डॉ नूतन ठाकुर (कन्वेनर, नेशनल आरटीआई फोरम) द्वारा इलाहाबाद हाई कोर्ट, लखनऊ बेंच में दायर पीआइएल संख्या 2685/2012 (एम/बी) में जस्टिस उमानाथ सिंह और जस्टिस वी के दीक्षित ने आदेश दिया कि प्रिंट और इलेक्ट्रानिक मीडिया में सेना के मूवमेंट की खबर नहीं आनी चाहिए. कोर्ट ने यह भी कहा कि वे मीडिया की स्वतंत्रता को रोक नहीं रहे हैं और यह भी देख रहे हैं कि पूर्व में ही सेना की मूवमेंट को लेकर तमाम खबरें मीडिया में आ चुकी हैं अतः अब यह आवश्यक हो गया है कि इस तरह से सेना के मूवमेंट की खबरों पर रोक लगे.
कोर्ट ने यह कहा कि सेना की टुकड़ियों के मूवमेंट का मामला अत्यंत संवेदनशील और गोपनीय होता है. अतः इसे अधिक चर्चा में ला कर देश की सुरक्षा और सेना की गोपनीयता के साथ खिलवाड़ नहीं किया जा सकता. कोर्ट ने कहा कि याची डॉ ठाकुर, जो एक सामाजिक कार्यकर्ता और फ्रीलांस जर्नलिस्ट हैं, ने मीडिया की इस प्रकार की रिपोर्टिंग पर चिंता व्यक्त की थी.
कोर्ट ने सचिव, गृह मंत्रालय एवं सचिव, सूचना एवं प्रसारण मंत्रालय, भारत सरकार एवं प्रमुख सचिव (गृह), उत्तर प्रदेश को इस आदेश का आज से ही
अनुपालन कराने का आदेश दिया है. इसके लिए इस आदेश की प्रति अतिरिक्त सोलिसिटर जनरल तथा मुख्य स्थायी अधिवक्ता को दिये जाने के भी आदेश दिये गए. डॉ ठाकुर ने उच्च न्यायालय से यह प्रार्थना की थी कि ये दोनों मामले बहुत ही गंभीर हैं और अतः इन दोनों मामलों की तुरंत उच्चस्तरीय न्यायिक जांच की जानी चाहिए. उन्होंने इसमें प्रधान मंत्री कार्यालय को प्रतिवादी बनाया था.

We have heard petitioner in person and learned Assistant Solicitor General of India, Sri I.H. Farooqi, for Union of India. The issue of movement of Army troops is not a matter of the kind which should require public discussion at the cost of defence official secrecy and the security of country. Petitioner, a social activist and freelance journalist, in her submissions expressed her grave concern over the media reportings on this subject which, if permitted to continue, may seriously interfere with the handling of security matters by Army, particularly the movements of troops from the strategic point of view in the field as well as peace areas. Thus, without interfering with the independence of media and keeping in view the fact that the news items relating to movements of troops have already engaged the attention at the highest level in the defence as well as in the Government, we think it appropriate to direct the Secretary, Home Affairs, and the Secretary, Information & Broadcasting, Government of India and the Principal Secretary (Home), Government of U.P., to ensure that there is no reporting/release of any news item by the Print as well as Electronic Media relating to the subject matter, namely, the movement of troops as contained in the accompanying annexures.
Writ petition is dismissed at this stage with aforesaid directions.
Let a copy of this order issue today to the officials concerned as well as to learned Additional Solicitor General of India/Assistant Solicitor General of India and learned Chief Standing Counsel for immediate compliance.
