The Lucknow bench of Central Administrative Tribunal (CAT) today reserved its order in the petition filed by IPS officer Amitabh Thakur challenging the promotion guidelines for IAS, IPS and IFS officers. The bench consisting of Navneet Kumar and Jayati Chandra reserved its order after hearing petitioner’s counsel Dr Nutan Thakur and Government of India’s counsel Raj Singh.
Sri Thakur had said that the promotion guidelines are contradictory to the Pay Rules for these services, while also leaving huge scope for discretion. Hence, he had prayed for formulating definite Rules for promotion to these services thereby ending arbitrariness in the process. The Union government had opposed it by saying that the Guidelines were working perfectly all over India and no problem was arising out of it.
कैट- आईएएस, आईपीएस पदोन्नति निर्देश को चुनौती याचिका में फैसला सुरक्षित
केन्द्रीय प्रशासनिक अभिकरण (कैट) के लखनऊ बेंच ने आईपीएस अधिकारी अमिताभ ठाकुर द्वारा आईएएस, आईपीएस तथा आईएफएस के पदोन्नति दिशानिर्देशों को चुनौती देने वाली याचिका पर आज अपना फैसला सुरक्षित कर लिया.
नवनीत कुमार और जयति चंद्रा की बेंच ने अपना फैसला याची की अधिवक्ता डॉ नूतन ठाकुर और भारत सरकार के अधिवक्ता राज सिंह को सुनने के बाद सुरक्षित किया. श्री ठाकुर ने अपनी याचिका में कहा था कि ये पदोन्नति दिशानिर्देश इन सेवाओं के लिए बने वेतन नियमावली के विपरीत हैं, साथ ही इनमे मनमानेपन के लिए काफी स्थान है. अतः उन्होंने पदोन्नति सम्बन्धी स्पष्ट नियम बनाए जाने और इस प्रक्रिया में हो रहे मनमानेपन को ख़त्म करने की प्रार्थना की थी. भारत सरकार ने विरोध में यह कहा था कि दिशानिर्देश पूरे भारत में सही काम कर रहे हैं और इसमें किसी प्रकार की दिक्कत नहीं आ रही है.
