राष्ट्रीय मानवाधिकार आयोग ने लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर द्वारा दिल्ली से लाखों मजदूरों के पलायन के मामले में भेजी गयी शिकायत का संज्ञान लिया है.
नूतन ने शिकायत में कहा था कि दिल्ली से हुए पलायन से स्पष्ट है कि इस संबंध में एक या अधिक स्तर पर घोर लापरवाही हुई. इसके अलावा बीजेपी और आप एक-दूसरे पर इन गरीब मजदूरों के पलायन के लिए आपराधिक षडयंत्र करने का भी आरोप लगा रही है.
उन्होंने इस मामले में पयालित हो रहे मजदूरों की तत्काल जरूरतों पर ध्यान देने के साथ प्रशासनिक एवं आपराधिक उत्तरदायित्व के निर्धारण की प्रार्थना की थी.
आयोग ने नूतन को सूचित किया है कि उनके द्वारा भेजी गयी शिकायत आयोग में दर्ज कर ली गयी है, जिसपर अग्रिम कार्यवाही की जाएगी.
NHRC to enquire complaint on Delhi exodus
National Human Rights Commission has taken cognizance of the complaint presented by Lucknow based activist Dr Nutan Thakur in the matter of exodus of lakhs of Delhi workers.
In her complaint, Nutan had said that the mass exodus proves that there is definite huge negligence at one or more levels. In addition BJP and AAP are also making allegations and counter-allegations of criminal instigation of the poor workers to migrate, pointing to criminal conspiracy here.
Hence she had prayed for immediate cognizance of the needs of the migrating workers, along with fixing the administrative and criminal responsibilities of the concerned authorities.
The Commission has intimated Nutan that it has registered the complaint on which subsequent action shall be taken.

Your Lordship,
I am an advocate, activist and member of Aam Aadmi Party (AAP), but I write this letter merely as a concerned citizen of this Nation and my political affiliations have no relevance to the matter of immense human rights concern being raised here.
The issue of exodus of lakhs of migrant workers of UP, Bihar, Jharkhand etc from Delhi during the recent lockdown is making bad news everywhere. The pain and turmoil associated with the entire set of events is beyond words and clearly shows that there are definite failures at the level of governance and proper planning, either by the Union Government or the Delhi Government or both. Equally serious is the series of allegations and counter-allegations being made by the Bhartiya Janata Party (BJP) in power at Center and UP and AAP government in Delhi.
I present certain facts in this complaint, which make it clear that not only is the matter extremely serious and needs immediate intervention, but it is also related with deeper issues related with governance, where the allegations by BJP and AAP are not limited to mere negligence but deliberate criminal misconduct.
For instance, BJP general secretary (organisation) Sri B L Santhosh tweeted on 28/03/2020 at 09.34 PM- “Migrants workers tell on camera that thet were told that buses will be there at Anandvihar … DTC buses drop them to Anand Vihar … Some forces want India to fail when #IndiaFightsCorona Nation will not forgive them.” He followed it by his tweet at 09.45 PM-“ NCR region more than 100 positive cases … It’s a HEALTH RED ZONE … About half a lakh migrant workers from that area allowed , encouraged to move out without being given shelter , food is a criminal act . Some people wants India to fail when #IndiaFightsCorona.”
Allegedly after this, Sri Raghav Chadha had tweeted in Hindi whose English translation is as follows-“According to sources, Yogiji is getting migrants going from Delhi to UP beaten up. He is saying why did you go to Delhi and you will not be allowed to go to Delhi again. My appeal to UP government is not to do this and not to increase problems in this difficult hour.”
After this, Sri Mrityunjay Kumar, Press Advisor to UP CM tweeted as follows-“यह सरासर झूठी ख़बर है, ऐसी महामारी के समय भी इनकी पार्टी गंदी राजनीति खेलने से बाज़ नहीं आ रही है, इतना नीचे कैसे गिर सकती है आम आदमी पार्टी? इस ट्वीट पर उत्तरप्रदेश सरकार और पुलिस निश्चित कार्यवाही करेगी।“
Sri Manish Sisodia, Deputy CM, Delhi made the following tweets at 09.48 PM on 28/03/2020- “मुझे बहुत दुःख है कि कोरोना महामारी के बीच बीजेपी नेता टुच्ची राजनीति पर उतर आए है. @myogiadityanath जी की सरकार ने आरोप लगाया है कि @ArvindKejriwal जी ने बिजली पानी काट दिया इसलिए लोग दिल्ली से जा रहे हैं. यह गम्भीरता से एक होकर देश को, बचाने का समय है, घटिया राजनीति का नहीं. Replying to @msisodia @myogiadityanath जी ! दिल्ली का कोई आदमी यह नहीं कह सकता कि @ArvindKejriwal जी ने लोगों का बिजली पानी काट दिया. फिर आपकी सरकार इस तरह के घटिया बयान जारी कर रही है ये ठीक नहीं लगा.
Sri Mrityunjay Kumar replied to this tweet immediately at 11.03 PM-“दिल्ली से हो रहा ये भारी पलायन आपकी सरकार की ही देन है। इन्हें न आसरा मिला, न खाना, न पानी। मूसलाधार बारिश में सर छुपाने को छत तक नहीं.. योगी सरकार ने रातों रात बसें लगाकर इनके रहने खाने की व्यवस्था की है। झूठ बोलकर फेस सेविंग मत करिए। चुल्लू भर पानी है या भिजवाऊँ?”
Today 29/03/2020 at 07.55 AM, Sri Kapil Mishra, BJP leader presented a video of 0.20 minutes, with the following words- “दिल्ली में इस तरह बस्तियों में रात को माइक से अनाउंसमेंट किये गए थे आनंद विहार के लिए बस जा रही हैं, वहां से आगे यूपी बिहार के लिए बस मिलेगी सोते हुए लोगों को उठा उठाकर बसों से बॉर्डर पर भेजा गया ये बहुत सोची समझी साजिश की गई हैं.”
FIR No 292/2020 has also been registered against Sri Raghav Chadha at Sector-20, Noida by Sri Prashant Umrao, who made this public through his tweet at 08.29 AM.
In contrast, Sri Arvind Kejriwal, CM said in his tweet dated 28/03/2020 at 09.38 PM as follows-“ हमारी दिल्ली में कोई भूखा नहीं सोएगा। आज से हम 568 स्कूल और 238 शेल्टरों द्वारा रोजाना 4 लाख लोगों को भोजन खिलाने के लिए तैयार है आप सब से मेरी अपील है, ज़्यादा से ज़्यादा लोगों को Hunger Relief Centres के बारे में बताएं और नजदीकी सेंटर पर लोगों को पहुंचने में उनकी मदद करें।“ He again tweeted today 29/03/2020 at 10.09 AM-“ दिल्ली से अपने गाँव जा रहे लोगों से मेरी अपील।“, where he appealed to all persons from outside to stay in Delhi, where the Delhi Government will take complete care of them.
The above facts make it clear that-
- There has been mass exodus from Delhi, which was prima-facie against the directions, mandate and basic purpose of complete lockdown.
- These exodus have put in jeopardy the health and public safety of all concerned, including the affected persons, those attending them and where they shall finally be going.
- Hence there is definite huge negligence at one or more levels.
- The BJP and AAP are also making allegations and counter-allegations of criminal instigation of the poor workers to migrate, pointing to criminal conspiracy here.
It is quite obvious that this is an extremely serious matter, which has 03 primary aspects-
A. Immediate relief to the aggrieved persons, who are hardest hit by the events.
B. Fixing liability of administrative negligence.
C. Fixing liability for criminal instigation, if any.
It can be easily seen that each of these aspects are hugely related with Human Rights and Governance and need a completely neutral and non-political approach, which can be done only through an independent and neutral High level Commission. It is also quite obvious that the matter needs immediate attention and is of immense urgency, hence it needs to be kind heard without any delay and without any procedural formalities.
Hence, it is being prayed to kindly take immediate cognizance of this complaint and issue all possible directions/orders in this regards, so that all the 03 aspects/issues raised above are properly taken care of.
