जस्टिस सी के प्रसाद को प्रेस कौंसिल का नया अध्यक्ष बनाया गया है पर सामाजिक कार्यकर्ता डॉ नूतन ठाकुर ने उनकी नियुक्ति पर गहरी आपत्ति जाहिर की है. उन्होंने भारत के राष्ट्रपति को पत्र भेज कर 01 जनवरी 2014 को उनके कृष्णा नगर, पटना स्थित शुभाशीष सेन गुप्ता नामक पड़ोसी के साथ विवाद में अपने पद का खुलेआम दुरुपयोग करने सम्बंधित अपनी शिकायत की प्रति संलग्न किया है.
शिकायत के अनुसार जस्टिस प्रसाद पर अपने परिवार वालों के साथ “जानबूझ कर एक आपराधिक षडयंत्र करने, एक झूठे केस में उन्हें फंसाने के लिए गवाह बनने, उनकी संपत्ति पर गलत कब्जा करने, पडोसी की जमीन पर अतिक्रमण करने जैसे गंभीर आरोप लगे हैं. अपने पत्र में डॉ ठाकुर ने कहा है कि पद के दुरुपयोग के इन गंभीर शिकायतों की जांच कराये बिना उन्हें प्रेस कौंसिल अध्यक्ष नियुक्त करना उचित नहीं दिखता है और इस पर पुनर्विचार की आवश्यकता जान पड़ती है.

Your Lordship,
I am Dr Nutan Thakur r/o 5/426, Viram Khand, Gomti Nagar, Lucknow, a social activist who works primarily in the field of transparency and accountability in public life. It has come to notice that Justice Chandramauli Kumar Prasad, ex Judge of the Hon’ble Supreme Court has been appointed as the Chairman of Press Council of India under the Press Council Act 1978.
It is kindly prayed that a very serious complaint of blatant misuse of authority are pending against Justice Prasad. It is as regards the complaint sent by me dated 01/01/2014 to the Hon’ble Chief Justice of India with a copy to you about Mr Shubhashish Sen Gupta son of late Dr. Jamini Mohan Sen Gupta of “ Yamini ” L / 3 and 3A, Road No. 17, Sri Krishna Nagar, P. S. Buddha Colony, Patna about which Sri Sen Gupta had previously sent to Your Lordship a complaint dated 25/12/2013 along with an Affidavit.
The complaint says that Mr Sen Gupta has been repeatedly demanding before various authorities for enquiries against certain personal misdeeds and improper acts of Hon’ble Justice Prasad in his individual capacity as Mr Sen Gupta’s neighbor but so far no authority has heeded to his complaint. The complaint says that Hon’ble Justice Prasad along with his brother Mr. Pinakpani Kumar Prasad and other members of his family are repeatedly misbehaving with Mr Sen Gupta, now himself a senior citizen and his wife. The complaint also says that previously a police officer in Patna Mr. Kumar Amar Singh, who had been entrusted this matter, had actually gone into the details and after having looked into the concerned issues had promised good behavior on part of the other side but things remain the same.
The complaint alleges “consciously plotting a criminal conspiracy, hating minority communities, willing to become a witness in a false case wholly plotted by him, trespassing others properties and injuring and beating up inmates and alike” etc against Hon’ble Justice Prasad. It also says that Hon’ble Justice Prasad’s son Mr Ardhendumauli Kumar Prasad is representing Bihar and UP as a lawyer in the Hon’ble Supreme Court.
Mr Sen Gupta has attached a huge list of documents to show that Hon’ble Justice Prasad and his family member, are misusing the extremely high constitutional authority conferred on him for petty personal gains and to belittle, humiliate and threaten an old neighbor.
As per Sri Sen Gupta, the neighbourhood dispute goes as far back as Hon’ble Justice Prasad’s father late Mr. K. K. Prasad being continued till today. It says that Hon’ble Justice Prasad himself hatched a criminal conspiracy to get Sri Sen Gupta’s family members arrested by the help of a new neighbor, Mr. Deo Sharan Shukla, who bought a vacant land at the adjacent west to their plot where he even assured them that, he would stand eye witness if such a case is anyhow lodged but later back tracked seeing danger of getting arrested himself for creating a false drama.
It is alleged that Hon’ble Justice Prasad and his family had criminally encroached a big chunk of their land on the intervening night of 23/24-12-1979 while recently, he directly took active part in getting their northern drain chamber quite criminally removed and constructing a new gate over it, blocking their water outlet causing damage to their property with the water logging in their drive-way at the time of rainfall.
Mr Sen Gupta alleges that it is Hon’ble Justice himself who got the recent illegal block of construction made over the set off area on the southern side of their house after illegally blocking their air light and view after jumping the Building By-laws of the PMC (earlier the PRDA) where they have even encroached upon a portion of the Main Road No. 17 of Sri Krishna Nagar, Patna on the southern side which the Housing Board had long marked as encroachment.
The complaint presents instance of a previous FIR against Hon’ble Justice himself which was later compromised by these two parties through Criminal Misc. No. 573 of 1986 (Chandramauli Kumar Prasad and another …. Petitioner Vs Tripti Sen Gupta………Opposite Party) through Order dated 3 / 8.8.91. It presents Order Sheet dated 8.8.91 of the Hon’ble High Court of Patna (being attached), various F I Rs presented to the local PS and other public authorities and the photographic depictions of alleged unauthorized and improper parking of official cars. It also shows photographs of alleged illegal construction in the house of Hon’ble Justice and throwing of garbage and other material on the pathway.
These are definitely extremely serious allegations against an ex Judge of the Hon’ble Supreme Court. Unfortunately neither the complaint sent by me nor that of Justice Prasad’s neighbor were ever enquired into and meanwhile Justice Prasad has been appointed as Chairman, Press Council which does not seem proper because it can be easily seen that any person against whom allegations of misuse of authority for neighbourhood dispute is found established, would never be deemed fit for getting appointed to us an important post.
Hence, it is being prayed that the appointment of Justice Prasad to Chairman, Press Council be withheld for the time being and an enquiry be undertaken as regards my complaint dated 01/01/2014 and the complaint dated 25/12/2013 sent by Sri Sen Gupta and to finally direct Justice Prasad to hold his position only after the enquiry, if the allegations are established to be true.

As per the complaint, the sitting Justice of the Hon’be Supreme Court of India was himself present in person at the time of fixing of the gate and giving directions to the mason and the labourers to his satisfaction after getting Mr Sen Gupta’s drain chamber removed without any fear of law so as to erect a big wide gate improperly.
Mr Sen Gupta alleges that it is Hon’ble Justice himself who got the recent illegal block of construction made over the set off area on the southern side of their house after illegally blocking their air light and view after jumping the Building By-laws of the PMC (earlier the PRDA) where they have even encroached upon a portion of the Main Road No. 17 of Sri Krishna Nagar, Patna on the southern side which the Housing Board had long marked as encroachment.
The complaint also says that the official cars of the Hon’ble Patna High Court is parked on and off for hours together at Mr Sen Gupta’s narrow northern entrance and exit hindering their movement knowingly when Hon’ble Justice’s house is already situated right on the main road having an all time benefit of 70 feet length of openness compared to their 15 feet road.
The complaint presents instance of a previous FIR against Hon’ble Justice himself which was later compromised by these two parties through Criminal Misc. These are definitely extremely serious allegations against a sitting Judge of the Hon’ble Supreme Court. The recent allegations against other senior members of Higher Judiciary clearly shows that all is not well here and this kind of alleged personal conduct (or misconduct) is bound to give extremely bad message in the society. A sitting Judge of the Hon’ble Supreme Court being alleged for this kind of open misuse of authority for such small personal gains and petty activities, is something the Higher Judiciary is least prepared for.
With due regards the kind of evidences and proof presented by Mr Sen Gupta are so many and look so apparent that they seem to establish his allegations beyond any reasonable doubt. As stated earlier, there is the copy of the compromise made before the Hon’ble Patna High Court, there is the copy of the FIR presented by a neighbor Mr Shukla which has Hon’ble Justice’s name as a witness, there are photographs of official and personal vehicles on the entrance road, there are photographs of the alleged illegal construction and there are copies of the innumerable number of previous complaints sent by Mr Sen Gupta. All these facts make it prima-facie quite apparent that something is going seriously wrong with Mr Sen Gupta so as to force him to write such a long letter for Justice to none else than the Hon’ble President himself, along with a host of documents and evidences. Otherwise, why would an old man try to fight with the immediate neighbor, that too Judge of the Hon’ble Supreme Court unless compelled to do so?
Hence it is humbly prayed that being the administrative head of the Hon’ble Supreme Court, Your Lordship may kindly personally advise and ensure that Hon’ble Justice Prasad does not get involved in such personal conduct and neighbourhood disputes because it is bound to be extremely counterproductive for him, for the entire Judiciary and the entire nation. A Hon’ble Judge of the Hon’ble Supreme Court has much better and much higher things to do than to fight and quarrel with a neighbor because the entire episode puts him in an extremely awkward and uncharitable position.
PRAYER
1. To kindly direct and ensure as the Head of the Indian Judiciary and as the administrative head of Hon’ble Justice Chrandramauli Kumar Prasad to get personally completely detached from the neighbourhood dispute of all kinds with Mr Shubhashish Sen Gupta and his family and if possible, to direct all his family members to refrain from any such further dispute and misuse of authority like parking the official/unofficial car in his pathway, obstructing his pathway, any illegal construction etc because the matter concerns not only Hon’ble Justice Prasad as an individual but also willingly or unwillingly gets involved the fact that he is a sitting Judge of the Hon’ble Supreme Court
2. To kindly look into the allegation of Hon’ble Justice Prasad’s son learned Mr Ardhendumauli Kumar Prasad being an advocate of Bihar and Uttar Pradesh government in the Hon’ble Supreme Court itself, particularly in the light of the fact that Hon’ble Justice Prasad has been a Judge of the Hon’ble Patna High Court and the Chief Justice of the Hon’ble Allahabad High Court as regards its propriety and appropriateness and to issue directions accordingly

Re : A serious complaint against Justice Chandramauli Kumar Prasad, (a sitting Judge of the Hon’ble Supreme Court of India).
With quite a heavy heart I am hereby compelled to reveal once again, the ongoing deep and intrinsic criminal propensities of the person named Mr. Chandramauli Kumar Prasad who later managed to get into the levels of the highly respected class of judiciary of this great nation who is now most unfortunately, one of the sitting Supreme Court Judges of India.
A copy of my earlier complaint dated 01.07.07 addressed to The Hon’ble Chief Justice of India, a copy of which was also sent to Your Excellency by Registered Post No. 3711 on 10.10.07 is attached herewith for your quick reference. Following to my said complaint, an enquiry was demanded by Your Excellency from Kotwali Police of Patna, but the matter was fully covered up by the officer named Kumar Amar Singh who conducted the enquiry.
Mr. Kumar Amar Singh did call me at Kotwali and had a formal discussion pertaining to your enquiry when I showed him many evidences against Justice Chandramauli Kumar Prasad at which, he was very surprised and tried to pacify me by ensuring me that, the said Justice won’t do anything like this again and accordingly, I stopped pursuing the matter further, the mistake which I now severely lament.
It was the same Mr. Kumar Amar Singh who earlier on 28.06.07 came to my house at the request of the other party to settle an issue when we had to lodge an F I R against Mr. Pinakpani Kumar Prasad one of the brothers of the said Justice Chandramauli Kumar Prasad for his utter misbehavior with my wife. That time also, I reconciled with what the said Mr. Kumar Amar Singh promised me if I showed my good gesture by not pursuing the FIR anymore. I did follow Mr. Singh with all humility hoping things would improve but, in vain.
Later, when I again had to complain to the CJI and Your Excellency under a compulsory situation and when your enquiry came, it was the same Mr. Kumar Amar Singh who once again managed to convince me not to pursue my complaint despite the evidences shown, probably as because then it was believed that, Justice Chandramauli Kumar Prasad was almost about to become a Supreme Court Judge and such a complaint can ruin his chances for managing a place at a further height.
We all know that, we live in one of the most corrupt nations of the world where dishonesty, unscrupulousness, nepotism and “ might is right ” is rife but still, things are changing for better though in a snail’s pace yet it should be welcomed. But here comes, yet another example of a Justice so corrupt by nature, propensity, practice, and what not and as a reason, we expect Your Excellency to take a stern and adequate action in this respect.
Can it be at all imagined that, a person consciously plotting a criminal conspiracy, hating minority communities, willing to become a witness in a false case wholly plotted by him, trespassing others properties and injuring and beating up inmates and alike, knowingly torturing and harassing people by his cruel and silly activities only to project power and status including instigating people against us, yet still can most surprisingly, manage to infiltrate in the high and the most respected class of the judiciary where only god alike people are expected to exist ?
Is it not an intense shame and terrible disgrace for a noble country like India who has gained independence over six decades ago and yet such things happen ? I have lived in England for around twelve and a half years or so but, never could imagine a judge so cruel by instinct. Even an ordinary person can put a serious complaint against any judge if found involved in corrupt practices. That is what now happening in India as well. People are openly discussing about the serious corruption within the judiciary and it has now become common place with no exception altogether.
Justice Chandramauli’s son Ardhendumauli is representing Bihar and UP as a lawyer is no surprise. It seems that, there are no better lawyers than Mr. Ardhendu in all over Bihar and Uttar Pradesh. How he got there one can easily imagine with a question of whether his father has made deals with the State Governments to oblige the officials later in time of need. Not to forget that, despite such despicable background, most surprisingly enough, Justice Chandramauli Kumar Prasad was further elevated to the Apex Court when Mr. K. G. Balakrishnan was the CJI who had been termed as the most corrupt Chief Justice of India.
What people can learn from the disgraced ex-Justices Saumitra Sen and A. K. Ganguli and now the other one as well ? If scrutinised, then many such Justices like Justice Chandramauli Kumar Prasad would be exposed who are sitting on a high chair of Justice god-alike when they are just the opposite and Justice Chandramauli Kumar Prasad’s case won’t take any time to be fully proven beyond any reasonable doubt. I am fully prepared to vigorously testify in any court of law to prove what he is been into since decades together.
Attaching herewith a list of documents which will sufficiently, categorically and lucidly prove that, the inclusion of Justice Chandramauli Kumar Prasad in the group of judges anywhere, is just a shame for the nation and no way it can be a matter of pride to the least. I after all, feel terribly melancholy and sad to bring about such a matter perpetrated by a sitting Supreme Court Judge and feel what a kind of judgment he might be coming up with, when he himself remains engrossed with so many dangerous demerits of unprecedented proportion within himself. It is a stupendous disgrace for all the law-loving citizens of India, no doubt.
To us, Justice Chandramauli and his family members have individually and jointly created a hell since we have taken the possession of our land next to the Justice ’s house who then had no pedigree at all, nor by ethics, nor by status, nor by education nor by family and not by any other background as such. The house was one of the filthiest house in our area to which we used to get terribly disturbed, the description Your Excellency would find in the F I R in HINDI given to the Buddha Colony Police Station but, with no action till date.
Every family member of Mr. Chandramauli to this day believes and behaves exactly what the Karta of Plot No. L / 4 the late Mr. K. K. Prasad used to behave and believed in. Justice Chandramauli’s father used to despise us thoroughly and used to vehemently pass nasty comments on our community and repeatedly warned us not to take possession of our land as we are members of a minority community. Then how can Justice Chandramauli grow up with noble ethics is a very simple matter to comprehend.
It was Chandramauli himself who hatched a criminal conspiracy to get we family members arrested by the help of a new neighbour who bought a vacant land at the adjacent west to our plot after six years of coming here. Justice Chandramauli even assured them that, he would stand eye witness if such a case is anyhow lodged but later back tracked seeing danger of getting arrested himself for creating a false drama and becoming a false eyewitness with an act of perjury to his credit. Mr. Deo Sharan Shukla our neighbour, once murmered that, it was solely Mr. Chandramauli’s idea to lodge the false case in which he wanted to give witness.
It is true to its bone that, had Chandramauli got chances to the least, he would have crushed us under his feet which he kept on longing for, but we started winning most of the court cases with the neighbour who quite criminally encroached a big chunk of our land on the intervening night of 23 and 24th December of 1979 at the advice of Chandramauli himself. Mr. Chandramauli very eagerly kept an eagle’s eye on the court developments to see us devastated but after seeing that we are winning in all circumstances he back tracked and started causing damage to us indirectly as far as possible which is going on even today.
Justice Chandramauli didn’t leave even a stone unturned to harass us whenever he could and even today what he is doing is mentioned in my FIR in Hindi Language sent to the Buddha Colony Police Station but the officers never dare to take action against any member of the Justice’s family nor the Kotwali wants to listen any complaint against them. I have sent letters to both the Police Stations under the RTI Act but, they have failed to answer despite sending reminder when Kotwali even refused to accept my Registered Post making a query under the RTI Act, the same unopened packet which is now being sent to Your Excellency for you kind perusal and necessary action. Your Excellency can well imagine what is going on in our country. Law is being flouted by the persons who are supposed to protect it but, in vain.
Recently, Justice Chandramauli directly took active part in getting our northern drain chamber quite criminally removed and constructing a new gate over it, blocking my water outlet causing damage to our property with the water logging in our drive-way at the time of rainfall, which is clearly evident even now which had already been shown to the police but, with no action again. A fresh enquiry is needed by a top level IPS officer with an impeccable background from outside Bihar or again the matter will be brushed up aside as usual.
It has clearly been observed that, the sitting Justice of the Hon’be Supreme Court of India himself present in person at the time of fixing of the gate and giving directions to the mason and the labourers to his satisfaction after getting my drain chamber removed without any fear of law as he himself is a judge and he knows that, no one can dare to ask him questions. To erect a big wide gate after 40 years ( despite having their own two gates on the main road ) just at our northern entrance and exit is to take an old revenge by regularly subjugating us as the Justice’s late father was ordered by the administration to remove their illegal construction just made on the substantial part of our said road.
It is Justice Chandramauli himself who got the recent illegal block of construction made over the set off area on the southern side of their house after illegally blocking our air light and view after jumping the Building By-laws of the PMC ( earlier the PRDA ) by showing foot to the law of the land himself when he should be protecting the same being a judge of the country that too, of the highest court of our great nation.
There are colossal examples of Justice Chandramauli’s delinquent behavior including most of the members of his family as well who remain fully charged with ego and pride as one of their family members is a judge. The other members of family of the said Justice Chandramauli Kumar Prasad have long asserted that, they would teach us a good lesson for the rest of our lives. They have even encroached upon a portion of the Main Road No. 17 of Sri Krishna Nagar, Patna on the southern side which the Housing Board had long marked as encroachment. The said encroachment also hinders our easy movement at the corners by the illegal encroachment made by the Prasad family which is amply evident at any time.
A complaint was made to the local Police Station and the Senior SP of Patna in this respect on dumping building materials and garbages quite knowingly at our northern exit and entrance blocking our way to and fro making our lives difficult in every possible way for more than two years, but the administration doesn’t dare to take action whether it is the Commissioner of Patna Municipal Corporation, or SHO of the local PS, or Kotwali Police or the Senior SP of Patna.
Further to the above, the official cars of the High Court is parked on and off for hours together at our narrow northern entrance and exit hindering our movement knowingly, is almost a common practice for Justice Chandramauli Kumar Prasad whenever he is here. Time and time again we have to blow horn in order to draw attention of the inmates of Plot No. L / 4 to remove their carx parked but to no avail when their house is already situated right on the main road having an all time benefit of 70 feet length of openness compared to our only 15 feet that too, half encroached by the Justice’s family and then cars are dumped in the remaining space on and off. Any sensible person would know the reason.
At the strength of Justice Chandramauli, rest of the members also purposefully disturb and torture us on a regular basis which can be proven with the help of photographs and physical evidences. For the past two years, they are not removing the said garbages and building materials making our lives even more traumatic and difficult. The access road is precisely meant for two plots falling at the back including ours but, after fully endorsing the cruel actions of the Justice, the rest members of the family also keep on doing the same on a very regular basis. But, we will not take it anymore.
Still, many things are yet to be told which is not possible to add on to this complaint any further to make this complaint even more hefty. But yes, the other family members of Justice Chandramauli Kumar Prasad are desperately looming forward to become Judges at the strength of the stature of Justice Chandramauli himself so that, they can also plunge into a elegant life style of a privileged person alike Justice Chandramauli Kumar Prasad himself doing anything without any fear of law while always trying to subjugate us . Whatever we are suffering today is a calculative effect of no other than Justice Chandramauli Kumar Prasad himself but, we have been painfully enduring ever since as usual due to many reasons which could be understood by any person with a common sense.
In fact, Justice Chandramauli Kumar Prasad has not only betrayed my innocent parents many times but also, has ruined our lives to a greater extent which cannot be compensated by any means. Needles to say that, the credibility of the collegium goes down to zero by unlawfully supporting Justice Chandramauli Kumar Prasad concealing all the criminality he has been most willingly indulging into after misleading the Law Ministry altogether. Nothing could be more betraying, frustrating and unfortunate than this for our great motherland India for whom millions of patriotic people selflessly shed their blood for emancipating us from the shackles of slavery.
However, I quite anxiously look forward to get an answer directly from Your Excellency to see if at all, actions are taken against the offenders of law no matter where they are sitting or have managed to reach anyhow. Just to recall here that, once I needed to write letters to Her Majesty, The Queen of England and Tony Blair (ex-PM of UK) and can proudly reveal that, I got quick replies from both the offices. Our motherland India may also not be far behind as I can believe after enjoying many decades of true independence and expect alike to get a quick answer from You’re Kind Excellency as well.

Affidavit
I, Shubhashish Sen Gupta (of around 60 years) son of late Dr. Jamini Mohan Sen Gupta of “ Yamini ” L / 3 and 3A, Road No. 17, Sri Krishna Nagar, P. S. Buddha Colony, Patna, do hereby solemnly affirm and declare as follows that :-
1). I have myself drafted the Complaint of four pages ( to which this Affidavit is attached ) against Justice Chandramauli Kumar Prasad who along with his family members have jointly and individually inflicted endless injuries on the mind and body of our family members since around four decades which we have been suffering from as being the members of a minority community.
2). The statements made in the different paragraphs of the four paged Complaint dated 25th December 2013 is absolutely true to my belief and understanding and whatever has been depicted herewith has been done under no fear or pressure of any kind from any quarter. The attached list of documents proves everything.
3). I fully assert here that, long before becoming Justice, the said Mr. Chandramauli Kumar Prasad trespassed our compound and beat me up badly after coming onto our southern side verandah of our Sri Krishna Nagar residence of Patna along with his brother Mr. Yahanvi Kumar Prasad and injured me as much as possible precisely to terrorise me permanently and we family members as an act of deep-rooted vengeance. A similar incident was also perpetrated by Chandramauli Kumar Prasad along with an accomplice with another family of a minority community in our vicinity to which we were the eye witnesses.
4). The compromise between Chandramauli Kumar Prasad and we family members was done under pressure and threatening so that, the prosecution charges against Chandramauli and another may be easily quashed on a later date as like in

5). I can testify all such matters and can vividly explain the incidences taking place here at any court of law for seeking justice including giving the descriptions of the persons involved in all round criminal activities perpetrated against us in different manners by the said Justice Chandramauli Kumar Prasad and his delinquent family including the lady members who individually and jointly have been settling a big score even today which if required, can be divulged in any court of law giving full explanation in front of the toughest lawyers of the country.
6). Many other incidences have also taken place here which have not been included in the written complaint but can be disclosed with full honesty whenever required. I believe that, following this complaint there is bound be violent retaliations later, but I am prepared for all eventuality.
7). Even lately, Justice Chandramauli Kumar Prasad is harassing us in different ways as an act of deep-rooted vengeance by his ill-gotten power and status. Copies of this set of papers would likely be sent to different places for information.
