दिल्ली हाई कोर्ट ने केंद्रीय सूचना आयोग द्वारा एयर इंडिया के विनिवेश से संबंधित सूचना देने के आदेश के विरोध में भारत सरकार की याचिका पर लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर को नोटिस जारी कर जवाब माँगा है. जस्टिस चन्द्र शेखर की बेंच ने सुनवाई की अगली तारीख 18 जुलाई 2019 नियत की है.
मंत्रालय के जन सूचना अधिकारी ने नूतन को आरटीआई एक्ट की धारा 8(1) (जे), जो कैबिनेट पेपर से संबंधित है, में सूचना देने से मना किया था. सूचना आयुक्त दिव्य प्रकाश सिन्हा ने कहा था कि चूँकि कैबिनेट ने एयर इंडिया के विनिवेश के प्रस्ताव को स्वीकृति दे दी है, अतः मंत्रालय द्वारा धारा 8(1)(जे) में सूचना देने से मना करना पूरी तरह अनुचित है. अतः आयोग ने जन सूचना अधिकारी को 15 दिन में सूचना प्रदान करने के निर्देश दिए थे.
सरकार ने अपनी याचिका में कहा कि कैबिनेट ने अभी हाल में ही विनिवेश के प्रस्ताव को स्वीकार किया है, जो अभी शुरुवाती दौर में है. याचिका के अनुसार आयोग के आदेश के दूरगामी परिणाम होंगे, जिसमे गोपनीय सूचना लीक होगी जिसका किसी व्यक्ति द्वारा दुरुपयोग किया जा सकता है. याचिका के अनुसार इस मामले में कई व्यावसायिक कदम शामिल हैं जिनके संबंध में सूचना देने पर भारत सरकार के निर्णय की व्यावसायिक गोपनीयता प्रभावित होगी तथा मामले के व्यावसायिक लाभ पर अनुचित असर पड़ेगा.
Delhi HC notice on CIC Air India disinvestment order
The Delhi High Court has issued notice to Lucknow based activist Dr Nutan Thakur, seeking her response, in the Writ petition filed by Central Government against the directions of the Information Commission to provide information on disinvestment of Air India.
The bench of Justice Chandra Shekhar has fixed 18 July 2019 as next date of hearing.
The Public Information Officer (PIO) of the Ministry of Civil Aviation had denied information to Nutan under Section 8(1)(i) of RTI Act, related with records of deliberations of the Cabinet.
Information Commissioner Divya Prakash Sinha had said in his order that the Ministry had grossly erred in invoking Section 8(1)(i) of RTI Act because the Cabinet has already approved the proposal on disinvestment, hence information cannot be denied., directing the PIO to provide the information as available with the Ministry within 15 days.
The Government has said in its petition that the Cabinet has just accepted the disinvestment proposal which is still at its infancy. The petition says that the Commission’s order would have far-reaching consequences in respect of leakage of confidential information which might be misused by any person. It says there are commercial steps involved, leakage of whose information which will impede the commercial confidentiality of the decision of the Government of India and would affect the commercial viability of the issue.
