एक्टिविस्ट डॉ नूतन ठाकुर ने आज इलाहाबाद हाई कोर्ट के लखनऊ बेंच में हवाई यात्राओं में किराया नियंत्रण हेतु एक याचिका दायर किया. याचिका में यह कहा गया है कि देश में सारे एयरलाइन्स को वायुयान नियमावली 1937 के अनुसूची 11 में दी गयी शर्तों का पालन करने पर नियम 134 के अधीन नागरिक उड्डयन मंत्रालय द्वारा उड़ान प्रमाणपत्र प्रदान किया जाता है. पहले अनुसूची 11 में यह प्रावधान था कि प्राइवेट एयरलाइन्स को तभी प्रमाणपत्र दिया जाएगा जब उनके किराए वाजिब होंगे. साथ ही यह भी प्रावधान था कि ये एयरलाइन्स अपने प्रमाणपत्र में न्यूनतम और अधिकतम यात्री किराया और सामानों का भाड़ा अंकित करेंगे.
याचिका के अनुसार भारत सरकार ने 27 दिसंबर 2013 तथा 13 जनवरी 2015 को नियमावली में संशोधन कर इन प्रावधानों को समाप्त कर दिया, जिसके बाद से एयरलाइन्स की मनमानी और अधिक बढ़ गयी है. नूतन ने इन संशोधनों को अनुचित और उपभोक्ताओं के हितों के सर्वथा विपरीत बताते हुए इन संशोधनों को रद्द करने और पुरानी प्रावधान लागू करने की प्रार्थना की है.
Petition for regulating Air fares
Activist Dr Nutan Thakur today filed a petition in Lucknow Bench of the Allahabad High Court as regards regulating airfares by the various Airlines. The petition says that the Private airlines are granted Air Operator Certificate by the Ministry of Civil Aviation under Rule 134 of the Aircrafts Rules 1937, on fulfilling the conditions given in Schedule 11 of the Rules.
Previously one condition in Schedule 11 was that Certificate would be granted only when the Air fares are reasonable, while another condition said that the Certificate shall mention the minimum and maximum limits of passenger and goods fares to be charged by these Airlines. As per the petition, the Government of India removed these two conditions through amendments made in the Aircraft Rules on 27 December 2013 and 13 January 2015, after which the Airlines have become completely uncontrolled in hiking their fares. Calling them unreasonable, arbitrary and against consumer interest, Nutan has prayed for quashing these amendments and for restoring the previous provisions.
