गृह मंत्रालय, भारत सरकार ने अनुच्छेद 370 को समाप्त करने के निर्णय से संबंधित सूचना देने से साफ़ इंकार कर दिया है. लखनऊ स्थिति एक्टिविस्ट डॉ नूतन ठाकुर ने गृह मंत्रालय से अनुच्छेद 370 को समाप्त किये जाने, जम्मू कश्मीर को राज्य का दर्जा समाप्त किये जाने तथा जम्मू-कश्मीर एवं लद्दाख को केंद्र शासित प्रदेश बनाये जाने से संबंधित गृह मंत्रालय की पत्रावली के अभिलेख मांगे थे.
मंत्रालय के जन सूचना अधिकारी ने इसे आरटीआई एक्ट की धारा 8(1) से आच्छादित बताते हुए कहा कि इस विषय पर नागरिकों को सूचना देने की बाध्यता नहीं है. नूतन ने इसके खिलाफ प्रथम अपील दायर कर कहा है कि मात्र धारा 8(1) में सूचना देने से मना करने की बात सही नहीं है, बल्कि यह भी बताया जाना जरुरी है कि सूचना धारा 8(1) की किस उपधारा में निषिद्ध है. इससे पहले प्रधानमंत्री कार्यालय ने भी नूतन को यह सूचना “यथोचित विचार के बाद” देने से मना कर दिया था.
MHA blatantly refuses info on Article 370, J&K
The Ministry of Home Affairs (MHA) has blatantly refused to provide information related with the decision to abrogate Article 370.
Lucknow based activist Dr Nutan Thakur had sought copy of the official file of MHA related with the decision to abrogate Article 370, end the status of Statehood of Jammu and Kashmir and form Union Territories of Jammu and Kashmir and Laddakh.
The Central Public Information Officer (CPIO) of MHA refused to provide information, saying that the information sough attracts the provisions of section 8(1) of the RTI Act, under which there is no obligation to provide information to citizen.
Nutan has filed First Appeal against this order, saying that the MHA has not clearly specified which sub-section of section 8(1) is applicable in this case.
Previously the Prime Minister Office had also refused to provide this information as being done “after due consideration.”
