SUB- Response to Labour Commissioner’s Report dated 08.07.2016 on the implementation of the Majithia Wage Board Award in Maharasthtra and submitted to the Supreme Court in Contempt Petition (C) No. 411/2014 in Writ Petition (C) No. 246/2011

1.The report is not exhaustive and several establishments such as PTI, UNI, Hindustan Samachar (all news agencies), The Hindu, Business India, Businessworld, Dainik Bhaskar,  Magna Group (Stardust, etc), Living Media Group (India Today, etc), Malayalam Manorama Group(The Week,etc), have been left out from the survey.

2. The report states that 207 newspaper establishments in Maharashtra were surveyed out of which 43 establishments have fully implemented the Majithia Wage Board Award;21 have partially implemented the Award and 143 have not implemented the Award at all.

3. The claims that the Award has been fully implemented and partially implemented have not been verified by scrutinizing the relevant documents such as balance sheets for the relevant years 2007-2008, 2008-2009 and 2009-2010 as well as the relevant wage registers and pay-slips.

4. Consequently, the all-important question as to whether the establishments surveyed have been classified in accordance with Clauses 3-7of the Award has been circumvented. The survey in Vidarbha and Marathwada has been particularly lax in this respect.

5.The Report does not indicate what action has been initiated in the case of those establishments that have admittedly not implemented or partially implemented the Award.

6.The question of whether the quantum of Dearness Allowance, Variable Pay and other allowances such as House Rent Allowance, Transport Allowance, Night Shift Allowance, Leave Travel Allowance and Medical Allowance is in accordance with the relevant provisions of the Award has also not been covered in the Report.

7. The Report has also not sought to establish whether Clause 20 (f ) of the Award, pertaining to Assured Career Development ,has been implemented.

8. The Report has also failed to verify whether Contract employees have been paid Variable Pay in accordance with Clause 9 (b) of the Award.

9. The Report is also silent on whether employees of the surveyed establishments have been paid arrears in four installments by 7 February 2015, the deadline set by the Hon’ble Supreme Court.

10.Several employees have complained that the Labour Department’s officers sought to question them in the presence of management representatives. Oral verification should be conducted in strict confidence after giving due notice to the employees.

11. It is the considered contention of the Joint Action Committee that not a single newspaper establishment in Maharashtra has complied with the Award in its entirety.

In the light of the above facts and reasoning, the Joint Action Committee rejects the Labour Commissioner’s Report dated 08.07.2016.

The Joint Action Committee demands:

That the Labour Department should conduct a fresh survey of all newspaper establishments in the state of Maharashtra after taking into consideration all the points raised in this Joint Action Committee Note and

That the Labour Department should take immediate action against those establishments that have admittedly, partially implemented and not implemented the Award.

    Well done. It is high time we request for a Specimen Calculation Sheet from the Ministry of Labour and Employment and request for publishing it in the Gazette and MoLE’s website. This will put an end to all arguments over DA formula (INS dictated 189 base or Gazette Notified 167 base), whether Variable Pay should be taken into account for Dearness Allowance, PF, calculation, etc.
    Once we get the Specimen Salary Calculation Sheet, we can be able to show it to the Labour Commissioners and erring managements as proof of our genuine claim.
