यादव सिंह मामले में इलाहाबाद हाईकोर्ट की लखनऊ बेंच में सामाजिक कार्यकर्ता डॉ. नूतन ठाकुर की पीआईएल में उत्तर प्रदेश सरकार और नोएडा विकास प्राधिकरण के हलफनामे कई गंभीर बातों का खुलासा कर रहे हैं।
नोएडा प्राधिकरण के आरपी सिंह द्वारा 13 जून 2012 को सेक्टर-39, नोएडा में दायर एफआईआर में श्री सिंह के साथ वही परियोजना अभियंता रामेन्द्र कमीशनखोरी के अभियुक्त बनाए गए थे, जो 28 नवम्बर 2014 को इनकम टैक्स छापे में यादव सिंह के घर पर मिले और जिन्होंने इनकम टैक्स अधिकारियों के सामने स्वीकारा था कि प्रत्येक अनुबंध अवार्ड में अवैध कमीशन लिया जाता था, जिसके आधार पर नोएडा प्राधिकरण ने 08 दिसंबर 2014 को रामेन्द्र को निलंबित कर दिया।
जो बात दो साल पहले यादव सिंह के खिलाफ एफआईआर में कही गयी थी, वही बाद में फिर से स्थापित हो गई लेकिन सीबीसीआईडी ने मामले में अंतिम रिपोर्ट लगा दी। हलफनामे से यह बात भी सामने आ रही है कि प्रदेश सरकार ने सीबीसीआईडी विवेचना मामले के एक अभियुक्त जेएसपी कंस्ट्रक्शन के संजय जैन के अनुरोध पर ट्रान्सफर किया था। डॉ. ठाकुर ने इन तथ्यों के आधार पर सीबीसीआईडी विवेचना के प्रथमद्रष्ट्या ही गलत होने की बात कहते हुए इन बातों को हलफनामे के जरिये 16 मार्च की सुनवाई में कोर्ट के सामने रखने की बात कही है।

Project Engineer Ramendra, who was co-accused in the FIR registered on 13 June 2012 by R P Singh of Noida Authority in Sector 39, Noida against Sri Singh, is the same person who was found in Sri Singh’s house during Income tax raids on 28 November 2014 and accepted before Income tax authorities that they took illegal commission in each contractual award, based on which Ramendra was suspended on 08 December.
Hence the allegations made against Yadav Singh and Ramendra two years ago was later proved again but CBICID sent Final report in the case. The affidavit also brings forth the fact that the investigation was transferred to CBCID on application JPS construction’s Sanjay Jain, an accused in the FIR. Hence, calling CBCID investigation prima facie erroneous, Dr Thakur has said she would be producing these facts on affidavit before the Court during next hearing on 16 March.
