Munger : The world famous 200 crore Dainik Hindustan Advertisement scandal case now reached the Supreme Court.Honourable Mr.Justice H.L.Dattu and Honourable Mr.Justice Dipak Misra, in the Special Leave Petition (Criminal) No.1603/2013,(Shobhana Bhartia Vs State of Bihar & others ) on March 05, ordered to stay further proceedings in the Munger F.I.R No.445/2011,dated 18-11-2011 under sections 8(B)/14/15 of the Press & Registration of Books Act,1867 read with sections 420/471/476 of the Indian Penal Code,1860.
The Supreme Court ordered, "There shall be interim stay of further proceedins in the F.I.R No.445/2011, dated 18/12/2011 under sections 8(B)/14/15 of the Press & Registration of Books Act, 1867 read with sections 420/471 /476 of the Indian Penal Code,1860 and the proceedings emanating thereto, until further orders."
Senior advocates Mr.Mukul Rohtagi, Mr.Aman Lekhi, Mr. Sandeep Kapur, Mr.Shivek Trehan and Mr. Laksh Khanna for M/S Karanjawala & Com. appeared for the petitioner, Shobhana Bhartia in the Supreme Court.
Demand to confiscate the properties of economic offenders : The President of the Watch Dog group and government witness in the sensational 200 crore Dainik Hindustan Advertisement scandal,Kashi Prasad, who is also an R.T.I activist of national level ,senior lawyer and journalist,in a press note today, has urged the Chief Minister of Bihar ,Nitish Kumar and the Director General of Police, Bihar, Abhyanand to confiscate the properties of all the accused persons of the Munger Kotwali Case No.445 of 2011 on the plea that this case relates to the economic offence of serious-nature not in India,but in the world of the media.
The accused persons include the VVIPs of India : The accused persons include Smt. Shobhana Bharatia (the Chairperson of M/S Hindustan Media Ventures Limited, New Delhi), Amit Chopra (the Publisher, M/S Hindustan Media Ventures Limited, New Delhi), Shashi Shekhar (Chief Editor, Dainik Hindustan, New Delhi), Aaku Srivastawa (the Regional Editor, Dainik Hindustan, Patna Edition, Patna) and Binod Bandhu (the Regional Editor, the Bhagalpur and Munger editions of Dainik Hindustan, Bhagalpur). It is worth mentioning that Kashi Prasad has been honoured by Arvind Kejriwal earlier.
The Bihar govt.'s decision hailed : Meanwhile, Mr.Prasad has also hailed the decision of the Bihar government in which the govt. has begun confiscating the properties of arms-smugglers and illicit- liquor manufacturers.Recently, on the directives of the Director General of Police(Bihar,Patna),the Munger police under the leadership of the Police Superintendent,P.Kannan, have confiscated the properties of two arms-smugglers in the Munger district in Bihar.The Munger administratin has sent proposals to the state government to confiscate the properties of twenty more economic offenders.
"If the govt. confiscates the properties of arms-smugglers,the govt. is also free to confiscate the properties of the accused persons in connection with the famous 200 crore Dainik Hindustan Advertisement scandal case," advocates Mr. Prasad.
Demand to expedite the police investigation : In the press -note, Mr.Prasad has also urged the Bihar Chief Minister,Nitish Kumar and the D.G.P(Bihar),Abhyanand to expedite the investigation of this case immediately in the wake of the findings of the supervision-reports of the S.P(Munger) and the Dy.S.P(Munger) .The S.P and the Dy.S.P have found all allegations against the accused persons "prima facie true." It is worth mentioning that the Honourable Justice Anjana Prakash of the Patna High Court has directed the Munger police to complete the police investigaton in this instant case within three months from the date of the receipt of this court order. The High Court order has ,in fact, strengthened the morale of the Bihar police in the investigaton of this world famous case.
Accusations against accused persons under various sections of IPC : All the accused persons namely Shobhana Bharatia,Amit Chopra,Shashi Shekhar,Aaku Srivastawa and Binod Bandhu have been charged with cheating and committing forgery with the Union and the Bihar governments in a bid to get the government advertisements under sections 420/471 and 476 of the Indian Penal Code and sections 8(B)/14 and 15 of The Press & Registration of Books Act,1867.
The charge-sheet awaited : After the submission of the supervision-reports of the Dy.S.P and the S.P,the Munger police are to submit the charge-sheet against them in the court.(EOM)
