आरटीआई कार्यकर्ता डॉ नूतन ठाकुर और देवेन्द्र दीक्षित ने उत्तर प्रदेश के राज्यपाल बी एल जोशी की नियुक्ति पर गंभीर सवाल खड़े किये हैं. राष्ट्रपति, प्रधानमंत्री और गृह मंत्री को भेजे अपने पत्र में आरटीआई कार्यकर्ताओं ने कहा है कि गृह मंत्रालय, भारत सरकार के आरटीआई उत्तर के अनुसार मंत्रालय के पास श्री जोशी द्वारा यूपी के राज्यापल बनने के पूर्व विभिन्न पदों पर कार्यरत रहने और उनके चल-अचल संपत्तियों के सम्बन्ध में कोई भी सूचना उपलब्ध नहीं है. यही उत्तर राज्यपाल सचिवालय द्वारा भी दिया गया है.
डॉ ठाकुर और श्री दीक्षित ने कहा है कि जब सरकार के पास श्री जोशी से सम्बंधित बुनियादी सूचनाएं उपलब्ध नहीं थीं तो गृह मंत्रालय द्वारा किस आधार पर उनके नाम का सुझाव दिया गया और कैसे प्रधानमंत्री की संस्तुति पर राष्ट्रपति द्वारा उनकी नियुक्ति की गयी? उन्होंने कहा है कि आरटीआई उत्तर से केंद्र सरकार द्वारा श्री जोशी और अन्य तमाम राज्यपालों की नियुक्ति प्रक्रिया पर प्रश्नचिन्ह लग जाते हैं. अतः उन्होंने श्री जोशी की राज्यपाल पद पर नियुक्ति की प्रक्रिया की तत्काल जांच कराते हुए कोई अनियमितता पाए जाने पर कार्यवाही किये जाने की मांग की है. साथ ही इसके दृष्टिगत पिछले दस सालों में हुई समस्त राज्यपाल नियुक्तियों की भी पुनरीक्षा किये जाने की मांग की है.

We are Dr Nutan Thakur and Devendra Dikshit, Lucknow based social activists and RTI activists, working in the field of transparent and accountable governance. Here we present certain issues as regards the appointment of UP Governor Sri B L Joshi.
One among us, Sri Devendra Dixit had asked certain questions from the Ministry of Home Affairs, the Prime Minister Office and the President office. The questions related to appointment of Sri B L Joshi, Governor of Uttar Pradesh and asked about his previous posts held before getting appointed to this post, his moveable and immoveable property, property of his near relatives, his appointment and extension as Governor of UP etc. A similar query was sent to Governor office, UP. A copy of the RTI queries is being attached as Annexure No 1.
The PMO and President office sent the RTI letter to the MHA. The RTI reply sent by the Ministry of Home Affairs says that it does not have any records of the posts held by Sri Joshi before being appointed as Governor of UP nor does it have any records of the moveable and immoveable properties held by him. The same reply has also been sent by the office of the UP Governor. A copy of the various RTI replies is being attached as Annexure No 2.
Now the question that naturally arises is that when there was no record available about Sri Joshi, then how was Sri Joshi’s name suggested by the Ministry of Home Affairs? How did the MHA recommend a name when it did not even have the basic facts about the person whose name it was recommending for the extremely high and important post as that of Governor? Does this mean that the MHA is not even concerned about whom to recommend for the post of Governor? Does it also mean that names are recommended by MHA just in an arbitrary manner without having even the bare minimum information like his previous work and conduct, his property/status etc.?
There can be no denial that the post of Governor of State is extremely important and highly revered. Is it that persons are being appointed to these posts even without knowing their whereabouts, the basic facts related with them, about their previous posts held, about their basic minimum personal data etc?
The question is- has it happened only in the case of Sri B L Joshi or is it a regular feature in the Government of India? The question is also whether anyone can suddenly be appointed as Governor even without having the bare minimum facts about his him and without his basic personal details, as the RTI reply by the MHA indicates?
Thus the RTI response puts a question-mark on the entire appointment process of Sri Joshi and possibly of other Governors being appointed by the Union Government.
Hence we strongly ask for immediate enquiry into the appointment process of Sri Joshi including his antecedents and to take appropriate action against all persons involved in the process, if irregularities are found in it.
We also demand for a review of all the appointments to the post of Governor made in the last ten years in the light of the RTI response to see if the same situation exists for any other Governor appointed during this process, without having even the basic data and information about the concerned person being appointed as Governor and hence putting the entire Constitutional machinery in great risk and to take appropriate action in light of this review.
Finally we strongly recommend that all future appointments to the post of Governor be made only after having all such relevant personal details on record and after their proper verification.
