दिल्ली यूनियन ऑफ जर्नलिस्ट्स (DUJ) और नेशनल अलायंस ऑफ जर्नलिस्ट्स (NAJ) ने मद्रास हाईकोर्ट के ऐतिहासिक फैसले का पूरे दिल से स्वागत किया है, जिसमें प्रेस की स्वतंत्रता की रक्षा की गई है। कोर्ट ने 6 फरवरी 2025 को दिए अपने फैसले में उस घटना की कड़ी निंदा की, जिसमें पुलिस ने यौन उत्पीड़न के एक मामले की रिपोर्टिंग कर रहे पत्रकारों के मोबाइल फोन जब्त कर लिए थे।
मद्रास हाईकोर्ट के जस्टिस जी.के. इलंथिरैयन ने कहा, “पत्रकारों को उनके व्यक्तिगत और गोपनीय डेटा तक जबरन पहुंच प्रदान करने के लिए मजबूर करना, उनसे निजी और संवेदनशील जानकारी मांगना न केवल प्रेस की आज़ादी पर हमला है, बल्कि सर्विलांस (निगरानी) के डर से उन्हें दबाने का प्रयास भी है।”
साहसी पत्रकारों की जीत
DUJ और NAJ ने उन चार बहादुर पत्रकारों को बधाई दी है, जिन्होंने इस मामले में अपने फोन जब्त किए जाने और विशेष जांच दल (SIT) द्वारा की गई अनुचित पूछताछ के खिलाफ अदालत का दरवाजा खटखटाया।
यह मामला अन्ना विश्वविद्यालय की एक इंजीनियरिंग छात्रा के यौन उत्पीड़न से जुड़ा था। जांच के दौरान ऑल-वुमन स्पेशल इन्वेस्टिगेशन टीम (SIT) ने पत्रकारों से 50 से अधिक सवाल पूछे, जिनमें उनके मित्रों और परिवार से जुड़े विषय, विदेश यात्राओं की जानकारी और यहां तक कि उनके गोपनीय सूत्रों का खुलासा करने की मांग शामिल थी।
कोर्ट का सख्त निर्देश
मद्रास हाईकोर्ट ने स्पष्ट निर्देश दिया है कि:
1. जांच अगले पांच दिनों में पूरी की जाए।
2. पत्रकारों के मोबाइल फोन और अन्य जब्त किए गए उपकरण तुरंत लौटाए जाएं।
3. SIT द्वारा पत्रकारों के उत्पीड़न और दबाव को रोका जाए।
दिल्ली पुलिस को भी लौटाने होंगे पत्रकारों के डिवाइस
इस फैसले के संदर्भ में DUJ-NAJ ने मांग की है कि दिल्ली पुलिस भी इसी तरह न्यूज़क्लिक (NewsClick) के पत्रकारों के मोबाइल फोन, लैपटॉप और अन्य जब्त किए गए उपकरणों को तुरंत लौटाए, जिन्हें दो साल पहले की गई छापेमारी में जब्त किया गया था।
प्रेस की स्वतंत्रता और पत्रकारों की निजता की रक्षा के इस ऐतिहासिक फैसले से पूरे मीडिया जगत को एक मजबूत संदेश मिला है कि पत्रकारों को उनके काम के लिए प्रताड़ित नहीं किया जा सकता।
DUJ-NAJ Welcome Judgement on Mobile Privacy
The Delhi Union of Journalists (DUJ) and National Alliance of Journalists (NAJ) welcome wholeheartedly the landmark judgement of the Madras High Court defending press freedom. The Court on February 6, 2025 condemned the police’s seizure of journalists’ mobile phones when they reported on a sexual assault case.”Forcing journalists to provide access to their personal and private data and asking them to reveal private data and asking them to reveal private and confidential information is nothing but assaulting the press and oppressing them with the fear of surveillance,” the Court of Justice G K Ilanthiraiyan said.
The DUJ and NAJ congratulate the four brave journalists who filed the case challenging the seizure of phones and intrusive personal questioning by the all-women Special Investigation Team.
The SIT, while investigating the sexual assault of an engineering student at Anna University, asked journalists to answer over 50 questions, many related to their friends and families, foreign trips etc. They demanded that confidential sources be disclosed. The Court has directed the enquiry be concluded in the next five days, the phones and other seized devices be returned and harassment stopped.
In this context the DUJ-NAJ demand that the Delhi police similarly return the phones, laptops and other devices of journalists seized during raids on NewsClick staff seized over two years ago.
