आईएनएस उपाध्यक्ष परेशनाथ ने सभी सदस्यों को पत्र भेजने के साथ चार पेज का संलग्नक भी भेजा, जिसमें विवाद के विषय में विस्तार से उल्लेख किया गया है, उस संलग्नक को यहां प्रकाशित किया जा रहा है : UNWARRANTED CHANGES IN ARTICLES : The next AGM of INS to be held on 24.9.09 is being called not only to elect 35 Executive Members, but also to approve a special resolution changing articles of Association, Provisions that had remained on book for many decades are changed. a close look will reveal that new provisions can be misused easily.
The change in article 8(d) shifts the responsibility of proving that the subscription to INS had been actually sent by the member in time i.e. by 1st march sending Cheque that the INS acknowledges the same. yes there are provisions for Reminders but where the payment has already been made the member will not Bother to check if the INS has not sent receipt. it is after all not a tax or a fine. it is Merelv a voluntarv contribution. Heavens do not fall if a member fails to sent his subscription on time and Realizes later after 31st jujy, the last date. framers of the articles 31st july, the Membership can be restored by paying an additional fee of RS 500/-. This provision of extending the courtesy to an old member is now being Removed by deleting article 10(a). why? no answers were given when the Question were raised in executive committee meeting where the proposal was Presented. Did INS face any problem due to articel 10(a). the president did not Share with member.
The changes are of significant consequence and are prone to misuse. Cheques and drafts from member who ask awkward questions or do not give proxies on asking, can be destroyed. Notices can be shown to have bee sent out to members but who will check if these were actually sent.
During last Executive Committee meeting when proposal was being discussed I repeatedly asked for specific instances which created the need for bringing this change but president mr hormusji came did not give any instance. Another suggestion of giving amendments a better thought and combining this with other needed changes was also brushed aside.
Is INS not a body run for serving members? Is it to serve a few?
It is possible that the change in Articles is being brought because a case is pending in High Court where INS is respondent against its own member who had been an office bearer too. The matter for reasons not known has never been disclosed to the Executive Committee. In a way the changes are subjudice and an attempt to cover the case.
A few points to ponder regarding membership of INS which need to be considered berore you as a member give assent to changes:
The membership used to be granted when concerned Regional Committee Chairman approved the same, generally after meeting the applicant.
Now a Committee of ‘Past Presidents’ has taken away powers from Regional Committee Chairmen. This Committee does not circulate its Minutes. This Committee meets half an hour before the Executive Committee meeting and names of approved applicants are kept on table with no information about applicant publication. Many times Chairman of Sub-Committee but Office Bearers are not allowed.
Earlier list of pending application used to be kept in Agenda of Executive Committee but now no such list is given. All pending applications are virtually rejected with no intimation to Executive Members or applicants.
Criteria for new members has now changed. It seems that it is now: ‘If you support, you are in.’
Membership is being cancelled at will on the excuse of delay in payment of subscription. Who has not sent subscription or who sent after delay is known only to a few. Even Office Bearers are not allowed any information. This year even the list of those whose membership has been cancelled due to non/delayed payment has not been kept before the Executive Committee.
INS is now a lucrative source of great influence for the benefit of a few on government policies, advertisement agencies and other media related bodies. On top of it there is several hundred crore worth Mumbai INS Building Project. Few points worth noting:
Members know very little about Building project in Mumbai worth several hundred crores. Signed Development Agreement with developer M/s Orbit has not been circulated among members. Periodic development is not shared with members although the Project Committee Chairman tries his best to inform EC members of Progress.
Notices of Disaccreditation are served but then lifted in a week or so without any details being shared with Committee Meeting are full of such incidents.
Appointments, promotions and increments of INS staff are done without calling BSF Committee. Executive Committee is intimated in only some cases, that too after the decision is implemented.
Secretary General has not been appointed for one full year there is no attempt to appoint one.
WAN conference to be held in December is a prestigious event but as yet it is not clear if INS will be able to raise the required money. Not many members are involved in the event where everyone should have been informed about details. Even the Core Committee members are being kept dark.
Approved Minutes of EC are not circulated among general members as was the practice for decades. These minutes used to be of great source of information for members.
Many healthy conventions of INS have been given a good-bye.
Ignoring all norms, the President has written letters to Prime Minister without prior discussion in Executive Committee. One such letter was written against an English publication inviting the government to intervene. Now a letter dated 13th August 2009 has been written on FDI but the Executive Committee was not about it even when it met on 17th August 2009.
Are these the reasons for anxiety to change the Articles? Is it part or an attempt to confine the membership of INS to only those who accept the situation as it is and to enable those in power to throw those out who disagree by hook or crook. If this amendment is passed, more amendments may be introduced so that INS becomes a pocket organization. This amendment is not needed at all and is misuse of proxy power.
WHAT CAN YOU DO : If you wish to see that this august body retains its dignity, prestige and aura and serves members, you must use the right of your membership carefully and intelligently in this AGM. If you have already given proxy, it was for choosing 35 members and not endorsement of changes in Articles. You have right to change the appointed proxy.
You may also choose to travel to Hyderabad for the sake of INS. Your presence in Hyderabad on 24th September 09 will be the real test of your willingness to SAVE INS.
Those who are protectors of freedoms of public at large, those who are not afraid of establishment, those who take on powerful social and corporate bodies, should have the strength to keep their own house clean and above board, an example for free and fair dealing. Please act now, for later it may be too late.
INS should have vision of future and run by people share the vision.
