पत्रकार से वकील बने पीयूष ने आज समाज से साढ़े तीन लाख मांगा

: ई-मेल के जरिए लीगल नोटिस भेजा : प्रबंधन से पीड़ित पत्रकारों की मदद को तैयार हैं एडवोकेट पीयूष जैन : करीब साल भर पहले अच्छे-खासे पत्रकारिता के करियर की गुडबॉय बोलकर पत्रकार से वकील बने पीयूष जैन ने आज समाज अखबार को अपने बकाया भुगतान करने के लिए नोटिस भेजा है. उन्होंने अपना यह नोटिस ई मेल के माध्यम से गुड मार्निंग इंडिया के एचआर डिपार्टमेंट और मैनेजिंग डायरेक्टर कार्तिक शर्मा को भेजा है. सूत्रों के अनुसार, श्री जैन ने अपने नोटिस में तीन महीने की सैलरी, एक महीने का बोनस, छुट्टिïयों का भुगतान, पीएफ, वेतन के डिफरेंस की मांग की है. बताते हैं कि उन्होंने करीब साढ़े तीन लाख की मांग कंपनी से की है.

Sir,

Under instructions from and on behalf of my client Mr. Piyush Jain S/o Late Sh. V.K. Jain, R/o 341/2A/4A, Shalimar Park, Delhi – 110 032, I do hereby serve upon you with the following legal notice:-

1. That my client had been in the employment of the Hindi Daily newspaper “Aaj Samaj” of the addressee since 01.02.2009 and was working as Staff Reporter and was drawing Rs.17,000/- per month till the date of his termination i.e. 08.03.2010.

2. That earlier my client was working with Sandhya Times as Staff Reporter on a monthly salary of Rs.22,000/- and your officials had approached my client for working with the aforesaid “Aaj Samaj” and offered him a monthly salary of Rs.35,000/-, but you did not provide the same on one pretext or the other.

3. That since the date of joining till the date of termination of his service i.e. 08.03.2010, my client had blameless service record and he never gave an opportunity of any complaint to you with regard to his work and behaviour during his entire service tenure.

4. That just to avoid your liability under various laws, you the addressee is / was not following the rules and regulations and even did not provide the minimum facilities available to my client such as appointment letter, ESIC, PF, Bonus, EL/CL from the date of the appointment and were not maintaining proper record of its employees.

5. That my client was regularly and continuously demanding the aforesaid facilities and also the salary of Rs.35,000/- as promised by you and your Group Editor namely, Sh. Madhukar Upadhaya, but instead of providing the same, you got annoyed and abused my client and threatened him of dire consequences in case of any complaint made against you by my client.

6. That in furtherance of the same, you terminated the services of my client orally on 08.03.2010 without any reasonable cause or excuse and withheld the salary of my client since 29.02.2010 till the date of termination of this services i.e., 08.03.2010.

7. That the termination of the services of my client is per-se illegal and unjustified and against the principles of natural justice which amounts to unfair labour practice and in violation of Section 25 F of I.D. Act.

8. That after termination of services, my client had visited your office on several occasions and requested you to take him back on job and to clear his outstanding dues but instead of putting him back on job or clearing his dues, you started extending threats for implicating him in false criminal case, in case he visits your premises again.

9. That my client, is therefore, entitled to the difference of salary i.e., Rs.35,000/- minus Rs.17,000/-  w.e.f., 01.02.2009 till 29.02.2010 (Totalling Rs.2,34,000/-), salary @ Rs.35,000/- per month from 01.03.2010 to 08.03.2010 (Totalling Rs.4,375/-) and also three months Notice Pay @ Rs.35,000/- per month (Totalling Rs.1,05,000/-) along with Payment of Bonus, Earned Leave, Gratuity, PF and other dues.

I, therefore, call upon you to pay to my client the above said amount i.e., Rs.3,43,375/- (Rupees Three Lacs Forty Three Thousand Three Hundred Seventy Five only) along with Payment of Bonus, Earned Leave, Gratuity, PF and other dues as detailed in Para 9 of the Notice within ten days of the receipt of this notice, otherwise I have definite instructions from my client to take appropriate legal action against you in the court of law at your entire risks, costs and consequences which may please note.

I further call upon you to pay Rs.5,500/- as fee of this legal notice.
