केंद्रीय सूचना आयोग ने गृह मंत्रालय को भारत सरकार द्वारा जम्मू एवं कश्मीर में वार्ताकार दिनेश्वर शर्मा की नियुक्ति विषयक सूचना देने के आदेश दिए हैं.
लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर ने गृह मंत्रालय से इस नियुक्ति सम्बन्धी पत्रावली के अभिलेख मांगे थे. मंत्रालय ने उन्हें दिनेश्वर शर्मा की नियुक्ति विषयक पत्रों की प्रति प्रदान की किन्तु पत्रावली के नोटशीट तथा पत्राचार को गोपनीय तथा संवेदनशील बताते हुए देने से मना कर दिया.
मुख्य सूचना आयुक्त सुधीर भार्गव ने कहा कि यह विधि का स्थापित सिद्धांत है कि नोटशीट तथा पत्राचार लोक प्राधिकारी के पास उपलब्ध सूचना की श्रेणी में आते हैं तथा उन्हें तभी मना किया जा सकता है जब वे आरटीआई एक्ट 2005 की धारा 8 (1) में निषिद्ध सिद्ध किये जा चुके हों. अतः आयोग ने मंत्रालय को इस मामले की पुनर्परीक्षा करते हुए नूतन को चार सप्ताह में सूचना देने के निर्देश दिए.
CIC directs MHA to provide info on J&K Interlocutor
The Central Information Commission has directed the Ministry of Home Affairs (MHA) to provide information about the appointment of Dineshwar Sharma as the Government of India interlocutor in Jammu and Kashmir.
Lucknow based activist Dr Nutan Thakur had sought documents of MHA file related with this appointment. MHA provided copy of letters regarding the appointment of Dineshwar Sharma but the remaining information pertaining to the correspondences and note sheets was not disclosed as being confidential and sensitive in nature.
Sudhir Bhargava, Chief Information Commissioner said that it is a settled principle of law that disclosure of note sheets and correspondences being information held and available with the public authority cannot be denied to the information seeker unless it is established as prohibited under any of the provisions mentioned under Section 8 (1) of the RTI Act, 2005. Therefore, the Commission directed the MHA to re-examine this matter and provide the information to Nutan within four weeks.
