नई दिल्ली। समाचार एजेंसी एशियन न्यूज़ इंटरनेशनल (ANI) को बुधवार को दिल्ली हाईकोर्ट से बड़ा झटका लगा है। अदालत ने डाइनामाइट न्यूज़ के खिलाफ कॉपीराइट उल्लंघन के मुकदमे में एएनआई द्वारा दायर अपील को खारिज कर दिया।
दिल्ली हाईकोर्ट के न्यायमूर्ति सी. हरि शंकर और न्यायमूर्ति ओम प्रकाश शुक्ला की खंडपीठ ने आदेश दिया कि एएनआई की अपील में कोई दम नहीं है और इसे प्रारंभिक स्तर पर ही खारिज किया जाता है। इस फैसले के साथ डाइनामाइट न्यूज़ ने एएनआई को तगड़ा सबक सिखाया है। अदालत ने एएनआई के आचरण को अनुचित ठहराते हुए उसके रवैये पर भी नाराज़गी जताई।
इससे पहले, 14 अक्टूबर को एकल न्यायाधीश ने आदेश दिया था कि यूट्यूब डाइनामाइट न्यूज़ का चैनल अनब्लॉक करे। अदालत ने यह आदेश तब दिया था जब डाइनामाइट न्यूज़ ने अदालत को आश्वस्त किया कि वह उन सभी नौ वीडियो को हटा देगा, जिन पर एएनआई ने कॉपीराइट उल्लंघन का आरोप लगाया था।
21 मार्च को डाइनामाइट न्यूज़ ने अदालत को बताया था कि वह पिछले दस वर्षों से YouTube चैनल https://www.youtube.com/@DynamiteNews1 चला रहा है और अब तक अपने चैनल पर 17 हजार से अधिक वीडियो अपलोड कर चुका है।
इन 17 हजार वीडियो में से, किसी कर्मचारी की अनजाने में हुई गलती के कारण नौ वीडियो में एएनआई के कुछ सेकंड के अंश चल गए थे। डाइनामाइट न्यूज़ ने अदालत को यह भी भरोसा दिलाया कि भविष्य में वह एएनआई के किसी भी वीडियो का उपयोग अपने चैनल पर नहीं करेगा। अदालत ने इस बयान को रिकॉर्ड पर लिया और फिर आदेश पारित किया।
मामले की अगली सुनवाई 14 अक्टूबर को हुई, जब डाइनामाइट न्यूज़ ने बताया कि एएनआई ने अदालत की जानकारी दिए बिना सीधे यूट्यूब से संपर्क कर कुछ नए यूआरएल हटवाने की मांग की थी। डाइनामाइट न्यूज़ का कहना था कि यह कदम 21 मार्च के आदेश की अवहेलना था, क्योंकि एएनआई ने अदालत में आए बिना चैनल को ब्लॉक करवाने की कोशिश की।
दिल्ली हाईकोर्ट ने दिया सख्त निर्देश
दिल्ली हाईकोर्ट ने एएनआई को निर्देश दिया कि वह दो दिनों के भीतर डाइनामाइट न्यूज़ को सभी संबंधित यूआरएल की सूची उपलब्ध कराए, ताकि उन वीडियो अंशों को हटाया जा सके। साथ ही, यूट्यूब को आदेश दिया गया कि जैसे ही डाइनामाइट न्यूज़ को सूची मिल जाए और वह यूट्यूब से संपर्क करे, तो यूट्यूब दो दिनों के भीतर उसका चैनल अनब्लॉक करे।
न्यायाधीश ने स्पष्ट कहा —
“जैसे ही प्रतिवादी संख्या 2 (यूट्यूब) चैनल को अनब्लॉक करेगा, प्रतिवादी संख्या 1 (डाइनामाइट न्यूज़) को वादी (एएनआई) द्वारा बताए गए सभी यूआरएल को 24 घंटे के भीतर हटाना, निष्क्रिय करना और ब्लॉक करना होगा तथा इसकी सूचना वादी और प्रतिवादी संख्या 2 को देनी होगी। यदि प्रतिवादी संख्या 1 ऐसा करने में विफल रहता है, तो प्रतिवादी संख्या 2 को दोबारा उसका चैनल ब्लॉक करना होगा।”
“We express our displeasure in the manner the appellant [ANI] has proceeded in this matter. The YouTube channel of the respondent [Dynamite News] was unblocked after the March 21 order passed by the single judge in ANI’s copyright suit. The manner in which the appellant ANI managed to get the said order reversed and getting the respondent’s YT channel once again blocked by directly approaching YT, in respect to the URLs that were prior to passing of the March 21 order, deserves to be deprecated,” the Court stated.
अदालत में एएनआई की की बड़ी हार
बाद में एएनआई ने इस आदेश के खिलाफ डिवीजन बेंच में अपील की थी, लेकिन बुधवार को हाईकोर्ट की दो-न्यायाधीशों वाली बेंच ने एएनआई की अपील को पूरी तरह खारिज कर दिया। अदालत ने कहा कि एकल न्यायाधीश के आदेश में कोई त्रुटि नहीं है और एएनआई की अपील निराधार है।
ANI पर कड़ी टिप्पणी
इस फैसले के बाद अब डाइनामाइट न्यूज़ का यूट्यूब चैनल बहाल रहेगा और एएनआई को मामले में कोई राहत नहीं मिल सकी है। अदालत की सख्त टिप्पणियों ने एएनआई के रवैये पर भी सवाल खड़े कर दिए हैं, जिसे अदालत ने “अनुचित” करार दिया।
ब्लैकमेलिंग पर लगी रोक
पत्रकारिता करने वाले तमाम यू-ट्यूबर और न्यूज़ वेबसाइट्स यदि गलती से एएनआई के किसी वीडियो का थोड़ा-सा भी विज़ुअल इस्तेमाल कर लेते हैं, तो एएनआई तुरंत उस चैनल पर कॉपीराइट का दावा ठोककर चैनल संचालकों से वसूली के लिए ब्लैकमेलिंग शुरू कर देता है। यही तरीका एएनआई ने डाइनामाइट न्यूज़ के साथ भी अपनाया था।
यू-ट्यूब पर पत्रकारिता करने वालों को मिली बड़ी राहत
डाइनामाइट न्यूज़ का कहना था कि 17 हजार वीडियो में से पाँच साल पुराने किसी एक वीडियो में कॉपीराइट स्ट्राइक दिखाकर एएनआई पूरे चैनल को ब्लॉक नहीं कर सकता। डाइनामाइट न्यूज़ ने दबाव में न आते हुए कानूनी लड़ाई लड़ी और अंततः एएनआई को कड़ा सबक मिला। छोटे-छोटे यू-ट्यूबर, जिन्हें एएनआई चैनल ब्लॉक कराने की धमकी देकर ब्लैकमेल करता था, अब राहत महसूस करेंगे। अदालत के इस आदेश के बाद एएनआई किसी को चैनल बंद कराने का डर नहीं दिखा सकेगा।
डाइनामाइट न्यूज़ के एडिटर-इन-चीफ मनोज टिबड़ेवाल आकाश वरिष्ठ पत्रकार हैं। उन्होंने दिल्ली दूरदर्शन में दस वर्षों तक मुख्य राजनीतिक संवाददाता और प्राइम टाइम न्यूज़ एंकर के रूप में कार्य किया है। इससे पहले, उन्होंने इंडिया टुडे और द इंडियन एक्सप्रेस जैसे प्रतिष्ठित मीडिया संस्थानों के लिए भी काम किया है।
अवैध बुलडोजर पर लग चुकी है रोक
पिछले साल 6 नवंबर को मनोज टिबड़ेवाल आकाश द्वारा दायर जनहित याचिका पर सुनवाई करते हुए देश की सर्वोच्च अदालत ने ऐतिहासिक फैसला सुनाया था। सुप्रीम कोर्ट ने न केवल उत्तर प्रदेश सरकार पर 25 लाख रुपये का जुर्माना लगाया, बल्कि पूरे देश में अवैध रूप से बुलडोज़र के इस्तेमाल पर रोक भी लगा दी थी। इस ऐतिहासिक निर्णय की पूरे देश में व्यापक चर्चा हुई थी।
ANI suffers major setback in Delhi High Court; Dynamite News wins case, big relief for YouTuber journalists
New Delhi: News agency Asian News International (ANI) faced a major setback from the Delhi High Court on Wednesday, which dismissed its appeal in the copyright infringement case filed against Dynamite News.
A division bench comprising Justice C. Hari Shankar and Justice Om Prakash Shukla observed that there was no merit in ANI’s appeal and dismissed it at the admission stage itself. With this ruling, Dynamite News has secured a clear victory, and the Court expressed displeasure over ANI’s conduct, terming it inappropriate.
Earlier, on October 14, a single judge had directed YouTube to unblock the channel of Dynamite News. The court had passed this order after Dynamite News assured that it would remove all nine videos against which ANI had raised copyright objections.
Senior Advocate Chander Lall and fox and Mandal’s Kunal Vajani, appearing for Dynamite News, earlier argued that since ANI had failed to obtain the relief to block Dynamite News from Court, it directly approached YouTube to ensure the same and ANI wanted Dynamite News to take its license.“We went through negotiations, mediation. Threats were handed out saying that we will remove your channel if you do not take our license. I have removed everything,” the senior counsel said.
On March 21, Dynamite News had informed the court that it had been running its YouTube channel (https://www.youtube.com/@DynamiteNews1) for over ten years and uploaded more than 17,000 videos. Out of these, nine videos had inadvertently included a few seconds of ANI footage due to an unintentional error by a staff member. Dynamite News assured the court that it would not use any ANI videos in the future. The court took this statement on record and passed its order accordingly.
During the next hearing on October 14, Dynamite News informed the court that ANI had contacted YouTube directly, seeking the removal of new URLs without informing the court. Dynamite News argued that this action violated the March 21 order, as ANI attempted to get the channel blocked without approaching the court.
Delhi High Court issues strict directions
The Delhi High Court directed ANI to provide a complete list of the concerned URLs to Dynamite News within two days so that the disputed video clips could be removed. YouTube was instructed to unblock the Dynamite News channel within two days of receiving confirmation that the removal had been completed.
The judge clearly stated:
“As soon as Respondent No. 2 (YouTube) unblocks the channel, Respondent No. 1 (Dynamite News) shall remove, disable, and block all URLs specified by the plaintiff (ANI) within 24 hours and inform both the plaintiff and Respondent No. 2. If Respondent No. 1 fails to comply, Respondent No. 2 shall block the channel again.”
ANI’s appeal dismissed by Division Bench
Subsequently, ANI filed an appeal before a division bench, but on Wednesday, the two-judge bench of the Delhi High Court dismissed it, holding that there was no error in the single judge’s order and that ANI’s appeal was without merit.
Court’s strong remarks on ANI
With this ruling, Dynamite News’ YouTube channel remains active, and ANI received no relief. The Court’s sharp remarks questioning ANI’s conduct have raised serious concerns about its approach, which the Court termed “improper.”
End of alleged blackmailing tactics
Several YouTubers and small digital news platforms had earlier complained that if they used even a few seconds of ANI’s visuals unintentionally, the agency would immediately file copyright strikes and allegedly pressure them for settlements. ANI reportedly adopted a similar approach against Dynamite News as well.
Big relief for YouTuber journalists
Dynamite News argued that out of 17,000 videos, ANI could not demand a complete channel block for one old video containing minor overlapping footage. By standing firm and fighting legally, Dynamite News has set a precedent, bringing major relief to small and independent YouTubers who faced such intimidation. The Court’s order now ensures that ANI cannot misuse copyright claims to threaten or block entire channels.
