Securities & Exchange Board of India (SEBI) has requested Lucknow Bench of Allahabad High Court to grant further 6 months to enquire into the complaints presented by IPS officer Amitabh Thakur and social activist Dr Nutan Thakur regarding issuance of Sahara Q shop bonds and advances.
Through an application filed by Naveen Sharma, AGM, SEBI, Lucknow, SEBI said that it has already initiated the process of examination of issues with regards to schemes of Sahara Q shop unique products and conversion of Adobe bonds into bonds of Sahara Q shop.
SEBI also said that Sahara Q shop is not cooperating in the examination of the matter and no financial details have been made available by them. It said Sahara Q shop have not filed their financials even to Registrar of companies and hence obtaining these details is becoming very difficult.
Hence considering the complex nature of the bonds and the voluminous nature of documents, SEBI has sought 6 more months to examine the complaint sent by Amitabh and Nutan.
Previously the High Court had directed SEBI to decide their pending representation in accordance with law, within a period of three months.
The petition had said that like previous cases of Sahara India Real Estate and Sahara Housing, in reality the Sahara Q shop advances were again collection of public money by bye-passing the law of the land, thereby putting the interest of investors in complete jeopardy. Calling them illegal and improper means of public money collection, they had sought enquiry which SEBI had been ignoring, forcing them to file this Petition.
सेबी : सहारा क्यू शॉप में बदलाव की जांच, सहारा का सहयोग नहीं
भारतीय प्रतिभूति एवं विनियम बोर्ड (सेबी) ने इलाहाबाद हाई कोर्ट की लखनऊ बेंच के आदेश पर आईपीएस अधिकारी अमिताभ ठाकुर और सामाजिक कार्यकर्ता डॉ नूतन ठाकुर द्वारा सहारा क्यू शॉप अग्रिम तथा बॉण्ड के सम्बन्ध में की जा रही जांच के लिए 6 अतिरिक्त माह का समय दिए जाने का निवेदन किया है. नवीन शर्मा, एजीएम, सेबी, लखनऊ के माध्यम से प्रस्तुत प्रार्थनापत्र में सेबी ने कहा है कि उसने सहारा क्यू शॉप द्वारा बांड जारी किये जाने और एडोब बांड के क्यू शॉप बांड में परिवर्तित करने की जांच शुरू कर दी है.
सेबी ने कहा कि सहारा क्यू शॉप इस जांच में कत्तई सहयोग नहीं कर रहा है और उसके द्वारा कोई भी वित्तीय आंकड़े उपलब्ध नहीं कराये गए हैं. उन्होंने कहा कि सहारा क्यू शॉप ने कंपनी रजिस्ट्रार तक को ये आंकड़े नहीं दिए हैं जिससे इन्हें हासिल करने में बहुत कठिनाई आ रही है. अतः मामले की जटिलता और वृहत स्वरुप को देखते हुए सेबी ने अमिताभ और नूतन द्वारा दी गयी शिकायत की जांच के लिए 6 अतिरिक्त माह देने का निवेदन किया है.
पूर्व में हाई कोर्ट ने सेबी को इन लोगों द्वारा प्रस्तुत प्रत्यावेदन को तीन माह में निस्तारित करने के आदेश दिया था. याचिका में कहा गया था कि पूर्व के सहारा इंडिया रियल एस्टेट और सहारा हाउसिंग की तरह सहारा क्यू शॉप अग्रिम भी हकीकत में क़ानून को धोखा दे कर पब्लिक मनी कलेक्शन है, जिसमे निवेशकों के हितों की रक्षा का कोई प्रावधान नहीं है. अतः इसे पब्लिक मनी कलेक्शन का गैर-कानूनी और अनुचित तरीका बताते हुए इन्होंने सेबी से जांच की मांग की थी और कोई कार्यवाही नहीं होने पर याचिका दायर किया था.
