वीओआई मामले में कोर्ट के ये हैं आदेश

सर्चलाइट मूवीज के अमित सिन्हा और त्रिवेणी मीडिया के मित्तल ब्रदर्स के बीच वीओआई पर आधिपत्य को लेकर मचे घमासान में परसों आए कोर्ट के फैसले की आधिकारिक प्रति सामने आ गई है. दिल्ली हाईकोर्ट के न्यायाधीश जस्टिस विपिन संघई की कोर्ट ने जो फैसला दिया, वो यूं है…

”Issue notice to the respondent returnable on 28.07.2010. Notice be issued through registered AD post, approved courier and be taken Dasti as well. The petitioners are aggrieved by the non-compliance of the supplementary agreement dated 03.06.2010 by the respondent. It is asserted that the respondents have failed to make payment of the agreed amounts as per the schedule fixed in the said agreement.

My attention is drawn to the communication dated 25.06.2010 sent by the respondent to the petitioner undertaking to pay on or before 05.07.2010 a sum of Rs. 1.5 Crores in the manner stated in the said communication. The respondent, it appears, did not make the said payment and the petitioner sent a notice dated 05.07.2010 to the respondent requiring the respondent to handover the possession of the assets along with management of the Triveni Media Limited (‘TML’ for short), and of Voice of India to the petitioner forthwith as per the supplementary agreement dated 03.06.2010.

Considering the averments made in the petition and the documents filled on record, at this stage, the respondents, their servants, agents, nominees, employees, assigns are restrained from alienating, transferring, dealing with, damaging the media equipment and such other properties of TML lying at the premises situated at A-37, Sector – 60, Noida, and other bureau offices of TML throughout India. Mr. xxxxxxxxxx Advocate, mobile No. 98xxxxxxx is appointed as local commissioner to visit the premises situated at A- 37, Sector – 60, NOIDA, to prepare inventory and reconcile the list of equipment installed therein with the list of equipments filed as Annexure B to the supplementary agreement. The local commissioner shall take photograph/videography of the same and to report the condition thereof to this Court.

The local commission shall be executed after giving notice to the parties. The fees of the local commissioner is fixed at Rs. 30,000/- to be paid by the petitioner apart from all other pocket expenses. The local commissioner shall be entitled to take police assistance, in case there is any hindrance caused in the execution of the commission. The S.H.O. of the concerned police station is directed to render necessary assistance to the local commissioner. The respondent shall not deprive the petitioner of its right to inspect the premises in terms of clause 11 of the supplementary agreement dated 03.06.2010 till the next date.”
