: O R D E R : Whereas by the reports/complaint received and by observation of overall activities prevailing in the areas known as Indira Gandhi International Airport Terminal-1, Terminal- 2, Terminal-3, Haj Terminal, Cargo terminal and roads up to NH-8, which caters to arrival and departure of air passengers and Cargo by different international and domestic flights and all other adjoining operational areas, comprising various Government and Airlines offices….
which includes Airlines offices Complex at outside arrival and departure of Terminal-1, Terminal-2 and Terminal-3, Air India/Indian Airlines office near Jaal Road Termnal-1, Air India Office near ATC Complex, ATC Tower, Import & Export Cargo, Air India workshop, New Customs House, BCAS office, ARC Hanger, Sky Gourmet, Ambassador Sky Chef and other Catering Units, APHO, AAI Building, Centaur Hotel, Udan Bhawan, White House, Airport Service Building, VIP, Premium & General Parking of Terminal 2 & 3, Haj Terminal parking area, Multi Level Car parking of Terminal-3 and all other areas associated with operational control of flights and facilitation of passengers, it became necessary to take measures for immediate prevention and for speedy remedy to prevent obstruction, annoyance or injury to any person lawfully employed or to prevent danger to human life, health or safety of airport, passengers (domestic/international), in view of the strike of Air India pilots which has been declared illegal by the Hon’ble High Court of Delhi vide order dated 27.4.2011 to prevent disturbance of public tranquility including overall smooth functioning of the Airport or riot or affray.
And whereas by the past experience, and by the complaints/report received it is observed that un-restricted holding of public meetings, dharnas, processions, demonstrations, Picketing, soliciting for personal gain in above mentioned area is likely to cause obstruction, annoyance or injury to any person lawfully employed or to cause danger to human life, health or safety of airport passengers (domestic/international), safety of officials and VIPs or may cause disturbance to public tranquility, riot or affray and disturb the smooth functioning of the Airport.
And whereas to prevent or to provide speedy remedy against such obstruction, annoyance or injury to any person lawfully employed or such danger to human life, health or safety of above mentioned persons or such disturbance of public tranquility or a riot, it is deemed necessary to pass an order U/s 144 CrPC for the purpose of immediate prevention or speedy remedy.
Now, therefore, in exercise of the powers conferred upon me by section 144 Criminal Procedure Code 1973, read with Govt. of India, Ministry of Home Affairs New Delhi’s notification No. U-11036/1/2010/UTL dated 09.09.2010, I, Mohd. Irshad Haider, Asstt. Commissioner of Police, Sub-Division Palam (IGIA), New Delhi do hereby make written order prohibiting such activities as mentioned above by aforesaid persons for personal gain.
This order shall come into force w.e.f. from 02.05.2011 and shall remain in force for a period of 30 days i.e. up to 31.05.2011 (Both days inclusive), unless withdrawn earlier.
Any person contravening this order shall be punished under section 188 of the Indian Penal Code.
As the notice cannot be served individually to all concerned, the order is herby passed ex-parte. It shall be published for the information of the public through press and by affixing copies on the notice boards of all Districts Addl.CsP/DCsP, Addl. DCsP, ACsP, Tehsil Offices, all Police Stations concerned and the offices of NDMC and MCD.
Religious functions/ Rallies/public meetings etc. can be held with prior permission, in writing, of Dy. Commissioner of Police, IGI Airport and this order shall not apply to a procession which has the requisite permission of the police.
