पूर्व केन्द्रीय मंत्री एम जे अकबर द्वारा दिल्ली के पटियाला हाई कोर्ट में दायर मानहानि के मुकदमे में खुद उनके लिए मुश्किलें बढ़ सकती हैं. 27 अक्टूबर को दिल्ली बार कौंसिल ने उनके वकील को नोटिस जारी करते हुए गलत वकालतनामे के लिए दो सप्ताह में जवाब माँगा है. गौरतलब है कि पूर्व विदेश मंत्री ने #MeToo कैम्पेन के तहत अपने ऊपर लगे आरोपों के बाद एक आरोपकर्ता पत्रकार के खिलाफ दिल्ली के पटियाला कोर्ट में मानहानि का मुकदमा दर्ज किया है.
स्त्रीवादी पत्रिका स्त्रीकाल द्वारा 16 अक्टूबर को प्राप्त शिकायत का संज्ञान लेते हुए काउन्सिल ने सर्वमत से फैसला लेते हुए यह कार्रवाई की है. स्त्रीकाल की ओर से पत्रिका के सम्पादक संजीव चंदन ने बार काउंसिल को लिखा था कि इस मामले में पूर्व विदेशमंत्री द्वारा दायर मानहानि के मुकदमे में न सिर्फ बार काउंसिल के नियमों का उल्लंघन किया गया है, बल्कि वकालतनामे को मीडिया में जारी कर और 97 वकीलों की सूची जारी कर शिकायतकर्ताओं पर मानसिक दवाब बनाने की कोशिश की गयी है. शिकायत में कहा गया है कि बार काउंसिल के नियम के अनुसार वकालतनामे पर वकीलों का नाम, पता, संपर्क और एनरोलमेंट नम्बर आदि दर्ज करने होते हैं. अकबर के लिए कारंजावाला एंड कम्पनी द्वारा दायर वकालतनामे में इस नियम का अनुपाल न नहीं हुआ है और यहाँ तक कि नियमानुसार एम जे अकबर के हस्ताक्षर को भी वेरीफाय नहीं किया गया है.
बार काउन्सिल ने इस शिकायत का संज्ञान लेते हुए एडवोकेट कारंजावाला को नोटिस जारी की है और कहा है कि वकालतनामे पर चार वकीलों के ही एनरोलमेंट नंबर दर्ज हैं और उनके नाम तक नहीं लिखे गये हैं. इस सन्दर्भ में दो सप्ताह में जवाब माँगा गया है. अब सवाल है कि जिस वकालतनामे के साथ मानहानि का मामला दर्ज हुआ व्ही गलत है तो क्या दर्ज मामला गैरकानूनी नहीं है स्त्रीकाल की ओर से शिकायतकर्ता संजीव चन्दन ने कहा कि इस मामले में न सिर्फ नियमों का उल्लंघन हुआ है बल्कि 97 वकीलों की सूची मीडिया में जारी कर #MeToo कैम्पेन के तहत आवाज उठाने वाली स्त्रियों को दवाब में लाने की कोशिश की गयी है. आवाज उठाने वाली महिलाओं को प्रोत्साहित करना जरूरी है इसलिए हमने यह कदम उठाया है.
Bar council Delhi issued notice to MJ Akbar’s advocate
In a recent development of defamation case filed by the former union minister M.J.Akbar against the journalists, who raised voice in the #MeToo campaign, the Delhi Bar Council has issued Notice to Advocate Karanjawala, whose firm is appearing for Akbar in the case.
The Notice dated, 27.10.2018, has been sent on the complaint filed by Streekaal, a Feminist Hindi Journal and online Portal. The Council has asked the firm to reply the notice in Two weeks.
Sanjeev Chandan, the editor of Streekaal on behalf of Streekal had written to the Bar council of India on October 16. In his complaint he drew the attention of council on some issues and requested action against the advocates. Chandan in his complaint wrote, ‘ that filing of vakalatnama of 97 lawyers by the Karanjawala firm is nothing but a vulgar threat and show of power, diplayed widely in the press. It also shows the intention that the Vakalatnama was distributed in the Media.’
The complaint also raises some legal points saying, ‘ It is mandatory to mention name, enrollment number, address and phone number and other contact details of the advocates, which in the case of the 97 lawyers have not been fulfiled.
Acting on the complaint of Streekaal The Bar Council of Delhi issued notice observing that only 4 persons appears on the Vakalatnama with enrolmment numbers. Their names have also not been mentioned.’ The court observed that the Vakaltnama is not as per the rules of Bar Council.’
Now the question is that How the defamation case filed in this matter will be legal in the court if the Vakaltnama is not as per the rule.
