The Allahabad High Court, Lucknow Bench has taken a very strict view in the PIL filed by advocate Tripuresh Tripathi for effective control of swine flu and other influenza diseases, issuing notice to the Central and UP government.
Additional Advocate General Bulbul Godiyal tried to present the efforts made by the State government but petitioner’s counsel Dr Nutan Thakur strongly refuted these claims saying that both the governments have abjectly failed in their duty resulting in huge shortage of drugs and masks, with patients being turned back from hospitals. She also requested to implead Lucknow DM, CMO and town health officer of Nagar Nigam.
The bench of Justice Imtiyaz Murtaza and Justice Rituraj Awasthi said that it was not satisfied with the State government’s efforts. Hence it asked the respondents to present the efforts made so far before the Court, with special emphasis on preventive action. The Court also directed all officers including Principal Secretary Health to be present tomorrow before it, for the matter to be heard again.
स्वाइन फ्लू: हाई कोर्ट सख्त, अधिकारी तलब
स्वाइन फ्लू तथा अन्य इन्फ़्लुएज़ा रोगों पर असरदार नियंत्रण किये जाने के सम्बन्ध में अधिवक्ता त्रिपुरेश त्रिपाठी की पीआईएल में इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने कड़ा रुख अख्तियार करते हुए भारत सरकार और प्रदेश सरकार के स्वास्थ्य विभाग को नोटिस जारी किया है. राज्य सरकार की ओर से अपर महाधिवक्ता बुलबुल गोदियाल ने सरकार द्वारा किये गए कार्यों को बताया पर याची की अधिवक्ता डॉ नूतन ठाकुर ने इसका कड़ा प्रतिवाद करते हुए कहा कि दोनों सरकारें स्वाइन फ्लू को नियंत्रित करने में बुरी तरह असफल रही हैं जिसके कारण दवाईयों और मास्क की भारी किल्लत है और रोगी अस्पताल से लौटाए जा रहे हैं.
उन्होंने लखनऊ के डीएम, सीएमओ और नगर निगम स्वास्थ्य अधिकारी को भी प्रतिवादी बनाने का अनुरोध किया. जस्टिस इम्तियाज़ मुर्तजा और जस्टिस ऋतुराज अवस्थी की बेंच ने कहा कि वह सरकार के प्रयासों से संतुष्ट नहीं है. अतः कोर्ट ने भारत सरकार और राज्य सरकार द्वारा की गयी निरोधात्मक कार्यवाही सहित अब तक की गयी कार्यवाही से अवगत कराने को कहा. साथ ही कोर्ट ने प्रमुख सचिव स्वास्थ्य सहित सभी अधिकारियों को कल 25 फ़रवरी को तलब किया है जब फिर सुनवाई होगी.
