पत्रकार की आरटीआई से पता चला- माया व कर्ण भी डिफाल्टर

पीयूष जैन के चलते सरकार को करोड़ों का फायदा : नई दिल्ली नगर पालिका परिषद (एनडीएमसी) क्षेत्र की गिनती देश के सबसे पॉश माने जाने वाले इलाकों में की जाती है। वहां पर रहने वाले और कामकाज चलाने वाले लोगों को सारा देश वीवीआईपी मानता है। वह लोग जितने वीवीआईपी हैं, वह सारे उतने बड़े डिफाल्टर भी हैं। उन लोगों पर एनडीएमसी का अरबों रुपया बकाया है। आज समाज के संवाददाता पीयूष जैन ने उन सभी बड़े लोगों को बेनकाब करने के लिए सूचना के अधिकार-2005 का सहारा लिया। श्री जैन ने उनसे प्रॉपर्टी टैक्स के डिफाल्टरों के बारे में जानकारी मांगी। लेकिन एनडीएमसी ने यह जानकारी तीसरे पक्ष की जानकारी कहकर देने से इनकार कर दिया।

श्री जैन इस मामले को लेकर पहुंच गए मुख्य सूचना आयुक्त शैलेश गांधी की अदालत में। वहां पर उनके तर्को से श्री गांधी पूरी तरह संतुष्ट दिखे। उन्होंने भी तुरंत आदेश दिया कि सारे डिफाल्टरों के नाम वेबसाइट पर डाल दिए जाएं। उसके पश्चात श्री जैन ने एनडीएमसी में लाइसेंस फीस के अलावा बिजली पानी के डिफाल्टरों की सूची भी वेबसाइट पर डालने के लिए एक आवेदन किया। अभी बिजली पानी के डिफाल्टरों की सूची तो नहीं डाली गई, लेकिन बाकी डिफाल्टरों के नाम एनडीएमसी की वेबसाइट पर डाल दिए गए हैं। उस सूची में उत्तर प्रदेश की मुख्यमंत्री मायावती समेत युवराज कर्ण सिंह का नाम भी शामिल हैं। उस लिस्ट को देखने से पता चलता है कि जिन लोगों की गिनती देश के अरबपतियों में की जाती हैं, वह देश के कितने बड़े डिफाल्टर हैं। नई दिल्ली इलाके के ज्यादातर होटलों पर अरबों रुपए का बकाया है। वह होटल एक प्लेट भोजन का दो हजार रुपए चार्ज करते हैं और अपना टैक्स जमा नहीं कराते।

एनडीएमसी के अफसरों के अनुसार, जबसे इस प्रकार के समाचार अखबारों में छप रहे हैं, तब से प्रॉपर्टी टैक्स जमा कराने वाले लोगों की संख्या में जबर्दस्त इजाफा हुआ है। पिछले 15 दिन में ही करीब 70 करोड़ का राजस्व एनडीएमसी को मिला है। इसकी असली वजह पीयूष जैन हैं। यदि सूचना का अधिकार का इस्तेमाल इस प्रकार किया जाए तो सरकार अपने संसाधनों को वसूल कर देश की जनता के लिए बेहतर तरीके से काम कर सकती है।

Information Sought:

a) The number of people who Council area.

b) The name and address of people who owe more than Rs 50,000 to NDMC in property taxes.

Reply of PlO:

The Pio mentioned that there are “a number of assesses against whom property tax of Rs 50,000 and more is outstanding. However, the information sought by the Appellant has not been complied in the said format. The Appellant could, if he so desired, inspect the records available with the department.

Order of the FAA:

The FAA directed the PlO to provide the information of third parties without disclosing their names and addresses, subject to payment of relevant charges. The charges would have to be computed and communicated to the Appellant within a week. In case the Appellant was interested in knowing the names and addresses of the third party, the PlO was instructed to proceed as per provision of section 11 of RTI Act.

The FAA had erred in asking the Pio to make a demand for additional fee for the information since the 30 days already elapsed. The PlO has sent a letter after the FAA’s order demanded Rs.276/- for supply 138 pages of information. Information about defaulters of payments cannot be considered third party information and infact must be available suo-moto under Section-4 of the RTI Act. Public Authorities are allowing large amount of defaults by some people for which the normal law abiding citizen suffers. The Respondent states that the approximate budget of NDMC is about Rs. 1000/- crores where as the amount due from defaulters mere on account of property tax is over Rs.650/- crores. The PlO is directed to putup the list of all the defaulters giving the amounts on the website of NDMC so that citizens can know the individuals and institutions who are being financed by public funds.

Decision:

The Appeal is allowed.

The Pio will provide the information free of cost to the Appellant before 25 November 2009 on a CD.

The PlO is also directed to put up the list of all the defaulters giving the amounts on the website of NDMC under its Section 4 obligations. This will be done before 15 December 2009 and a compliance report will be sent to the Commission before 20 December 2009.
