जमीयत ने मदरसों पर झूठी रिपोर्टिंग के लिए जागरण को मानहानि का नोटिस भेजा

दैनिक जागरण में खबर इस्लामी मदरसों की साख को धूमिल करने की दुर्भावना से प्रकाशित की गई है, समाचारपत्र को तुरंत माफी मांगनी चाहिए और इसके प्रकाशन पर रोक लगानी चाहिएः मौलाना महमूद मदनी

नई दिल्ली : जमीयत उलेमा-ए-हिंद के अध्यक्ष मौलाना महमूद ए मदनी के दिशानिर्देश पर जमीअत के वकील अधिवक्ता एम. आर. शमशाद ने उनकी तरफ से हिंदी के समाचारपत्र ‘दैनिक जागरण’को एक भ्रामक खबर प्रकाशित करने के लिए कानूनी नोटिस भेजा है। जागरण ने गत 7 जुलाई 2021 को ‘उमर गौतम के मदरसे की खोज में 30 से अधिक रडार पर’ के शीर्षक से उक्त समाचार को प्रकाशित किया था।

इस सम्बंध में नोटिस में कहा गया है कि जागरण की उक्त खबर में “कई गलत और निराधार बातें शामिल हैं, जो पूरी तरह से गैर-जिम्मेदाराना, भ्रामक रिपोर्टिंग है“। उन्होंने कहा कि ‘‘यह मूलतः मदरसों की प्रतिष्ठा को खराब करने के दुर्भावनापूर्ण इरादे से है। इसके पढ़ने से सामान्यतः जिस तरह की भावना बनती है, वो सभी मदरसों के लिए अत्यंत नकारात्मक है.

नोटिस में आगे कहा गया है कि “प्रतिष्ठानों या अल्पसंख्यक संस्थनों यानी मदरसों के प्रबंधन को आपके द्वारा अवैध गतिविधि के रूप में दर्शाया गया है। यह एक भ्रामक और गलत धारणा है जो उन मूलभूत संवैधानिक सिद्धांतों का उल्लंघन है जिसमें न केवल अनुच्छेद 30 के तहत सभी अल्पसंख्यक (धार्मिक या भाषाई) को देश में अपनी पसंद के शिक्षण संस्थानों को चलाने और स्थापित करने का अधिकार प्रदान किया गया है बल्कि अनुच्छेद 29 के तहत अलग भाषा, लिपि या संस्कृति वाले नागरिकों के किसी भी वर्ग के भी इन्हीं अधिकारों को संरक्षित किया गया है।

नोटिस में आगे कहा गया है कि “आपने गलत तरीके और दुर्भावना से कहा है कि मदरसे मान्यता नहीं लेना चाहते हैं। रिपोर्ट में आगे कहा गया कि ज्यादातर गैरमान्यताप्राप्त मदरसे मान्यता के लिए आवेदन नहीं करना चहते हैं क्योंकि मान्यता मिलने पर उन्हें विभाग के नियमों का पालन करना होता है। चंदे का हिसाब देना होता है। यह मेरे मुवक्किल के खिलाफ नोटिसी (जागरण प्रकाशन और रिपोर्टर हसीन शाह) द्वारा तैयार किए गए स्पष्ट रूप से झूठे और निराधार तथ्य हैं। किसी भी मात्रात्मक आंकड़े, सांख्यिकीय संदर्भ या सबूत के अभाव में आपने द्वेष फैलाने की कोशिश की है।“

नोटिस में आगे कहा गया है कि “दुर्भावनापूर्ण इरादे से की गई इस विवादास्पद रिपोर्टिंग में व्यापक शीर्षक के तहत “लव जिहाद“ से सम्बंधित अन्य समाचारों को भी इसमें सम्मिलित किया गया है। एक अकेले शीर्षक के तहत समाचार सामग्रियों का यह वर्गीकरण पाठकों को भ्रमित करने और मदरसों को अवैध गतिविधियों से बदनाम करने का प्रयास है।“

नोटिस में आगे कहा गया है कि “उपरोक्त समाचार के प्रकाशन से मदरसों को एक अपूरणीय क्षति हुई है और प्रतिष्ठा को नुकसान पहुंचा है। विशेषकर तब जब आपने उमर गौतम के मामले को इससे जोड़ने का प्रयास किया है जो कि स्वयं अभी इस स्तर एक असत्यापित और विचाराधीन मामला है।“

नोटिस में जागरण से बिना शर्त माफी मांगने और विवादित लेख का प्रसार बंद करने और अपनी वेबसाइट से इसकी ऑनलाइन कॉपी को हटाने की मांग की गई है।

इस सम्बंध में आज नई दिल्ली में जमीयत उलेमा-ए-हिंद के कानूनी मामलों के संरक्षक एडवोकेट व मौलाना नियाज अहमद फारूकी ने बताया कि इस खबर से यह प्रभाव देने का प्रयास किया गया है कि देश में सभी स्वतंत्र मदरसे गैरकानूनी तरीके से चलते हैं। इसलिए सरकार इनके विरुद्ध कार्रवाई करेगी। हालांकि यह सच्चाई है कि यह मदरसे देश के संविधान के बुनियादी अनुच्छेद 30 के अनुसार चलते हैं और उनका अस्तित्व बिलकुल संवैधानिक है और संवैधानिक अधिकार का संरक्षण है। इसलिए ऐसी खबरों को नजरअंदाज नहीं किया जा सकता है जिससे सभी मदरसों की साख प्रभावित होती है।

Jamiat sends defamation notice to Jagran for false report on Madrasas

Jamiat national president Maulana Mahmood Madani said we have well-founded apprehensions that the report has been published with malafide and malicious intentions of harming goodwill and reputation of madarsas. Demands an unconditional apology and brakes on its circulation.

New Delhi (19 July 2021): Jamiat Ulema-i-Hind has sent a legal notice to Hindi newspaper Dainik Jagran for a report published on 07 July, targeting Madrasas. The notice sent on Friday demands an “unconditional apology in writing” and warns civil and criminal legal proceedings if failed to act on the notice.

“In search of Umar Gautam’s Madarasa, more than 30 Madarasa on radar,” translates the title of the report. The report claims these Madrasas are working illegally. Reports on ‘Love Jihad’ are also placed under the broader title.

The notice is sent by the Supreme Court advocate M R Shamshad on behalf of his client Maulana Mahmood A. Madani, President of Jamiat Ulama-i-Hind.

The notice stated that the Jagran story “contains several incorrect and baseless averments leading to grossly irresponsible, false reporting” with a “malafide intention to malign the reputation of Madarsas in general. Its reading is blatantly generalised in nature thereby posturing an extremely negative construct for all the Madarsas.”

The notice further stated that “The establishment or administration of Minority Institutions i.e. Madarsas herein have been portrayed by you as an illegal activity. A false and incorrect impression that goes against the cardinal constitutional principles wherein not only all minorities (religious or linguistic) have been provided the right to administer and establish educational institutions of their choice in the country (Article 30) but any section of the citizens having a distinct language, script or culture of its own are also protected thereby provided the right to conserve the same (Article 29)”
As far as RTE Act 2008 is concerned, as per the Supreme Court in Paramati Educational & cultural trust Vs Union of India (2013) exempts minority institutions including madarsas from its purview.

The notice further stated that “That the impugned report, with malafide intention, includes other news reports pertaining to “love jihad” under the broader title. This categorization of news items together under a single title is an attempt to confuse the readers and malign the Madarsas with illegal activities.”

The notice further stated that “The publication of the above story has caused an irreparable injury and loss of reputation to Madarsas in general when you have sought to link with the case of Umar Gautam; which itself is an unverified sub-judice matter at this stage.”

The notice demanded Jagran to apologise unconditionally and stop circulation of the impugned article and to take down the online copy from its website.
