The Department of Personnel and Training (DOPT), Government of India has refused to provide information about appointment of Rakesh Asthana as Special Director of CBI and about sudden decision to send Sri Asthana and then CBI Chief Alok Verma on leave to appoint M Nageshwar Rao Interim Director, calling them “secret” documents.”
Lucknow based activist Dr Nutan Thakur had sought information about the various inputs given and the Notesheet written at different levels as regards Sri Asthana before his appointment. She had also sought copy of the official file related with sudden sending on leave of Sri Verma and Sri Asthana and appointment of Sri Rao.
DOPT refused to provide the RTI information saying that the requisite documents have been marked as “Secret.” Saying that RTI Act does not provide for refusal of any information after being marked “secret document”, Nutan has preferred an Appeal against these denial.
वर्मा-अस्थाना को हटाना “गोपनीय” अभिलेख, देने से इनकार
कार्मिक एवं प्रशिक्षण विभाग (डीओपीटी), भारत सरकार ने सीबीआई के पूर्व विशेष निदेशक राकेश अस्थाना की नियुक्ति तथा उन्हें एवं पूर्व सीबीआई निदेशक आलोक वर्मा को लम्बे अवकाश पर भेजते हुए एम नागेश्वर राव को अंतरिम निदेशक बनाये जाने की सूचना को “गोपनीय” सूचना बताते हुए देने से इनकार कर दिया है.
लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर ने श्री अस्थाना की सीबीआई में नियुक्ति के समय विभिन्न विभागों से प्राप्त सूचना एवं विभिन्न स्तरों पर अंकित मंतव्य से संबंधित अभिलेख मांगे थे. इसी प्रकार उन्होंने श्री वर्मा तथा श्री अस्थाना को अचानक छुट्टी पर भेज कर श्री राव को अंतरिम निदेशक बनाने संबंधित पत्रावली के नोटशीट मांगे थे.
डीओपीटी ने इन अनुरोध को मना करते हुए कहा कि ये अभिलेख विभाग द्वारा “गोपनीय” अंकित किये गए हैं, अतः इन्हें प्रदान नहीं किया जा सकता है. नूतन के अनुसार आरटीआई एक्ट में किसी अभिलेख को “गोपनीय” बता कर मना करने का प्रावधान नहीं है, अतः उन्होंने इस मनाही के खिलाफ अपील किया है.
