.Kuldeep Narayan,dated 27-09-2012 wherein he stated following ::

''…………………Today morning, Hindustan newspaer has been obtained from Munger town(Munger Edition) and nearby Lakhisarai town (East Bihar Edition).Both the newspapers indicate same editor, same publisher & printer, same local editor, same phone no. and same RNI No. The RNI No. is also same as what can be seen on Bhagalpur edition.This way, it appears that on same registration, same RNI No.,different content is being published ,printed and circulated in different districts.Since the content is diferent, so they should be treated as different newspapers and should have different RNI's No., but here RI No. is same.This way,it has been found that in Bhagalpur,Munger, Lakhisarai, different newspaper contents are being circulated bearing same registration details……. It is evident that not only news content is different, but also some Government advertisement is published in one newspaper and not the other.For example, on page No.6 of newspaper circulated in Lakhisarai(East Bihar Edition), advertisement of Planning Department bearing advertisemet no. PR-7332(Planning)/12-13 has been published,but not in Munger edition circulated in Munger town."

The Honourable Justice has further stated in the para no.5,"The counsel for the petitioners submits that even accepting the allegation in the First Information Report, no offence whatsoever is made out against the petitioners. In fact, the informant and his father are disgruntled employees of newspaper, who,after their dismissal from work, have filed the present complaint to harass them."

The informant Mantoo Sharma, a social worker and RTI activist,has stated in the F.I.R, lodged with the Munger Kotwali police station,bearing P.S.Case No.445/201, that accused persons namely Smt.Shobhana Bhartia(The Chairperson,M/S Hindustan Media Ventures Ltd.,New Delhi),Shashi Shekhar(Chief Editor,Dainik Hindustan,New Delhi), Amit Chopra(Publisher,M/S Hindustan Media Ventures Ltd,New Delhi),Awadh Kumar Srivastava @ Aaku Srivastava(The Editor, Dainik Hindustan,Patna edition,Patna) and Binod Bandhu(the Regional Editor,Dainik Hindustan,Bhagalpur edition,Bhagalpur) have cheated the Union and the Bihar governments in illegally obtaining the government advertisements to the tune of rupees two hundred crores.The accused persons started publishing Hindi daily,Dainik Hindustan from Bhagalpur in Bihar in the year 2001 from the new printing press.But,the management didn't obtain the Certificate of Registration and the Registration Number from the Press Registrar,New Delhi.Though, the newspaper was without the Registration No.,the management claimed the government advertisement from the Union and the Bihar governments posing its publication as the Registered newspaper.

All the accused persons namely Shobhana Bharatia,Amit Chopra,Shashi Shekhar,Aaku Srivastawa and Binod Bandhu have been charged with cheating and committing forgery with the Union and the Bihar government in a bid to get the government advertisements under sections 420/471 and 476 of the Indian Penal Code and sections 8(B)/14 and 15 of The Press & Registration of Books Act,1867.

The Deputy Police Superintendent(Munger), A.K.Panchalar and the Police Superintendent(Munger) ,P.Kannan ,in their supervision reports, have found all allegations against the accused persons prime-facie true in this case.

The Honurable High Court,in its earlier orders, had asked the Munger police not to take any coercive measures against all the accused persons till further orders of the court.After the Dec 17 order of the Patna High Court,the High court order relating to the stay on any action against accused persons,now stands vacated.Now, the Munger police are free to arrest any of the accused persons any moment in this world famous advertisement scandal .
