डा. नूतन ने गृहमंत्री को पत्र लिखा, आईपीएस गीता जौहरी के खिलाफ कार्रवाई की मांग की

गुजराती दैनिक अखबार दिव्य भास्कर के राजकोट संस्करण के संपादक समेत तीन पत्रकारों के विरुद्ध थाना गांधीग्राम, राजकोट (गुजरात) में संजय कुमार, इंस्पेक्टर, थाना मालवीय नगर द्वारा मु०अ०स० 6/2012  धारा 447, 341, 509, 323, 500, 501, 502, 109, 292 व 120बी आईपीसी के तहत एक झूठा मुक़दमा पंजीकृत कराया गया है. यह मुक़दमा दिव्य भास्कर के राजकोट संस्करण में राजकोट सिटी के पुलिस कमिश्नर गीता जौहरी की नील सिटी क्लब, राजकोट में नए साल के ज़श्न की पार्टी में डांस करती तस्वीर छपने के आधार पर किया गया.

मानव अधिकारों के क्षेत्र में कार्यरत सिविल सोसायटी इंस्टीट्यूट फोर रिसर्च एंड डाक्युमेंटेशन इन सोशल साइंसेज (आईआरडीएस) द्वारा राजकोट पुलिस द्वारा इस तरह से पुलिस कमिश्नर के दवाब में किये गए अवैध कृत्य की घोर निंदा की गयी है. आईआरडीएस की सचिव डॉ. नूतन ठाकुर द्वारा यह कहा गया है कि गीता जौहरी के डांस करने और उनके फोटो के बगल में एक युवा जोड़ी के सट कर खड़े होने सम्बंधित फोटो के आधार पर जिन धाराओं में मुक़दमा पंजीकृत किया गया है, वह पूरी तरह से नियम विरुद्ध और अलोकतांत्रिक है. इसमें मानहानि से सम्बंधित धाराओं 500, 501, 502 आईपीसी के अलावा धारा 447 (आपराधिक प्रवेश), धारा 341 (आपराधिक पकड़), 323 (मारपीट), 120बी (आपराधिक षडयंत्र) तक शामिल हैं. स्वाभाविक है कि एक सार्वजनिक न्यू ईयर पार्टी में डांस करने की तस्वीर खींच कर उसे अखबार में छापना किसी भी तरीके से कोई आपराधिक कृत्य नहीं है. जिस तरह से जौहरी ने अपने एक अधीनस्थ अधिकारी संजय कुमार से यह एफआईआर दर्ज कराया है, वह भी पूरी तरह गलत है. इसी मुकदमे के आधार पर इन तीनों पत्रकारों को गिरफ्तार किया गया और कोर्ट द्वारा बेल मिलने पर भी काफी देर बाद रिहा किया गया.

डा. नूतन ठाकुर ने इस सम्बन्ध में गृह मंत्री, भारत सरकार एवं गुजरात के मुख्यमंत्री को पत्र लिख कर इस प्रकार का अवैधानिक कार्य करने और पत्रकारों को उत्पीडित करने के मामले में राजकोट की वर्तमान पुलिस कमिश्नर आईपीएस अधिकारी गीता जौहरी के विरुद्ध जांच करा कर कठोर दंडात्मक कार्रवाई करने की मांग की है. नीचे गृहमंत्री को भेजा गया पत्र.

Subject- Enquiry and strict action against Ms Geeta Johri, IPS officer from Gujarat presently working as Police Commissioner, Rajkot

Sir,

This is to inform you that as per the information coming from Media, a completely false FIR No 6/2012 under sections 447, 341, 509, 323, 500, 501, 502, 109, 292 and 120B IPC has been registered by Sri Sanjay Kumar, Inspector of Police Station Malviy Nagar, Rajkot (Gujarat) against three media-persons Sri Kana Batwa (editor), Sri Aniruddh Nakum (reporter) and Sri Prakash Ravrani (phtographer) belonging to Gujarati daily Divya Bhaskar daily. As per the information, this FIR was registered at the instigation of Ms Geeta Johri, IPS, the present Police Commissioner of Rajkot. The reason for getting this FIR registered was that her photo in a dancing pose at a New Year eve party at Neel City Club, Rajkot was taken and later published in the Rajkot edition of the Gujarati daily Divya Bhaskar.  The three media persons were later arrested and released after much delay despite grant of bail by the competent Court.

Institute for Research and Documentation in Social Sciences (IRDS), a Civil society working in the field of Human rights strongly condemns this gross violation of Human Rights by the Rajkot police on the illegal orders of Ms Geeta Johri.  We strongly feel that the FIR registered for publishing a photo of Ms Johri dancing in a Party and another photo on its side with a young couple standing  near each other is a completely illegal and undemocratic. Other than various sections related with Defamation (500, 501, 502 of IPC), even offence of criminal trespass (447 IPC), illegal detention (341 IPC), voluntary causing hurt (323 IPC) and criminal conspiracy (120B IPC) have been included in a simple act of taking a photo in dancing pose and publishing it. This act taking a photo in dancing pose and publishing it is not at all criminal in any way. What is equally serious is that Ms Johri did not get the FIR registered herself but forced one of her subordinate officers to register an FIR. One fails to understand why shall Mr Sanjay Kumar get adversely affected by a photograph of her dancing Police Commissioner?

If a proper enquiry is conducted in this matter, it will be found out that the the party was almost like a public gathering where many persons had assembled and were eating, dancing and making merry. Thus, if some photographer went there and took photographs of Ms Geeta Johri, Police Commissioner and published it in their newspaper, it cannot be considered as being a crime of any sort. On the other hand, registering such a serious crime for this act is definitely illegal. It is also a clear-cut case of abuse of power and is a serious act against the freedom of Press in our democratic nation.

Hence we request you to get the matter enquired immediately and to take strict action against IPS officer Ms Geeta Johri for this illegal act of extreme highhandedness.
