Subject: Compliance with the judgment dated 7.2.2014 passed by the Hon’ble Supreme Court in Writ Petition (c) No. 246/2011 and other connected Writ Petitions.

Sir/s,
      This is to bring to your kind attention that the Central Government, in exercise of powers under S. 9 and S. 13 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, constituted the Justice Majithia Wage Board. The said Majithia Wage Board submitted its recommendation to the Central Government on 31.12.2010. The said recommendations were challenged by various parties before the Hon’ble Supreme Court in Writ Petition (c) No. 246/2011 titled ABP Pvt. Ltd. And ors. Vs. Union of India and ors.and other connected Writ Petitions.

That, during the pendency of the above mentioned Writ Petitions, the Central Government, in exercise of its power under S. 12 of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, issued notification accepting the recommendations of the Majithia Wage Board. The Hon’ble Supreme Court, vide its judgment dated 7.2.2014, upheld the recommendations of the Majithia Wage Board and dismissed the Writ Petitions filed by various parties. It may also be stated here that the Hon’ble Supreme Court further directed that the wages as revised/determined shall be payable from 11.11.2011. It was further directed that the arrears upto March, 2014 shall be paid to all eligible persons in four equal installments within a period of one year from the date of the judgment and continue to pay the revised wages from April 2014 onwards. The directions issued by the Hon’ble Supreme Court is reproduced herein below for ready reference:
 
“73. In view of our conclusion and dismissal of the Writ Petitions, the wages as revised/determined shall be payable from 11.11.2011 when the Government of India notified the recommendations of the Majithia Wage Boards. All the arrears up to March, 2014 shall be paid to all eligible persons in four equal installments within a period of one year from today and continue to pay the revised wages from April, 2014.” A copy of the judgment is enclosed herewith as Enclosure – A.
 
That, I had been appointed in your company on 24.12.2007 as Reporter in Jan Jagriti – Editorial Department at Indore. On 23.06.2008 I was promoted to the post of Sub Editor and since have been working with your company on the said post.
 
That, I am covered by the recommendations of the Majithia Wage Board and as such I am entitled for receiving the pay scale as revised by the Majithia Wage Board. I am also covered by the direction of the Hon’ble Supreme Court in Paragraph No. 73 quoted above and therefore I am not only entitled for revised wages from April, 2014 but I am also entitled to receive the arrears from 11.11.2011 to March, 2014.
 
However, instead of paying the above mentioned amounts as recommended by the Majithia Wage Board and as directed by the Hon’ble Supreme Court in its judgment dated 07.02.2014, the officials of your company has been forcing its employees, including myself to sign a declaration stating that we are happy with the current wages and do not want the benefit of the recommendations of the Majithia Board or that of the directions of the Hon’ble Supreme Court dated 07.02.2014.
 
Not only this, when some of the employees refused to sign the above mentioned declaration, the management, with malafide intentions issued transfer orders with regard to all such employees, thereby acting arbitrarily and highhandedly. The officials of the company also tried to force me into signing the declaration. On my refusal to do so, the management issued order for transferring me from Indore to Barmer.
 
That, the above mentioned act of not paying the revised wages with effect from April, 2014 as also the act of not paying the arrears as per the above directions, does not only amount to non compliance of the directions issued by the Hon’ble Supreme Court, but also amounts to contempt of the directions of the Hon’ble Supreme Court, which is further aggravated by the act of the Company in forcing the employees to sign the declaration as mentioned above.
 
That, in compliance of the directions issued by the Hon’ble Supreme Court, kindly ensure that the revised wages are paid from April, 2014 and the arrears from 11.11.2011 up to March, 2014 are paid in four equal monthly installments within a period of one year from 07.02.2014.

    Fight for justice and also against the unjust Every Employees want to fight for their right as legally of any way as Shri Tarun Bhagwat. Tarun ji legal fight ka phal (fruit) aapko jaroor milega. Majithia Wage Board bhi Bahut sare karmachariyonka ke ladhai ka hi phal hai. Majithi Wage Board aasanise nahi mila hai. Sabhi karmachariyone ekjoot hokar/ Union ke sath ladhna chahiye.
