बहुजन समाज पार्टी द्वारा नोटबंदी के बाद दिल्ली के करोल बाग़ स्थित यूनियन बैंक ऑफ़ इंडिया के अपने पार्टी अकाउंट में 02 दिसंबर से 09 दिसंबर 2016 के बीच 104 करोड़ रुपये के पुराने नोट जमा कराये जाने के सम्बन्ध में दायर जनहित याचिका पर इलाहाबाद हाई कोर्ट के लखनऊ बेंच ने निर्वाचन आयोग को तीन माह में निर्णय लेने के आदेश दिए हैं. यह आदेश जस्टिस अमरेश्वर प्रताप साही और जस्टिस संजय हरकौली की बेंच ने याचिकाकर्ता प्रताप चन्द्र की अधिवक्ता डॉ नूतन ठाकुर तथा निर्वाचन आयोग के अधिवक्ता मनीष माथुर को सुनने के बाद दिया.
नूतन ठाकुर ने कोर्ट को बताया कि निर्वाचन आयोग ने 29 अगस्त 2014 द्वारा वित्तीय पारदर्शिता सम्बन्धी कई निर्देश पारित किये जिन्हें आयोग ने अपने आदेश दिनांक 19 नवम्बर 2014 द्वारा और अधिक स्पष्ट किया. इन निर्देशों में कहा गया है कि कोई भी राजनैतिक दल उन्हें चंदे में प्राप्त नकद धनराशि को प्राप्ति के 10 कार्यकारी दिवस के अन्दर पार्टी के बैंक अकाउंट में अवश्य ही जमा करा देगा. इन निर्देशों में कहा गया है कि यदि किसी पार्टी ने इन निर्देशों का उल्लंघन किया तो उसके खिलाफ निर्वाचन चिन्ह (आरक्षण एवं बटाई) आर्डर 1968 के प्रस्तर 16ए में पार्टी की मान्यता रद्द करने सहित तमाम कार्यवाही की जा सकती है.
चूँकि नोटबंदी का आदेश 08 नवम्बर को आया था, अतः इन निर्देशों के अनुसार अधिकतम 20 नवम्बर तक नकद धनराशि बैंक खाते में जमा कर देना चाहिए था पर बसपा ने 2 दिसंबर के बाद 104 करोड़ रुपये जमा कराये, जो सीधे-सीधे इन निर्देशों का उल्लंघन है. निर्वाचन आयोग के अधिवक्ता मनीष माथुर ने कहा कि आयोग को प्रताप चंद्रा की शिकायत मिल गयी है पर वर्तमान में विधान सभा चुनाव कराने की व्यवस्तता के कारण उसे इस पर निर्णय हेतु कुछ समय की आवश्यकता है. कोर्ट ने इन तथ्यों को सुनने के बाद इस शिकायत पर तीन महीने में कार्यवाही करने के आदेश देते हुए याचिका को निस्तारित कर दिया.
HC : Decide over BSP complaint of 104 crore deposit in 03 months
In the Public Interest Litigation filed as regards the Rs. 104 crores cash money deposited in old currency by Bahujan Samaj Party between 02 December 20 to 09 December 2016 in the Party’s bank account in Karol Bagh branch, New Delhi after the demonetization order, the Lucknow bench of Allahabad High Court today directed the Election commission to decide over the complaint within a period of 03 months.
The bench of Justice Amreshwar Pratap Sahi and Justice Sanjay Harkauli passed this order after hearing petitioner Pratap Chandra’s counsel Dr Nutan Thakur and Election Commission counsel Manish Mathur. Nutan Thakur told the Court that the Election Commission had issued Guidelines for financial transparency on 29 August 2014 which had been further clarified through its order dated 19 November 2014. These Guidelines say that any political party must deposit its cash collections in its bank account within 10 working days of the fund collection. These directions say that if any political party violates these Guidelines, action including cancelling the recognition of the political party can be taken under the provisions of Para 16A of the Election Symbols (reservation and Allotment) Orders 1968.
Since the demonetization order came on 08 November 2016, hence as per these directions, the cash deposit in old currencies should necessarily have been undertaken by 20 November but BSP deposited Rs. 104 crores between 02 December to 20 December, which is a clear violation of these Guidelines. Election Commission counsel Manish Mathur said that the Commission has received Pratap Chandra’s complaint but it is presently busy in organizing the Assembly elections, hence it requires some time to decide over the complaint. Having heard the facts, the Court directed the Commission to decide the matter in 03 months, finally disposing the Petition.
