सेलरी न देने पर चैनल मालिक को ड्राइवर द्वारा ‘ठोंके’ जाने से संबंधित खबर के भड़ास4मीडिया पर प्रकाशन के बाद इंडिया न्यूज चैनल के मालिक कार्तिकेय शर्मा उर्फ कार्तिक शर्मा ने भड़ास4मीडिया डाट काम को लीगल नोटिस भिजवाया है. इस लीगल नोटिस में कहा गया है कि जो कुछ भी भड़ास पर उनके बारे में छपा है, वह सब निराधार, मनगढ़ंत और मानहानिकारक है. लीगल नोटिस में तत्काल प्रभाव से खबर और संबंधित सारे लिंक हटाने को कहा गया है.

Sub: Legal Notice in relation to the false and defamatory statements in the article titled “सेलरी न देने वाले ‘इंडिया न्यूज’ चैनल के मालिक को ड्राइवर ने ‘ठोंक’ दिया! (देखें तस्वीरें) “ which is currently available at your website http://www.bhadas4media.com/tv/12291-kartik-sharma-ko-sabak-sikhaya . Although the whole article is full of false and misleading statements and is defamatory, below mentioned are few of the paragraphs of the said article.
“कहने को तो ये बड़े लोग होते हैं लेकिन दिल इनका इतना छोटा होता है कि ये अपने इर्द-गिर्द रहने वालों के दुखों-भावनाओं को भी नहीं समझते. इंडिया न्यूज चैनल के मालिक कार्तिक शर्मा उर्फ कार्तिकेय शर्मा अरबों-खरबों के मालिक हैं. होटल, मीडिया समेत कई किस्म के बिजनेस हैं. इनके पिता विनोद शर्मा हरियाणा के बड़े नेता हैं. एक भाई मनु शर्मा इन दिनों तिहाड़ जेल में जेसिका लाल मर्डर केस की सजा काट रहा है. सारे कारोबार का दारोमदार कार्तिक शर्मा के कंधों पर है. लेकिन इनकी ओछी मेंटलटी के चलते इनसे काफी लोग नाराज रहते हैं.”
and goes on to state that
“इन महाशय ने अपने ड्राइवर तक को कई महीने की सेलरी नहीं दी थी. खफा ड्राइवर ने हिसाब बराबर करने का ऐसा खौफनाक प्लान बनाया कि सुनकर आपके रोंगटे खड़े हो जाएंगे. नोएडा पुलिस से मिली जानकारी के अनुसार कार्तिकेय शर्मा अपने मित्र अशोक डोगरा के साथ इंडिया न्यूज चैनल के आफिस से दिल्ली के जोरबाग स्थित अपने घर जा रहे थे. बात 27-28 मार्च की रात की है”.
and in the last paragraph states that
“सवाल यह है कि क्या इससे मीडिया मालिक सबक लेंगे? वे कई महीनों तक लोगों से काम कराते हैं और सेलरी दिए बिना निकाल देते हैं. एक ड्राइवर ने जिस तरह से बदला लिया, उससे समझा जा रहा है कि उसने बाकियों को भी रास्ता दिखा दिया है. नोएडा दिल्ली जैसे महंगे इलाके में कोई कर्मचारी बिना सेलरी कैसे अपने परिवार को जिंदा रख सकता है. एक ब्वायलिंग प्वाइंट आता है जिसके बाद खुद को कीड़े मकोड़े की तरह जिंदा रखने की जगह आर-पार करने का फैसला लेते हुए मरने मारने पर उतारू हो जाता है”.
1. As a consequence of the false, incorrect and baseless above-quoted statements, a great deal of harm has been caused to my client’s name and reputation, painstakingly built over a decade.
2. That my client is the founder and promoter of ITV Network which owns and operates “NewsX” which is India’s Leading English News Channel and “India News” which is India’s Leading Hindi News Channel and four Hindi Regional News Channel. Mr. Sharma is responsible for providing livelihood to the families of more than 1500 employees most of whom have been working in his companies for more than half a decade or more.
3. The aforementioned contents of the article are false, malicious and defamatory and have caused severe harm to my client’s and his Companies/Channels’ reputation. Your mala fides, and the intention of harming the reputation of my client, are evident from the fact that instead of criticizing the illegal and life threatening attempt of the driver namely Ram Prakash you have made an attempt to create a public sympathy for an act which is totally illegal and criminal. It might not be wrong to say that you are attempting to criminally incite people against my client by running a false, malicious and frivolous propaganda.
4. In any event, it appears that you willfully omitted to check with my client or the company in which the said Driver is an employee or even verify facts through independent sources, before maligning my client’s reputation by publishing the above quoted false statements of the article, with the intent to cause damage to my client’s reputation.
5. The whole Article is frivolous and malicious and every portion quoted in sentence of the above paragraphs is false.
(i) As mentioned above Mr. Sharma is the founder promoter of ITV Network. Like any other professionally run company there are separate departments with their respective Heads to look after and manage the day to day running of the Company. Mr. Sharma is definitely not involved in payment of monthly salary of an employee who is working as a driver in one of his several companies.
(ii) As per the record of the company in which Mr. Prakash is employed as a driver all his salaries have been paid till date and in fact he was given an advance in the month February 2017 which he is liable to return over a period of six months.
6. Thus, the allegation of non-payment of salary is absolutely baseless, biased and unfounded.
7. You should have followed journalistic ethics and reached out to my client for his comments on those specific baseless statements which are false and defamatory.
8. However, it appears that for your own reasons, you decided not to let truth get in the way of your publishing the article without even attempting to get in touch with my client to verify the above quoted statements.
I therefore call upon you to:
(i) publish a retraction of the said statements in the article prominently on the website: http://www.bhadas4media.com/tv/12291-kartik-sharma-ko-sabak-sikhaya
(ii) publish an unqualified apology to my client for having carried the said article prominently on your website http://www.bhadas4media.com ; and
(iii) remove all the links of the said article from your website with immediate effect following your receipt of this letter.
My client reserves his right to initiate appropriate legal proceedings, civil and criminal, against you (jointly and severally) at your cost and consequences. You are hereby put to notice of the same.

Is it a legal notice, or glorifying the company, and Kartikey Sharma?
As stated in clause 2- “Mr. Sharma is responsible for providing livelihood to the families of more than 1500 employees.”
He can pay salary to his employee. That is enough. He can not be responsible for providing livelihood to the families of more than 1500 employees. He is not the God or “Bhagyavidhata.”

Not only driver ..ITV management has hold and not paid salaries of so many ex employees…dont worry almighty will surely punish him ..the way punished his elder brother.
