Subject: Complaint against ACP Sanjeev Kumar, Ashok Vihar Police Station from wrongful investigation, verbal abuse and physical threatening and unlawful confiscation of Mobile phone.

Dear Sir,

I am Mansi Singh, an advocate residing in Noida, U.P. My father, Mr. Yashwant Singh, son of Sh. Lal Ji Singh, is a well-known journalist, CEO, and Editor of Bhadas4Media, a website and news portal. He has been in this profession for about 30 years. Recently, an FIR was registered against him at the Bharat Nagar Police Station. The said complaint was registered under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is crucial to mention that the said complaint was based on a false and fabricated story.

It is pertinent to mention that despite several attempt, my father failed to get a copy of the FIR registered against him. On October 2, 2023, my father was summoned for investigation purposes at the Bharat Nagar Police Station, and he willingly cooperated with the Delhi Police to clarify the matter, as it was evidently based on a false story.

Upon my father’s arrival at the station, it became apparent to him that he had not been called in for a genuine investigation. The Investigation Officer for this FIR was appointed ACP Sanjeev Kumar. But the questioning was conducted by Inspector Suraj Pal. The questioning and investigation was conducted in a shady place which does not have any CCTV camera or surveillance. He immediately began verbally threatening my father and even resorted to threatening physical violence. He demanded that my father confess to the allegations, and if he did not comply, he would face severe consequences.

Despite my father’s insistence on presenting his side of the story, the police officer refused to listen and continued to harass him. The Police Officer i.e. Inspector Suraj Pal confiscated my father’s mobile phone, claiming that he needed it for investigation purposes. My father requested a receipt for the seizure, but none was provided. The mobile phone in question is an iPhone 11, containing an Airtel SIM card with the number 9999330099. We have reason to believe that the phone is being used against my father, as it has not been officially collected for investigation but was rather forcibly taken.

The Police officers have direct access to my father’s personal information, including bank account details, access to all social media accounts, home address, and information about our entire family. This situation has placed us in a state of fear and apprehension.

The actions of Delhi Police have infringed upon the fundamental rights of my father and have severely restricted his ability to demand a fair investigation. His conduct has caused my father great distress and has subjected him to severe mental harassment at the hands of the Delhi Police.

As an advocate and his daughter, I would like to raise a few of my concerns to you.

1. Whether the summoning an accused for the purpose of investigation includes verbal abuse, threatening physical violence?
2. Whether an investigation against an accused included confiscation of mobile phone without any due procedure of law?
3. Whether the action of Delhi Police to confiscate the mobile phone for investigation without any receipt or acknowledgement was lawful?
4. When the IO for this Investigation was appointed to be ACP Sanjeev Kumar, then why the investigation was conducted by Inspector Suaj Pal?
5. Whether the questioning and investigation of a Journalist is to be conducted in shady place, without any camera or surveillance?
6. Why haven’t the accused received the copy of the FIR despite repeatedly demanding for the same when it is the right of an accused clearly stated by the Hon’ble Supreme Court of India.

The actions of Delhi Police have directly resulted in:

• Violation of Fundamental Rights: The actions of Delhi Police have directly infringed the Fundamental Rights of a citizen of this country, hence defying its own purpose. The actions resulted in breach of Right to Equality (Article 14), Right to Life and Personal Liberty (Article 21), Right Against Self-Incrimination (Article 20(3)), Right to Privacy (Under Article 21) and Right to Freedom of Speech and Expression (Article 19(1)(a)).

• Police Regulations and Conduct: The behavior of the ACP has violated police conduct regulations. It also resulted it Criminal Intimidation. Police officers are expected to follow a code of conduct and any abuse of power or misconduct should be subject to disciplinary action.

• Human Rights Violations: The actions of Delhi Police have violated the basic human rights. This form of investigation has violated the Principle of Natural Justice. Refusal to hear side, and conducting an investigation with a clear bias, whereas, threatening, harassing and confiscation of personal item is a clear violation of Human Rights.

• Violation of Privacy: The unauthorized confiscation of my father’s mobile phone and the access to personal information is a clear-cut violation of privacy rights.

This is an urgent matter which needs your attention immediately. Please do the needful and take action for the same.
