NMC के नए नियम : डॉक्टर-अस्पताल सोशल मीडिया पर मरीज लाने का प्रचार नहीं कर सकेंगे, AI टेस्टिमोनियल और ‘गारंटीड इलाज’ पर रोक

नेशनल मेडिकल कमीशन (NMC) ने डॉक्टरों, अस्पतालों और मेडिकल संस्थानों के लिए विज्ञापन और सार्वजनिक संवाद के नए दिशा-निर्देश जारी कर दिए हैं। 6 अक्टूबर 2026 को जारी ये नियम तुरंत लागू हो गए हैं। इनमें सोशल मीडिया, इंस्टाग्राम, यूट्यूब, इन्फ्लुएंसर मार्केटिंग, स्पॉन्सर्ड पोस्ट और AI से बने प्रचार को साफ तौर पर विज्ञापन की श्रेणी में रखा गया है।

दिशा-निर्देश का नाम है Guidelines on Ethical Advertising and Public Communication by Hospitals/Medical Institutions and Registered Medical Practitioners। इन्हें NMC के एथिक्स एंड मेडिकल रजिस्ट्रेशन बोर्ड ने नोटिस नंबर R-13014/01/2024-Ethics के तहत जारी किया है। सुप्रीम कोर्ट में दायर याचिका और पुराने मेडिकल काउंसिल एथिक्स नियमों को ध्यान में रखकर ये गाइडलाइन बनाई गई हैं।

क्या प्रतिबंधित है

नए नियमों के तहत रजिस्टर्ड मेडिकल प्रैक्टिशनर और अस्पताल भ्रामक प्रचार या मरीज हासिल करने के लिए सोशल मीडिया का इस्तेमाल नहीं कर सकते। साफ मनाही इन चीजों पर है:

• मरीज के टेस्टिमोनियल, सिफारिश, एंडोर्समेंट या रिव्यू मांगना या शेयर करना

• पेड, फर्जी या गुमराह करने वाले रिव्यू, रेटिंग और टेस्टिमोनियल खरीदना या बनवाना

• “गारंटीड इलाज”, “100% सक्सेस”, “बेस्ट डॉक्टर”, “नंबर-1 स्पेशलिस्ट”, “मिरेकल ट्रीटमेंट”, “पेनलेस ट्रीटमेंट” जैसे अप्रमाणित दावे

• प्रमोशनल पेशेंट स्टोरी और इलाज की सफलता दिखाने वाले ऐसे दावे, जो अवास्तविक उम्मीद पैदा करें

• सहमति के बावजूद प्रचार के लिए बिफोर-आफ्टर फोटो या मरीज की कहानी का इस्तेमाल

• सेलिब्रिटी, इन्फ्लुएंसर, मरीज या तीसरे पक्ष से ऐसे एंडोर्समेंट कराना

• मरीज लाने के बदले इन्फ्लुएंसर, एजेंसी या प्लेटफॉर्म को भुगतान

• फर्जी फॉलोअर्स, लाइक, व्यू या सर्च रैंकिंग खरीदना या एल्गोरिदम से अपनी साख बढ़ाना

• सीमित समय के डिस्काउंट, कूपन, गिफ्ट पैकेज या रेफरल लाभ, अगर इनसे अनावश्यक कंसल्टेशन बढ़ने का खतरा हो

AI पर अलग रोक

NMC ने साफ कहा है कि AI से सिंथेटिक मरीज टेस्टिमोनियल, आवाज, क्लिनिकल नतीजे या फर्जी एंडोर्समेंट नहीं बनाए जा सकते। AI का इस्तेमाल सेवा को असल से ज्यादा असरदार या सफल दिखाने के लिए भी नहीं हो सकता। व्यावसायिक हित के लिए AI प्रमोशनल कैंपेन प्रतिबंधित है। अगर कोई AI कंटेंट नियमों के अनुरूप हो, तो उस पर स्रोत का निशान लगाना होगा कि वह AI से बना है।

क्या करने की छूट है

सोशल मीडिया पूरी तरह बंद नहीं हुआ है। डॉक्टर तथ्यात्मक और गैर-प्रचारात्मक स्वास्थ्य शिक्षा दे सकते हैं। अस्पताल अपनी सेवाओं की वस्तुनिष्ठ जानकारी साझा कर सकते हैं—नाम, पता, सुविधाएं, संपर्क—बशर्ते उसमें श्रेष्ठता या गारंटी का दावा न हो। सार्वजनिक स्वास्थ्य अभियान और शैक्षणिक चर्चा भी जारी रह सकती है, पर वे छिपे विज्ञापन या मरीज बुलाने का जरिया न बनें। इलेक्ट्रॉनिक मीडिया पर डॉक्टर को नाम, योग्यता और रजिस्ट्रेशन नंबर बताना होगा।

उल्लंघन पर कार्रवाई

उल्लंघन पर ग्रेडेड कार्रवाई का प्रावधान है। पहली बार चेतावनी और अनिवार्य एथिक्स ट्रेनिंग, दूसरी बार निंदा और मौद्रिक जुर्माना, तीसरी बार तीन से छह महीने का निलंबन। गंभीर मामलों में छह से बारह महीने का निलंबन, और बार-बार उल्लंघन पर एक से तीन साल के लिए मेडिकल रजिस्टर से नाम हटाया जा सकता है। कार्रवाई से पहले कारण बताओ नोटिस और जवाब का मौका दिया जाएगा। अस्पतालों पर क्लिनिकल एस्टैब्लिशमेंट्स कानून के तहत अलग कार्रवाई हो सकती है।

NMC के आधिकारिक अकाउंट ने 6 अक्टूबर को इन दिशा-निर्देशों का लिंक साझा किया था। मेडिकल सर्कल और मीडिया में इसे डिजिटल मार्केटिंग पर सबसे सख्त लगाम बताया जा रहा है, क्योंकि अब प्रचार सिर्फ होर्डिंग या अखबार तक सीमित नहीं रहा—इंस्टाग्राम रील, यूट्यूब वीडियो, स्पॉन्सर्ड पोस्ट और AI कंटेंट भी उसी नैतिक दायरे में आ गए हैं।

And if you are a doctor or run a clinic/hospital, or actively create content on social media, you should definitely read this.

The guidelines came into force with immediate effect and cover advertising, digital communication, social media, AI-generated content and public health communication.

  1. AI-generated promotional content: RMPs and hospitals cannot use AI-generated or AI-assisted content to create misleading information, fabricate clinical data, patient outcomes, professional qualifications or patient experiences.

AI also cannot be used to manipulate a patient’s image, testimonial, voice or clinical outcome to create a false endorsement.

  1. RMPs are prohibited from making unsupported claims of superiority, exceptional expertise or guaranteed outcomes. The guidelines specifically refer to claims such as “Best doctors”, “No.1 Specialist”, “100% success”, “pain-free treatment”, “miracle treatment” and similar statements.

Any claim regarding professional qualifications, experience, outcomes or achievements should be capable of being independently verified and should not create an unrealistic expectation in the patient’s mind.

  1. Patient testimonials and endorsements cannot simply be used for promotion. The guidelines place significant emphasis on patient privacy and consent.

Patient photographs, videos, medical records, clinical images and identifiable medical information should not be used for advertising unless their use is legally permitted and the necessary consent and safeguards are in place.

Patient consent by itself does not automatically make every promotional use acceptable. The guidelines also specifically restrict the use of patient testimonials, before-and-after photographs, success stories and similar material for self-advertisement or promotional publicity.

4. No RMP or hospital/medical institution shall use discounts, limited-period offers, contests, coupons, gifts, cashback, referral benefits, free procedures or similar inducements in a manner that is likely to encourage unnecessary medical consultation, diagnosis, investigation or treatment or otherwise amount to commercial solicitation.

  1. No fake reviews, fake followers or manipulation of online reputation.

The guidelines specifically address the digital environment. RMPs and hospitals cannot use fake followers, likes, reviews, ratings, testimonials or similar mechanisms to artificially increase engagement or manipulate search rankings, visibility, algorithms or their perceived professional standing.

This is particularly relevant in an era where online reputation can directly influence patient choices.

  1. No Before – After photographs for promotional purposes. The guidelines state that use of photographs or images of an RMP for self-advertisement, solicitation or promotional publicity is not permitted.

Similarly, patient photographs and clinical material cannot be casually converted into promotional content.

Doctors therefore need to be particularly careful about the way they use patient images, procedure videos, clinical photographs and “before-after” material on social media.

  1. RMPs cannot make comparative claims such as claiming that their treatment, procedure, facility or outcome is superior to another doctor or institution unless the methodology and evidence behind such a claim are transparent, independently verifiable and legally permissible.

Simply declaring yourself or your institution to be the “best” is not acceptable.

  1. RMPs shall not post, publish or share promotional material involving celebrity patients, including their treatment, photographs, testimonials or clinical outcomes, for the purpose of promoting the RMP or hospital/medical institution.

The Guidelines also restrict the use of third parties, including advertising agencies, digital marketing agencies, influencers or online platforms, for self-promotion or for activities intended to procure or refer individual patients.

The engagement of such agencies or platforms shall not be structured in a manner that results in payment or other consideration being linked to the procurement or referral of individual patients.

In case of violation of the Guidelines, action may be taken by the concerned SMC against the RMP in accordance with the provisions of the NMC Act and Regulations.

The graded action may include:
1st Violation: warning and mandatory ethics training.

2nd Violation: censure and monetary penalty.

3rd Violation: suspension of registration.

Serious Violation: suspension of registration.

Repeated Violations: removal from the medical register for 1–3 years
